Employer's Council. Your complaint was referred to me per Joint Rule 38

is what | have endeavored to provide. | appreciate that you have fully cooperated with and
maintained the confidentiality of this process.
After thorough review of the evidence related to the complaint, including witness statements and
reports, as well as an independent legal opinion, my assessment supports a different conclusion
than those reached by Employer's Council in their investigative report.
‘White it is possibie that the complainant's Allegation #1 (as numbered in the Employer's Council
report) could be construed to be a violation of policy, the specifics of that allegation are not
consistent as they are reported in the written complaint, to the media, and the Employer's Councit
investigation. As such, there is no definitive determination that the policy was violated. | have been
advised that the remaining allegations (Allegations #2-#4) do not in any way allege a violation of our
workplace harassment policy.
Itis also important to note that none of the complainant's accusations constitute a violation of state
or federal employment laws. | reach that conclusion after consulting with legal counsel and
discussing the Employers Council's report with their Vice President
This has been a learning experience for all of us. Itis noted that you have already participated in the
required workplace harassment seminar as well as an additional voluntary seminar with the Senate
Majority Caucus. Therefore, in light of my review, and the seminars already attended, | have
determined that corrective action based on this complaint is unwarranted, and that this investigation
is therefore concluded.
