A Deeper Look into the 'Destructive

Deviations' of Shaykh Yahya Al-

Point 1:

He falsely accused Uthmaan bin Affaan (radhi Allaahu ‘anhu) of

innovating in Islaam.
We shall attempt to present these points to you one by one in a series
in order that each point can be examined properly and correctly, due to
the statement of Allah:

‫ﭽ… ﮌ ﮍ ﮎ ﮏ ﮐ ﮑ ﮒ ﮓ ﮔ ﮕﮖ ﮗ ﮘ ﮙ ﮚ ﮛ ﭼ‬
٤٢ :‫األنفال‬

…So that those who were to be destroyed might be destroyed after a clear
evidence, and those who were to live (i.e. believers) might live after a clear
evidence. And surely, Allâh is All-Hearer, All-Knower. Surah 8:42

١٧٤ :‫ﭽ ﮕ ﮖ ﮗ ﮘ ﮙ ﮚ ﭼ األعراف‬

Thus do We explain the Ayât (proofs, evidences, verses, lessons, signs,

revelations, etc.) in detail, so that they may turn (to the truth). Surah 7:174

٥٥ :‫ﭽ ﮀ ﮁ ﮂ ﮃ ﮄ ﮅ ﮆ ﭼ األنعام‬

And thus do We explain the Ayât (proofs, evidences, verses, lessons, signs,
revelations, etc.) in detail, that the way of the Mujrimûn (criminals, polytheists,
sinners) may become manifest. Surah 6:55

Firstly, we shall present to you an audio wherein the first point was
asked directly to Shaikh Yahyaa on the 26 day of Rabbe’ Al-Awwal 1434
Hijri(7 day of February, 2013), so let us listen to his response…

With regard to the first adhaan of the day of Jumu'ah, Abu Khadija then
attempts to restrict this statement to Shaykh Yahya –may aid him-.
However, the reality is that Shaykh Yahya in his book Ahkaamul-
Jumu’ah clearly mentioned nearly thirty scholars from the time of the
Sahaabah up until the scholars of our era who have said statements
similar to his. Some of them openly declaring the first adhaan on the
day of Jumu'ah to be an innovation while others have stated that it is a
newly invented matter which was brought about by ‘Uthman. These
scholars being the likes of :

1)ABDULLAH IBN UMAR(radhi Allaahu ‘anhu):

Imam Abu Bakr Ibn Abee Shaybah mentions in his book ‘Al-Musanaf’ *P.140 V.2+:

I was informed by Shabaabah who said,: I was informed by Hishaam Bin Al-Qaaz, from Nafi, From Ibn
Umar- May Allah be pleased with him said: “the first Adhaan on the day Of Jumah is an innovation [And
every Bidah is an innovation, even if the people see it to be something good] –the chain of narration is
sahih to Ibn Umar.


Ibn Abi Shaybah mentions [P.140 V.2]: I was informed by Hushaym, from Mansoor, from Hassan Al-
Basri- Rahimahullah-: the first call to prayer on Jumah (is the one) which occurs when the imam enters-
meaning his sitting on the mimbar- as for the one before that (the first adhaan) then it is newly
invented. –this is a Sahih chain of narration to Hassan al-Basri-rahimahullah- and its men are all


Ibn Abi Shaybah Mentions *P.140 V.2+: I was informed by Husaym, from Ash’ath, from Az-Zuhri who said:
“the first person to newly invent the first Adhaan was Uthman – RadiyallahuAnhu- so that the people of
the market are called (to prayer)” – this chain is la-bas to Az-Zuhri. As for Hushaym he is trustworthy.
Ash’ath: the son of Abdul Malik al-Himraani is Trustworthy.


Abdur-Razzaq mentioned in ‘Al-Musanaf’ *P.205 V.3+ from the narration of IbnJarir, he said: I was
informed by Ataa’: “the athaan for jum’ah used to be when the imam ascends (on the mimbar), that is
when business transactions are prohibited. As for the athaan which is called nowadays before the imam
exits (to the masjid) and sits (on the mimbar) then it is falsehood” – the chain of narration is sahih.


Abdur-Razzaq mentions [P.206 V.3] from Ibn Juraij: I was informed by Amr Bin Dinaar “the first person
to add the first athaan on jum’ah was Uthman. They used to make an athaan over the (people of)
Zawaraa’. As for (who started it) in our city, Al-Hajjaaj.- the chain of narration is sahih.


