Greetings,

Please find attached here with petition advance copy to obey the orders passed by the Rajasthan High
Court 15585 of 2010 to accept Cow with National status, as it was passed on 31-5-2017.
As per section 9 (k) of the Prevention of Cruelty to Animals Act, 1960, AWBI fully empowered and
authorize to issue advisory about the utility of cow along with scientifically proved their products as
panchgavya.
As per 10 of the Prevention of Cruelty to Animals Act, 1960, AWBI fully empowered and authorize to
regulate the Cow as National Cattle of India.
When elephant can be adopted and accepted as National Heritage animals without any demand and
legislations, only National Board for Wildlife approved agenda then why not COW????
Please treat it as legal Notice as well, if above said proposal not considered within 15 days at the level of
AWBI then the United Nation affiliated “International Organisation for Animal Protection: www.oipa.org
OIPA – Scouts and Guides for Animals www.scouts-guides4animals.com will protest in front of the main
gate of AWBI, which can be permanently converted to hunger strike as well.

Grievance Description
Referring to Hindu religious beliefs that 33 crores Gods and Goddesses reside within the cow, the
Rajasthan High Court asked the central and state governments to declare the cow as India’s
national animal. In his detailed judgment, Justice Mahesh Chandra Sharma directed the state
government to coordinate with the Centre and communicate the court’s decision to have the cow
declared a national animal. Justice Sharma also directed the government to ensure that those
who kill the cow are given life terms. Among other things, the petitioners had sought that the cow
be declared the national animal, and its slaughter be made punishable by a life sentence for its
protection and conservation. The court also appointed the Chief Secretary and Advocate General
of the state to be the legal custodians of the cow. In its 20 point summary, the court has directed
the government to explore the possibility of declaring cow as the national animal. The court cited
the example of Nepal, where the cow is the national animal in consonance with the nation’s
Hindu status. The court also appointed a monitoring committee to oversee the implementation of
its orders. The committee has been authorized to file contempt petitions if its orders are not
implemented by stakeholders. The bench also granted liberty to any person or class of persons to
approach the court with a plea in a PIL to declare the cow as the national animal. In his order,
Justice Sharma also cited a number of good effects of cow milk and urine. Please find attached

On the eve of the World Thinking Day, today on February 22, 2018, I, Naresh
Kadyan, Commissioner (Headquarter), Bharat Scouts and Guides, Haryana
along with Rep. of OIPA in India, Master Trainer, AWBI / Volunteer of WCCB
and Chairman, People for Animals (PFA) Haryana thinking today about the
status of indigenous cow and their progeny, besides it very bad condition due to
the productivity, abandoned ship been tool of politics, whereas Animal Welfare
Board of India, easily can adopt COW as National Cattle of India, keeping in
view their qualities and disappearance of the census, which is decreasing day by
day. As per section 9 (k) of the Prevention of Cruelty to Animals Act, 1960,
AWBI can issue Advisory about the utility of cow, its urine, milk, curd, ghee
along with gobar, besides it as per section 10, AWBI empowered to issue
Regulations, adopting Cow as National Cattle of India. The United Nation

Description for Animals Abhishek Kadyan, Mrs. Suman Malik Kadyan with Mrs. Sukanya
Kadyan Berwal thinking about the toothless legislation's for animal rights and
their welfare, whereas AWBI failed to regulate the law concerned, animals and
birds are being badly abused during their transportation as goods in non ISI
vehicles, hence we expect that AWBI can establish Police Post with close circuit
cameras in front of its Head Office, at Delhi Agra National Highway No. 2 in
Faridabad District, to control and monitor the cruelty against animals. It would
also be pertinent to mention here that Cow Protection cell also introduced, its
Head Office also needs to be shifted in the premises of NIAW for best
coordination. JUST THINK on it ........... Replace the toothless PCA Act, 1960
and be tolerant about the presence of animals and birds in the circuses for
educational purpose, which is exempted under section 27 (b) of the PCA Act,
1960 but shadow activist be jobless, if AWBI follow the rules and regulations.

reducing day by day, protected by law its slaughtering all around in India except Kerala, Goa and North
East with West Bengal.

It is humbly submitted that:

