ORIGINAL AND APPELLATE JURISDICTION OF COURTS

I. CRIMINAL CASES

COURTS ORIGINAL JURISDICTION APPELLATE JURISDICTION


1. Offences punishable with imprisonment not exceeding 6 years irrespective
Municipal Trial Courts / of the amount of fine and regardless of other imposable accessory or other
Metropolitan Trial Courts penalties including the civil liability arising from such offenses or predicated
(MTCs / MeTCs) irrespective of kind, nature, value or amount thereof “except in cases
falling within the exclusive jurisdiction of the Regional Trial Court and
the Sandiganbayan.”;

2. Where the only penalty provided for by law is a fine, the amount thereof
shall determine the jurisdiction of the court. The MTC shall have exclusive
original jurisdiction over offenses punishable with the fine of not more than
Php 4,000.00. (Adm. Cir. 09-94);

3. Offenses involving damage to property through criminal negligence;


4. Those covered by the Rule on Summary Procedure:

a. Violations of traffic laws, rules and regulations


b. Violations of the rental law
c. Violations of municipal or city ordinances
d. Violations of BP 22, otherwise known as Bouncing Checks Law
(AM No. 00-11-01-SC)

1. Criminal Cases not within the exclusive jurisdiction of any court, tribunal or
Regional Trial Courts body except those falling under the exclusive and concurrent jurisdiction of All cases decided by the MTCs in their respective
(RTCs) Sandiganbayan; territorial jurisdiction.

2. Offenses the imposable penalty for which exceeds 6 years imprisonment;


3. In cases where the only penalty is fine, the amount thereof shall determine
jurisdiction. If the amount exceeds Php 4,000.00, RTCs have jurisdiction
(Adm Cir. 09-94;)

4. Criminal cases under specific laws:


a. Written defamation;
b. Jurisdiction of designated courts over cases in violation of the
Comprehensive Dangerous Drugs Act of 2002
c. Violation of intellectual property rights

5. All cases on money laundering except those falling under the jurisdiction of
the Sandiganbayan

By Notice of Appeal:
Court of Appeals (CAs) Crimes of Terrorism under the Human Security Act of 2007. 1. From the RTC in the exercise of its original jurisdiction
except those appealable to the Sandiganbayan;

2. From the RTC where penalty imposed is reclusion


perpetua or life imprisonment or where a lesser
penalty is imposed but for offenses committed on the
same occasion or which arose out of the same
occurrence that gave rise to the more serious offense
for which the penalty of death, reclusion perpetua or
life imprisonment is imposed (Rule 122 as amended
by AM No. 05-03-SC)

By Automatic Review:
1. From the RTC in cases where the death penalty is
imposed.

By Petition for Review under Rule 42:


1. From the RTC in cases appealed thereto from the
lower courts and not appealable to the
Sandiganbayan.

1. Violations of the following: Appeals from the final judgment, resolutions or orders of
Sandiganbayan (SB) a. RA 3019 (Anti – Graft and Corrupt Practices Act); RTCs whether in the exercise of their own jurisdiction or

property;
b. Admiralty and maritime cases depending on the amount of demand and
claim;
c. Probate proceedings (testate or intestate) depending on the gross value
of the estate;
d. Demand for money depending on the amount;

2. If the assessed value of interest in the real property does not exceed Php
20,000.00 (outside Metro Manila) or does not exceed 50,000 (Metro
Manila).

3. Actions involving title to or possession of real property or any interest


therein depending on the assessed value;

4. Inclusion and exclusion of voters;


5. Cases falling under the 1991 Rules of Summary Procedure:

a. Forcible entry and unlawful detainer


b. Other civil cases except probate proceedings, where the total amount of
the plaintiffs claim does not exceed 100,000.00 (outside Metro Manila)
or 200,000 (Metro Manila) exclusive of interest and costs

6. Cases falling under the Rule of Procedure for Small Claims Cases

1. If the gross value, claim or demand exceeds Php 300,000.00 (outside Metro
Regional Trial Courts Manila) or exceeds Php 400,000.000 (Metro Manila); All cases decided by the MCTs in their respective
(RTCs) a. Actions involving personal property depending on the value of the territorial jurisdiction except decisions of lower courts
property; in the exercise of delegated jurisdiction.

declared in a state of suspension of payments.