Amr Bin Dinaar said with the previous chain: “I saw ibn Zubair and the athaan was not called until he sat
on the mimbar, and it was not called for him on Jum’ah except one adhaan.- It was mentioned by
Haafidh Ibn Rajab in ‘Fathul-Baari’ *P.218 V.8] and the chain of narration is sahih to Amr bin Dinaar. As
for Ibn Juraij: he is an Imam, he also stated that he was informed by Amr Bin Dinaar. As for Amr Bin
Dinaar he is Al-Jum’hee, an Imam. He students are Sufyan Ibn Uyaynah and he said regarding him:
“Trustworthy! Trustworthy! Trustworthy!”.


Ibn Rajab mentions in his ‘Fathul-Baari’ *P.219 V.8+: that Abdur Rahman said: “there was not in the time
of the Prophet except two adhaans (the adhaan& the iqaamah), when he sits on the mimbar, and
another athaan when the prayer is stood for. Then he-Rahimahullah- said: “as for this one which is
present now- meaning the athaan of Uthman- the people innovated it after him (the Prophet). –
Recorded by Ibn Abee Haatim-Rahimahullah.


Ibn Rajab mentions in his ‘Fathul Baari’ *P.219 V.8+: Sufyan Ath-Thawree said: “the adhaan for Jum’ah is
not called until midday, and when the mu’adhin calls to prayer the Imam stands on the mimbar and
gives the sermon. When he descends (from the mimbar) the Iqaamah is called. The athaan that used to
be called at the time of the prophet, Abu Bakr and Umar was (only) one athaan. As for the athaan it was
added (Uthmans First Athaan), then it is Muhdath (newly invented).


He-Rahimahullah- mentioned in his book ‘Al-Um’ *P.173 V.1+ : “Ataa’ used to deny that Uthman newly
invented it(the first athaan), he would say: Muawiyah newly invented it. Whomsoever it may be, the
way it was in at the time of the prophet is more beloved to me”.


As-Sarkhasii said: “they differed in regards to the adhaan which they considered to be the one which
obligates coming (to attend jum’ah) and which prohibits business transactions”. So At-Tahaawi used to
say (regarding the previous differing): “it is the athaan (called) at the minbar when the imam exits (to
the masjid). Because (this athaan) was the origin at the time of the prophet when he would exit and
ascend onto the mimbar, likewise in the time of Abu Bakr and Umar. After that, the people newly
invented the athaan of Az-zawaraa’. From ‘Al-Mabsuud’ *P.134 V.1+ also ‘Al-MafaatiihSharhMishkaat Al-
Masaabiih’ *P.498 V.3+.


“The first athaan on jum’ah was newly invented. Newly invented by Uthmaan” – this narration was
mentioned by Ibn Rajab in his ‘FathulBaari’ *P.220 V.8+.


Recorded By Waki’, from the way of Hishaam Bin Al-Qaaz: I asked Nafi’ about the first Athaan for jum’ah
and he said: “Ibn Umar said: ‘Innovation’ and every innovation is misguidance”. –the authenticity of this
chain to Nafi’ has been mentioned previously.


The author of ‘Minhal Al-Athab Al-Mawruud Sharh Sunan Abee Daawuud’: “as for what occurs from the
two athaans in one place (in the masjid) or one of them in the masjid and the other on top of the masjid,
then this is not in accordance to what our leader Uthman was upon, neither (in accordance) to what the
prophet was upon, nor Abu Bakr and Umar. Because verily the objective/goal that he was trying to
achieve by adding this adhaan was to make the people of Az-Zawraa hear it due to them not hearing it
being called inside of the masjid, and he did this when the population of the people (in Madinah)
increased thus the homes becoming more widespread and distant. When the people gathered in the
masjid, and the khateeb sat on the mimbar, the mu’athin would make a second athaan at the door of
the masjid or on the roof as it was in the time of the prophet, abu Bakr and umar.

So the goal that Uthmaan was trying to achieve by newly inventing this adhaan, it is not found in our
time. As we do not see an athaan being called far away from the masjid. Therefore it is requested to
suffice with one athaan on the day of jum’ah, as it was in the time of the prophet and his two
companions Abu Bakr and Umar”.


