The article explores the ethical and legal issues that arise due to the consumption of alcohol
and other drug (AOD) screening of patients suffering from trauma, particularly regarding
the confidentiality of the patient under the federal regulations. The author established that
testing for AOD abuse sometimes involves violation of the individual's privacy. In the case
of United States v. Eide, the court declared that the records in the emergency department
were protected and could not be used for prosecution of a patient in the criminal