1. As per article 48, every citizen of India has to work towards conservation of the cow
progeny, besides it, article 51 A (g) of Indian Constitution, defined the fundamental duties
of every citizen, to be humane and kind towards all living creatures other than human
beings.
2. As per census of 2012, as many as 1, 17, 209 Cow progeny declared as abandoned,
unclaimed and unproductive, which needs immediate attention for further treatment, care
and shelter because their life under threat due to garbage and polythene etc.
3. All these abandoned cow progeny are threat to the public life and property as well, being
public nuisance.
4. Section 3 of the Prevention of Cruelty to Animals Act, 1960, clarifies the responsibilities of
custodians of animals but all concerned officials are failed to implement the laws of the
land.
5. Neither Beef have medicinal values nor can bullock / ox be slaughtered after 15 years of
age, as permitted under the Haryana Prohibition of Cow Slaughter Rules, 1972.
6. Shifting of cow progeny from one place to another in the vehicles approved by the
concerned Authority as per Central Motor Vehicle (Eleventh Amendments) Rules, 2015
read with the Cattle Transport Rules, 1978 amended in 2001 and 2009.
7. The Govt. of Haryana constituted a Committee at each and every village to establish a
Cattle pond, which is not monitored by the DDPO and BDO’s, besides it Infirmaries
were also non functional, which were set up under section 35 of the Prevention of
Cruelty to Animals act, 1960, besides it feeding charges during court trials are not fixed
8. Five freedoms of animals are upheld by the Hon’ble Supreme Court of India, which are:
1. Freedom from hunger and thirst (food and water):
All animals deserve access to clean water and a well-balanced, nutritious diet. Freedom
from hunger and thirst provides for animals most basic needs by allowing that animal to
remain in good health and full of vitality.
2. Freedom from discomfort (shelter):
All animals should live in an appropriate environment. The conditions and surroundings
given to an animal contribute to its overall well-being. By providing an animal with shelter
and a comfortable resting area, you are ensuring that the animal remains healthy and
happy.
3. Freedom from pain, injury and disease (medical care):
All animals should be entitled to immediate veterinary attention when sick or injured to
avoid unnecessary suffering. In certain cases, unnecessary pain and injury can be prevented
through regular visits to a vet.
4. Freedom to express normal behaviour (exercise):
All animals should be allowed to express normal behaviours. A normal behaviour is the way
an animal acts in its natural environment. Enough space, proper shelter and housing as well
as adequate exercise, opportunity to play and the company of the animal's own kind
encourages the expression of normal behaviours.
5. Freedom from fear and distress (love and understanding):
All animals deserve to be happy. Ensuring conditions that avoid unnecessary anxiety and
stress will help to provide freedom from mental suffering. While favourable physical
conditions are essential, appropriate mental conditions are also important to good animal
welfare.
Prayers:

1. Implementation of the orders passed in Civil Writ No. 15585 of 2010 on 31-5-2017 by the Jaipur
Bench of Rajasthan High Court.
2. Declare cow as state cattle of Haryana, passing resolution in the Gau Ayog with AWB, Haryana.
Adopt cow progeny, for treatment, care and shelter along with old age Pension to these
unclaimed and unproductive cow progeny.
3. Status reports on the proper functioning of SPCA along with Infirmaries in the area.
4. Status reports on the implementation of the orders passed by the Government about the
establishments and proper functioning of animal fatak / cattle pond at each and every
village along with the restoration of Gauchar land, removing all encroachments.
5. Transportation of cow progeny as per the specifications of the Bureau of Indian standards.
6. Installation of animal scanner at toll tax barriers along with White paper on animal rights
and their welfare.
7. The Prevention of Cruelty to Animals (Transport of Animals on Foot) Rules, 2001 may
kindly be implemented after due endorsement along with the Prevention of Cruelty to
Animals (Regulation of Livestock Markets) Rules, 2017 and Prevention of Cruelty to
Animals (Care and Maintenance of Case Property Animals) Rules, 2017.
8. Annual Confidential reports of all concerned field functionaries, needs to be evaluate as
per their performances towards article 51 A (g) of Indian constitution.
9. Any other orders deems fit.

As per Indian Constitution, animal related legislation's can be prepared and


introduced by the State Governments only being animals as State subject but
there is a great confusion because sometimes Centers claims that animal in the
concrete list and they can make the legislation's, please find attached here with
petition moved by Naresh Kadyan after due consultation with Mrs. Sukanya
Berwal, Mrs. Suman Malik and Abhishek Kadyan. It would be pertinent to
mention here that Animal Welfare Board of India existed to look after the

Description AWD with AWBI will take up the attached petition with the Government of
Haryana for immediate attention and point wise reply along with the disposal of
following demands- 1. Appointment of Court Commissioner, to monitor the
honest implementations of the legislation's for animal rights and their welfare,
restoring five basic liberties of animals and birds. 2. Fast track court with time
frame policy for the disposal of animal abuse matter, introducing animal abuser
registry. 3. Pension for unproductive cow with the National Cattle of India
status.

The matter relating to the implementation of the animal welfare laws are to be
taken by the Government of Haryana. The Government of Haryana has already
established State Animal Welfare Board. The law enforcement is carried out by
the departments of the State Governments/UTs and the law enforcement
officials have to effectively enforce the law to prevent cruelty to the animals. The
Details : same may be brought to the notice of district administration or law enforcement
authorities for taking necessary action in the matter to prevent unnecessary
pain or suffering to animals and also to implement the directions of the Hon'ble
Supreme Court in its order dated 7.5.2014 for compliance. Hence, the matter
may be brought to the notice of the State Government of Haryana for taking
necessary action as per the provisions of the law.

Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 - 1. Section 4 (1) (c) of
the said Act, allowed cow slaughtering, subjected to experimentation in the interest of
medical, veterinary and public health research, whereas experimentation on animals,
like rat, mice and gunny pigs are prohibited, likewise cosmetics tested on animals, also
not allowed to import in India, hence cow progeny can’t be spared for any
experimentation. 2. Section 4 (3), removal of skin and hide from naturally dead cow are
allowed, to the authorized contractor and with the permission, same can be transported
by them but what about beef tallow, horn and bones of naturally dead cows, said Act is
silent, besides it Municipal Corporation at Panipat allowed tallow ownership to the
butchers?. 3. Section 8 of the said Act, allowed beef products, for medicinal purposes and
in such form as may be prescribed, whereas neither beef have medicinal qualities nor
prescribed by any Authority, communication through CM window also proved that not a
single permit was granted as per the Haryana Prohibition on Cow Slaughter Rules, 1972.
4. Section 12 allowed establishments of laboratories for testing of milk, differentiation of
beef from the meat of other species of animals but how and why cow skin and hide, horn
and bones be identified and certified that same be removed from naturally dead cow? 5.
Section 16 doesn’t allow, any common citizen, to perform their fundamental duties, as
Grievance defined under article 51 A (g) of Indian Constitution. 6. Section 17 (2)(4), provide two
:
Description opportunities to the owner of vehicle, involved in crime against cow progeny, before
order of confiscation and then before sale of confiscated vehicle, why twice? 7. A).
Section 19 (2)(a to d) allowed to make rules for cow slaughter, as defined under section 4,
whereas experimentation on cows, seems to be objectionable. B). Section 19 (2)(f)
allowed, to make rules for beef or beef product can be sold under section 8, whereas no
need to frame any rules for this purpose, as explained above. C). Section 19 (2)(i) allowed
to make rules for cow transportation, either by road, rail and on foot, whereas cow can
be shifted in ISI specified vehicles, as per their shape and size, after obtaining pre
transport clearance about vehicles. Declare Cow as state animal of Haryana, without
disturbing black buck, as it was done in Rajasthan, being camel and chinkara, as their
state animals. It would also be pertinent to mention here that the said legislation is silent
on the punishments for the violation of the rules made out under section 19, whereas
animal can be slaughtered as per Slaughter House Rules, 2001. 8. Section 20 (1) repealed
the Punjab Prohibition of Cow Slaughter Act, 1955 and (2) allowed anything done or any
action taken under repealed Act and rules, shall be deemed to have been done or taken
under this Act, hence all under trials case property, like vehicles involved needs to be
confiscated. As per (3), Haryana Prohibition of Cow Slaughter Rules, 1972 are adopted
as rules, till new rules to be framed under this Act.

Grievance Description
Referring to Hindu religious beliefs that 33 crores Gods and Goddesses reside within the cow, the
Rajasthan High Court asked the central and state governments to declare the cow as India’s national
animal. In his detailed judgment, Justice Mahesh Chandra Sharma directed the state government to
coordinate with the Centre and communicate the court’s decision to have the cow declared a national
animal. Justice Sharma also directed the government to ensure that those who kill the cow are given life
terms. Among other things, the petitioners had sought that the cow be declared the national animal, and
its slaughter be made punishable by a life sentence for its protection and conservation. The court also
appointed the Chief Secretary and Advocate General of the state to be the legal custodians of the cow.
In its 20 point summary, the court has directed the government to explore the possibility of declaring
cow as the national animal. The court cited the example of Nepal, where the cow is the national animal
in consonance with the nation’s Hindu status. The court also appointed a monitoring committee to
oversee the implementation of its orders. The committee has been authorized to file contempt petitions
if its orders are not implemented by stakeholders. The bench also granted liberty to any person or class
of persons to approach the court with a plea in a PIL to declare the cow as the national animal. In his
order, Justice Sharma also cited a number of good effects of cow milk and urine. Please find attached

OIPA Scouts and Guides for Animals Ch. Om Parkash Kadyan, Mrs. Saroj Grewal, Mrs. Sharda
Kadyan, Sahil Grewal, Preeti Malik Grewal, Abhishek Kadyan, Mrs. Suman Malik Kadyan with Mrs.
Sukanya Kadyan Berwal asked AWBI to consider and compliance on attached judgment within 15
days to avoid unnecessary litigation, whereas AWBI have power and Authority to issue advisory under
section 9 (k) and Regulations under section 10 of the Prevention of Cruelty to Animals Act, 1960 and
advisory on the qualities of panchgavya can be issued for educational purpose, besides it regulate the
National Cattle of India as census of cow reducing day by day, protected by law its slaughtering all
around in India except Kerala, Goa and North East with West Bengal.