He-Rahimahullah- was asked regarding the prayer after the first Athaan on the day of Jum’ah, was it
performed by the Prophet or any of the Sahaabah, Taabi’een and the Imams or not? –He-Rahimahullah-
answered: “All praise is due to Allah, as for the prophet then he wouldn’t pray anything before jum’ah
after the athaan, and no one has reported this from him. In the time of the prophet, the athaan wasn’t
called except when he ascended on the mimbar and bilal would call the athaan. The prophet would then
give two sermons (the two sermons the khateeb gives with the sitting down in between them) then Bilal
calls the iqaamah and the prophet leads the people in prayer ‘Majmu Al-Fataawa’ *P.188-189 V.24] also
‘Al-Kubraa’ *P.139 V.1+


He-Rahimahullah- transmitted a lack of differing regarding it (the first Athaan) being a newly invented
matter. “The hadith indicates that the athaan that was at the time of the prophet, abu Bakr and Umar
was the athaan made in front of the Imam when he sits on the mimbar, and there is no differing
between the Ulamaa’ regarding this”..Until He said: “and whomsoever claims that the athaan that was
at the time of the prophet was the first Athaan which is before the imam comes out (for the sermon)
has lied and this hadith disapproves him claim. There is a consensus of the Ulamaa upon that.” ‘Fathul
Baari’ *P.916 V.8+


Author of 'Aaridatul Ahwathi Sharh Sunan At-Tirmidhi’ *P.305 V.2+ on his explanation on the hadith of
Saa’ib ibn yaziid: “and what is better than what has been mentioned that:”the first legislation to be
changed in Islam was the first Athaan”


“As for the legislated athaan immediately after the imam ascends (on the mimbar) regarding this there
is no differing. This is how it was at the time of the prophet, Abu Bakr and Umar. When it was Uthman
(his caliphate) he added a third athaan for the people of Az-Aawraa (a marketplace in Madina).

As for the athaan which prohibits trade and necessitates attending (the khutbah) it is (the athaan) which
occured at the time of the prophet.” ‘Muqni’ *P.162-163 V.3]


“The athaan that occurs now first of all wasn’t in the time of the prophet, nor Abu bakr and Umar.
Rather it was done by Uthman ‘Al-Muraad Min-al-Madqal [P240 V.2]

He-Rahimahullah-also said on *Page.207+: “..the Sunnah in regards to Jum’ah is when the imam ascends
on the mimbar”.


A question was posed to the the Shaykh-Rahimahullah:

Question: “Do you see (the permissibility) of following Uthman with regards to the second athaan?


“We do not see following the example of what Uthmaan did unrestrictedly.. We previously mentioned
that he-RadiyallahuAnhu- added the second athaan for a reasonable cause, which was the increase of
the people (of Madina) and the distancing of their homes from the prophets masjid. So whosoever
decides to turn his sight away from this(previously mentioned) cause/reason and then unrestrictedly
holds fast to the adhaan of Uthmaan, then he will not be following the example of the Prophet(j), but
rather he will be in opposition to it, due to him not looking at the main point being considered(ie. the
increase of the people and the distancing of the houses) and if it wasn’t for this cause, Uthman wouldn’t
have increased on his (the prophets) Sunnah –Peace and Blessings be upon him- and the Sunnah of the

Then he-Rahimahullah-said: “in summary, we see that the athaan al-Muhamadi (the prophets Athaan)
to be sufficient and that it(the athaan) be when the imam exits and ascends on the mimbar”.’Al-Ajwiba
An-Naafi’ahAlaaAs’ilatLajnahtul-Jaami’ah’ *P.6-11]


He said on the explanation of Surah Jum’ah verse 9: “the athaan at the time of the prophet was the
same as the rest of the prayers (it was) when the prophet sat on the Mimbar, and likewise Abu Bakr,
Umar and Ali in Kufah. After that, Uthman added a third athaan on his residence which was known as
‘Az-Zawaraa’ when the people increased in Madina.


“As for the first athaan, then it is newly invented. It was done by Uthman bin Affaan to alert the people
(of Az-Zawraa) to attend the Friday sermon when Madinah expanded and its people increased ‘Tafseer
Al-Qurtubi’ *P.100 V.18+.


Imam Abul-Waleed Sulayman Bin Khalf Al-Baaji’-Rahimahullah- said: “Malik was asked regarding the call
(to prayer) on Jum’ah, Does it occur before it enters its time?” He said: “it does not occur until the sun …


“As for the intended athaan in it *the hadith: “whoever hears the athaan and does not respond (by
attending the sermon) there is no prayer for him”-reported by Bayhaqi in his sunan] it is the known
legislated (athaan): which is the athaan when the khateeb sits on the mimbar, and it also the intended
athaan in the verse [when the call is proclaimed for the salah on Friday, come to the remembrance of
Allah and leave off business 62:9]. As for the call which the author intended here, then it is something
which opposes the known legislation, and an innovation newly invented by Uthman” *Haashiyah Thaw-
An-Nahaar Lil-Jalaal P.103 V.2]


