Subject: Public hearing: Appeal of the Washoe County Planning Commission's approval of Tentative Subdivision Map Case
Number WTM18-001 (Lemmon Valley Heights). The project is a 206-lot single-family residential, common open space
subdivision......

Included in this packet you will find the following:

1. Affidavit for Tammy Holt-Still, Lemmon Valley Swan Lake Recovery Committee with all attachments for verification of
"Standing" and/or "Aggreived" to hear merits of appeal.

2. The presentation of the appeal for WTM18-001 (Lemmon Valley Heights) based on merits for the appeal of the approval
by Washoe County Planning Commission.

In Summary: Standing

Tammy Holt-Still, Lemmon Valley Swan Lake Recovery Committee submit that the appellant has standing in this case due
to the following reasons:
1. The proposed development has the potential to increase the amount of drainage to Swan Lake, which remains in
flood stage nearly one year after it expanded with runoff and snowmelt from 2016-2017;
2. The effects of the proposed development on the hydrologic response of the Swan Lake watershed have not been
considered in the context of commercial and residential development that has occurred since the 2007 study North
Valleys Flood Control Hydrologic Analysis and Mitigation Options City of Reno and Washoe County, Nevada,
study.
3. The geographical definition of standing does not account for the off-site effects of drainage from the development,
which have the potential to disrupt traffic and damage property well beyond a 500 foot proximity to the property;
4. The appellant does not have the resources to prepare and submit an analytical report of the type referred to in Red
Rock Valley Ranch, LLC v. Washoe County 127 Nev. 451 254 p3d 641 (2011). The type of analysis needed would
be similar to the 2007 report cited above and should be part of a comprehensive planning process that
acknowledges and estimates the potential for changes in hydrologic response (including from rainfall and
snowmelt) associated with changes in the amount of impermeable surface added to the watershed since the 2007
report was completed.
5. Flooding, potentially exacerbated by drainage from the development, can threaten public safety in this community
when/if Lemmon Drive becomes impassable for emergency vehicles as already demonstrated this last month.
6. During the 2017 flooding in Lemmon Valley, the 11493 Tupelo St. residence was flooding and has evidence to
support this statement.

In Summary of: The Appeal of the Washoe County Planning Commission Approval of WTM18-001 (Lemmon Valley
Heights) be granted for the following reasons:

1. After analysis of the above mentioned project by Mark Walker, hydrologist and professor with the University of
Nevada, Reno. Mark has been engaged by the Thriving Earth Exchange program of the American Geophysical
Union, that partnership established through our participation in the National Coalition of Flood Survivor Groups
set up by the nonprofit, Flood Forum USA.
2. Violations of NAC 445A. 285 and Washoe County Developmental Code 110.416.57 for the Washoe County
(Lemmon Valley) Reclamation Facility.
3. Soon expiration and request denial of the project by NDEP because of the Washoe County (Lemmon Valley)
Reclamation Facility.
4. Violations of NRS 278.335 Tentative Subdivision Map (a) no letter from the Truckee Meadows Fire Department;
(b) no letter from Truckee Meadows Water Authority; (c) no letter from Washoe County Health Department for the
above-mentioned authorities.
5. Public Safety for the slow response of emergency services due to distance of staffing and closure of major
thoroughfare. Alternative routes are not adequate or maintained for safety response.
6. Tentative Map does not match Washoe County Master Plan zoning M1 and M2.

In closing: The motions to be made at this time are:

Tammy Holt-Still, Lemmon Valley Swan Lake Recovery Committee has "standing" and/or "aggrieved" to move forward to
hear the merits of the appeal on WTM18-001 (Lemmon Valley Heights).

Tammy Holt-Still, Lemmon Valley Swan Lake Recovery Committee's merits to the appeal are valid and we move at this
time to overturn the approval of WTM18-001 (Lemmon Valley Heights) tentative map by Washoe County Planning
Commission pending completion of a comprehensive hydrologic response and drainage analysis that accounts for
snowmelt, rainfall, effluent, any recharge program and increases in impervious surface in the Swan Lake watershed since
the completion of 2007 Quad Knof study referred to in point 2 related to "Standing," above.
