3 THE COURT: We're in chambers. Cause
4 1822-CR00642, State of Missouri versus Eric Greitens.
5 The Court has recessed the hearing that was being
6 conducted in open court. Mr. Pedersen's here from the legal
7 staff, I believe most everyone knows him.
8 With the allegations that have been made in open
9 court and with the preliminary documents and argument in
10 support of those allegations, I feel it's incumbent upon me,
11 before the State put anything further on the record, to
12 advise Ms. Gardner and that any further reference is going
13 to be under oath and that, Ms. Gardner, unfortunately, I
14 need to advise you that you have the right to have an
15 attorney, to consider the advice of an attorney.
16 The allegations that I'm referring to is that in
17 documents and argument it seems that you were in the room
18 when the basis of the defendant's allegations of subornation
19 of perjury were made, and I don't take that as true. What
20 I'm taking that as it's a severe enough allegation that I
21 felt it was incumbent upon me to recess and make sure that
22 there was a record before anything further was said and
23 that's what I'm doing right now. Do you understand that?
24 MS. GARDNER: Yes, I do.
25 THE COURT: Mr. Steele, there's also been

1 allegations of perjury by Mr. Tisaby. I'm not sure, and Mr.


2 Pedersen's going to have to help me, I'm not sure what my
3 authority is at this point, as far as investigation of that
4 allegation, whether your office will need to conduct that
5 investigation or make sure that that investigation is
6 handled with regard to the criminal perjury that has been
7 alleged.
8 So I don't need an answer on that at this point,
9 but that is another basis of this recess is that there's a
10 prima facie showing here there may have been criminal
11 perjury and who investigates that needs to be determined.
12 Okay?
13 MR. STEELE: Yes, your Honor.
14 THE COURT: So, frankly, I don't know where
15 to go from here as far as when to reopen this hearing. Do
16 you have any requests? I felt that, I don't know -- didn't
17 know the extent of, Ms. Gardner, your office's knowledge of
18 what was going to be presented today, but I felt that you're
19 entitled to -- I felt it may have been somewhat -- the
20 extent of the allegations may have been somewhat of a
21 surprise, and I felt that it would be fair that you had time
22 to respond to it and time to respond to it based on the
23 admonition that I've put in the record.
24 So I'll take a suggestion from your office as to
25 when we complete this -- the rest of this hearing.