“it is as it has been said, that the athaan for jum’ah is not called before its time, and its time is midday,
the same as the prayer of Dhuhr for the rest of the days. Then he-Rahimahullah- mentioned that there
was no athaan (for jum’ah) in the time of the prophet until he sat on the mimbar. And that Uthman-
RadiyallahuAnhu- added the first athaan. He-Rahimahullah-then said: “the action of the prophet has
more right to be followed”

He-Rahimahullah- was asked: “is the first athaan for Jum’ah a sunnah?”. He-May Allah preserve him-said
at the end of the answer: “we have come to know from this, that the first athaan is not a sunnah, and it
is not befitting for a muslim to act upon it. Uthman did ijtihaad,In regards to ijtihaad, then (the
mujtahid) may be correct (in his ijtihaad) or incorrect”. *Summarized from: Ijaabatus-saa’ilalaaahamil-

Shaykh Yahya Mentions in his book ‘The Rulings of Jum’ah and its Innovations’ *Page 410+: “Mentioning
those who made a ruling concerning the first Athaan for jum’ah to be newly invented and an

summarized to only twenty or so] who have preceded him in making a ruling on this newly invented

In short, this supposed “destructive deviation” that Abu Khadija began

his article with, due to his ignorance and blind following of his Shaykh
Al-Barmaki, has turned out to be slander, not only of Shaykh Yahya but
rather of all of these great scholars of Al-Islaam who have said likewise.
Note that Shaykh Yahya is not alone in this statement nor has he done
anything worth criticizing.
As a final benefit in the completion of this first ‘destructive deviation’ a
questioner may ask; “Does it not necessitate that if the first adhaan on
the day of Jumu’ah is a newly invented matter and an innovation that
‘Uthman–may be pleased with him- is an innovator”?
The answer to this is no! And the people of knowledge have mentioned
that if a scholar falls into an innovation then this does not necessitate
that he is an innovator.
Shaykh Yahya himself in the same book that they claim he accused
'Uthman –may ‫ اهلل‬be pleased with him- 'of innovating into Islaam' (i.e.
Ahkaamul- Jumu'ah pg.315 -first print-)he summarized his research
about the first adhaan being an innovation by saying;
Some of the stubborn ones may say; "if you say that this adhaan is an
innovation, was 'Uthman when he did that (adhaan) an innovator?
We say, (we seek) refuge in . For 'Uthman –may be pleased with
him- is a rightly guided Khaleefah and surely the Messengerj said
"Why should I not feel shy from the one whom the Angles feel shy
And hej said "who will purchase the well of Rooma and for him is
the Jannah? So 'Uthman purchased it and left it for the Muslims.
And hej said to Abu Musa (about 'Uthman may be pleased with
him-) "allow him to enter (the house) and give him glad tidings of the
Jannah upon tribulations which will afflict him", Shaykh Yahya then
said;) and all of these (previously mentioned) narrations are authentic
on the Messenger of from them is that which is in the Saheehain,
and from them is that which is saheeh outside of the Two (i.e.
Saheehain), and 'Uthman –may be pleased with him- possess many
virtues other than that (which was mentioned). And it suffices him
that he was given glad tidings of the Jannah…until he said;
However, he –may be pleased with him- practiced ijtihaad and so
appointed a muadhin (a person to call the adhaan) in the market in
order to notify the people of the nearness of the time of prayer (i.e.
Jumu'ah), and this adhaan was not in the Masjid, as some of the
people do now, and (even) with the dissimilarity of the state of some
of the people now, then surely we hold that adhaan (i.e. the first
adhaan on the day of Jumu'ah) originally not to be legislated and that
Ameer Al-Mu'mineen(The leader of the Believers 'Uthman bin 'Affaan)
erred in this ijtihaad of his. And he is with this ijtihaad of his and his
good intent rewarded. And he is a shaheed (martyr) and from the ten
(Companions) who were given glad tidings of paradise and his sin is
forgiven. But as for the one who follows him in that error after the
evidence is made clear to him, then he is in this an innovator. He has
no excuse in opposing the Sunnah of the Messenger j and his two
Companions (i.e. Abu Bakr and 'Umr –may be pleased with them.
Rather Shaykh Rabee’ bin Haadi–may grant him success- stated in a
short treatise of his titled “Mumayizat Al-Hadaadiyah pg.2” which he
wrote in the year of 1423/2/20 which corresponds with 3/5/2002 when
some of the deviants the likes of Abul-Hassan Al-Marabi wrongfully
accused students of knowledge in Yemen to be Hadadiyah. Shaykh
Rabee’ listed a number of the distinct characteristics of the Hadadiyah
for the people to be aware of them. From the distinct characteristics
that he mentioned is that they declare anyone who falls into an
innovation to be an innovator. He said;
.‫ ّابي حجش عٌذُن أشذ ّ أخطش هي سٍذ قطب‬،‫ قْلِن بتبذٌع كل هي ّقع فً بذعة‬-

