Copyright
Copyright, according to Dictionary.com, is "the legal
right granted to an author, a composer, a playwright,
a publisher, or a distributor to exclusive publication,
production, sale, or distribution of a literary, musical,
dramatic, or artistic work."
Copyright is a form of intellectual
property which gives the creator
of an original work exclusive
rights for a certain period of time
in relation to that work.
Copyright laws are based on the belief that anyone
who creates an original, tangible work deserves to be
compensated for that work, that compensation
encourages more creative works, and that society as
a whole benefits from the creative efforts of its
members. Copyright laws, therefore, are designed to
protect a creator's right to be compensated and to
control how his or her work is used.
Copyrighted works must be:
1. Tangible
2. Creative
An idea cannot be copyrighted.
If you use a copyrighted work without authorization,
the owner may be entitled to bring an infringement
action against you.
Guidelines to Protect You, Your
Students, and Your School:
Educators and students can use copyrighted materials
within the following constrains:
1. Material was lawfully acquired
2. 10% or 3 minutes (whichever is less) is used of
a motion pictured
3. 10% or 1000 words, whichever is less is used of
a text
4. 10% or no more than 30 seconds is used of
music or lyrics
5. 250 words or less of an entire poem or portion
of a poem
Personal software may be installed on one school
computer for limited personal use or use with students.
Software licensed to your school may be copied for
limited job related use at home.
Your Job as an Educator:
