Sir:

This is to request for reconsideration of Resolution No. 24, Series of 2015 of the Board of
Trustees, Carlos Hilado Memorial State College (CHMSC), disapproving award of contract to
Assentia Construction, Inc. with the lowest calculated and responsive bid amounting to
Php102,836,026.31 for the construction of the Three (3) Storey Engineering and Technology
Green Building of the CHMSC in its Talisay Campus, Talisay City, Negros Occidental due to
presentation of spurious documents resulting to misrepresentation.

You BAC in its Resolution No. 014, S. 2015 declared our bid as the lowest calculated and
responsive bid and recommended to the BOT it’s approval.

The alleged spurious documents adverted to in the BOT Resolution are the sworn statements of our
nominated Project Engineer, Materials Engineer and Foreman where according to the BOT, there
are inconsistencies in the said documents compared to their signatures in the PRC issued IDS.

With all due respect to the Board of Trustees of CHMSC, while there may be inconsistencies in the
signatures of our nominated Project Engineer, Errel John Merino, Materials Engineer Jessie Babiera
and Foreman, Alistair Jacalan in their submitted sworn statements compared to their signatures in
their PRC issued IDs, the alleged inconsistencies do not ipso facto make their signatures in their
sworn statements forged. Truth is, Messrs. Merino, Babiera and Jacalan, had executed affidavits,
marked as Annex “A-1”, “A-2” and “A-3” attesting and admitting that the signatures appearing
above their names in the sworn statements are theirs. These admissions having been made in public
instruments, in law, are conclusive, incontrovertible and irrefutable, having been made by no less
than the persons who affixed their signatures on the documents and with full knowledge of their
consequences.

In view of the foregoing considerations, we trust you will make the appropriate representations to
the Board of Trustees of CHMSC to reconsider its Resolution No. 24, Series of 2015 and give due
course to our request for reconsideration and consequently bestow its approval to your BAC
Resolution No., 014, S. 2015, for reasons therein stated .