‘Their proclaiming to be an innovator everyone who has fallen into

an innovation and Ibn Hajr with them is worse than Sayid Qutb.’
And he also stated:
‫ ّ ُْ إرا ألصقْا بإًساى قْال ّ ُْ بشيء هٌَ ّ ٌعلي‬،‫الحذادٌة لِن أصل خبٍث‬-
،َ‫ فإًِن ٌصشّى على االستوشاس على سهً رلك الوظلْم بوا ألصقٍْ ب‬،ٌَ‫بشاءتَ ه‬
.‫فِن بِزا األصل الخبٍث ٌفْقْى الخْاسج‬

-‘ The Hadadiyah have an evil principle which is, that if they label a
person with a statement that he is free from and he declares his
innocence (from), then surely they persist continuing to accuse that
oppressed (individual) with what they labeled him with. And they
with this principle (of theirs) surpass the Khawaarij.’

Fear your Creator O Abu Khadija! And known that your plotting and
scheming is being written against you.

٢ :‫ﭽ ﭞ ﭟ ﭠ ﭡ ﭢﭣ ﭤ ﭥ ﭦ ﭧ ﭨ ﭩﭼ يونس‬
Say: “Allâh is more Swift In planning!” Certainly, Our Messengers (angels)
record All of that which You plot. Surah 10:21

‫ﭽ… ﭨ ﭩ ﭪ ﭫ ﭬ ﭭ ﭮﭯ ﭰ ﭱ ﭲﭳ ﭴ ﭵ ﭶ ﭷ‬
١٥٢ :‫ﭸ ﭹ ﭼ األنعام‬

…"And whenever you give your word (i.e. judge between men or give
evidence), say the truth even if a near relative is concerned, and fulfil the
Covenant of Allâh. This He commands you, that you may remember." Surah

‫ﭽ ﮨ ﮩ ﮪ ﮫ ﮬ ﮭ ﮮ ﮯﮰ ﮱ ﮲ ﮳ ﮴‬
‫﮵ ﮶ ﮷﮸ ﮹ ﮺ ﮻ ﮼﮽ ﮾ ﮿﯀ ﯁ ﯂ ﯃ ﯄ ﯅ ﯆ ﭼ‬
٨ :‫المائدة‬
O you who believe! Stand out firmly for Allâh as just witnesses; and let not the
enmity and hatred of others make you avoid justice. Be just: that is nearer to
piety; and fear Allâh. Verily, Allâh is Well-Acquainted with what you do. Surah

These several supposed ‘deviations’ of the noble Shaykh Yahya bin Alee
Al-Hajooree -may  aid him- 'written' by Abdul-Wahid also known as
Abu Khadija were posted on some internet sites. Abu Khadija described
these 'deviations' of ShaykhYahya Al-Hajooree by saying “a single one
of these affairs is destructive, then how much more when he has
numerous deviations.” Hence for the noble readers not to be misled
by his statements, the points which require mention in Abu Khadija's
article will be scrutinized and academically disproven by the leave of ‫اهلل‬.
What should be known from the beginning however, is that all of these
so-called ‘destructive deviations’ which Abu Khadija has mentioned
return to one of four main factors:

1. An error that had occurred from Shaykh Yahya which he retracted

from years ago, yet they continue to mention it for reasons which are
known to ‫ اهلل‬.
2. An obvious lie which was fabricated upon Shaykh Yahya by some of
the hizbees years ago which they have been handing down to each
other, fitnah after fitnah until it ended up in the hands of Abu Khadija
by way of his veiled Shaykh Al-Barmaki.
3. A statement of Shaykh Yahya which they have altered and twisted in
order to deceive and misguide the people. Whilst also attempting to
tarnish his honor by it.
4. A statement of Shaykh Yahya which in fact is not an error to begin
with, however due to Abu Khadija’s deep-rooted ignorance, he has
added it to his list of ‘destructive deviations’.
Throughout the course of these articles - willing-the reality of these
‘deviations’ will become clear to the just reader. Then it shall be known
to all whether Abu Khadija is an honest person seeking to clarify the
truth, or he is a deceitful individual who has silently been lurking and
waiting for an opportunity to bring forth what he has been concealing
for so long until Shaykh Rabee’ –may grant him good health and
wellbeing- spoke.
