The City Government’s intent to

covers a comprehensive and inclusive
opportunity for deserving and qualified
students regardless of culture, status,
race or political color gives priority to
those who are in the margins. Education
Champion Mayor Oscar Moreno once
again exemplified his laudable service
by making scholarships a priority agenda
for this year by increasing the number of
scholarship grants.
The Response
Authored by Councilor Suzette Magtajas-Daba,
chair of the Committee on Education in the City
Council together with the members of the City
Council approved the 2018 Scholarship Code.
The Program
This year’s applications reached 2,046
students. Only 1,309 applicants were admitted
to the program for this school year. Including the
current scholars who are graduating this year, a
total of 1,504 students are being supported by the
City Government.
The Benefits
All scholars will enjoy the privilege of full tuition
and matriculation scholarship and a monthly stipend.

Foolish investors
IT’S quite funny how foolish investors
are flocking our police departments after
being victimized by
Plateau’s Voice investment scams.
One of my in-
vestigator police
friend laughed at
these people because
according to them,
when these people got
millions in income at
Cesar Gorillo their first few months
of investment when the
scam did not yet collapse, they never
shared their income and they simply
kept silent about it. Now that the scam
has collapsed, they will bother the police
department with those complaints know-
ing full well that they will never recover
their investments anymore.
Only this day, I opened my TV and
saw the news of an OFW who invested
his P1 million in hard-earned money
from Qatar and could never recover it.
Another police officer obtained loans
and even got fellow investors to place
their investment through him totaling
P3 million and there is no way he can
recover it and had to face angry co-in-

Conclusion
THIS being the last of a series of 10 arti-
cles, you would have figured out by now
that in using the term
“technology”, I do not
just mean information
and communications
technology (ICT), but
“science and technolo-
gy” (S&T) in general.
I really do not know
Ike Señeres who it was that lumped
“information” and
“communications” together as if it is one
technology, but for sure I can tell you
that as it actually happened, practically
everything that is in the realm of S&T is
now affected by, or is benefited by ICT.
That is absolutely true and nobody can
argue with that, but somewhat related
to that is the saying that nowadays, if
you are not doing electronic commerce,
you are not doing commerce at all. That
however may be too broad of a state-
ment, because what was projected to
become a “paperless” society ultimately
became a society with “less paper”.
In theory, it could be said that practi-
cally all cabinet level departments have
the opportunity to promote one form of
technology or another, either as ICT or

These kinds of scams arose when the
Bitcoin fever hit the world as those who
initially invested 10 dollars found their
invested grew to 50 thousand dollars.
These Bitcoins later metamorphosed into
so many types of Bitcoin investments
and hit the world like a tornado. There
are Bitcoin investment that are consid-
ered legal as in the US, but China and
Korea have totally banned it resulting
in its 50-percent decline in investment
value across the world. I don’t have any
question on this type of investment be-
cause it has not been considered legal in
the US and some countries. Even Phil-
ippine government investment in-charge
are planning to draw policies on this.
But the problem is that so many in-
vestment scams pretending to be Bitcoin
investment are rising like mushrooms.
I made a research on this and there
are only five questions that should be
answered and if the response is no, then
that investment is a pyramiding or Ponzi
scam:

S&T. In particular however, it could be
said that the Department of Science and
Technology (DOST) and the Department
of Information and Communications
Technology (DICT) have more opportu-
nities to promote technologies than the
rest of the others. Rather than make this
topic sound more technical than ever, I
would rather ask what good things the
society needs and after that, we could
just ask what technologies would be
needed in order to provide for these
good things. If we will do it this way,
I am very sure that we could do many
good things for society, and it does not
even matter what technologies are need-
ed in order to make it happen.
Regardless of whatever cabinet level
department is involved however, what
is very basic is that their starting point
is policy, and by that I mean the policy
basis to promote or deploy one form of
technology or another. Once the policy
basis is established, it would be very
easy to derive programs, plans and proj-
ects that could go under it. By the way,
as an aside, it could be said that any gov-
ernment project that has no policy basis
is most likely corrupt, because for sure
it would not have the benefit of having

booklet where I also tucked my senior
citizen ID card. The store clerk then
told me the total amount was some-
thing around P750. In fairness, the total
amount was much lower than those in
other drug stores whose gross amount
hover around P800 pesos for the same
quantity, brand, and specifications of
medicines.
When I gave the store clerk my
booklet and ID, she told me, “Sir, three
percent ra among ihatag nga discount.”
I rejoined, “Dili 20 percent sa senior
citizen?” Her reply was, “Dili, sir, three
percent ra gyud kay mao na ang instruc-
tion sa amo sa tag-iya.”
I repeated the question and the reply
was a consistent only-three-percent-dis-
count-for-senior-citizens. Therefore,
at only three percent straight discount,
the net amount would have been P727.

With some Facebook subscribers
posting selfies several times daily, an ab-
sent First Lady becomes breaking news
for a media used to narcissistic politi-
cians and celebrities. Public image does
include assuring the madlang pehpohl
that everything is fine, thank you. There
was even a suggestion for her to have a
selfie with the day’s newspaper as proof
of life. Gosh. Pehpohl are too praning
in this age of CGI and superhero films.
Good thing Tom Cruise has continued
doing his stunts, with “Mission: Impos-
sible—Fallout” as the latest proof of his
non-CGI action scenes. And—tsan tsan
tsa ran!—he’s now filming “Top Gun:
Maverick.” How about that for nostal-
gia, eh?
Cruise definitely knows the impact of
perfect timing, you know, “Strike while
the iron is hot,” as the saying goes.
I, on the other hand, have lost the es-
sence of perfect timing. For example, I
remembered to have the house’s air-con-
ditioners cleaned only on Friday after
Pagasa announced two low-pressure
areas for the weekend and the arrival
of the rainy season in the second week
of June. So, cooler days ahead with an
abaniko enough to keep the hot flashes
away, thus, allowing the hard-working
air-conditioners to finally have their
much-deserved post-summer vacay. But
there I was, having them cleaned. Talk
of delayed reaction.
You reach an age, though, when a
delayed reaction is necessary in think-
ing things over. Overthinking does not
exactly help you morph into the Think-
ing Pinoy but sometimes it’s required
in weighing the pros and cons. You
reach a certain age after making a lot of
decisions for many years, from spur-of-
the-moment ones to choices made after
a year of reckoning.
There are people who don’t even
think twice about their choices and have
to live with the dire consequences for
the rest of their life. Thoughts of what-if
and if-only will then haunt them forever
and ever, amen. Who wants that kind of
existence, filled with regrets? No one.
Peace of mind is crucial to a truly joyful
life. To be able to sleep at night, and to
wake up in the morning while looking
forward to the possibilities.
Overexposure to Facebook may lead
to depressing thoughts but it’s through
some FB posts that we learn about toxic
people, toxic relationships and toxic
friendships. There’s that friend who
sighs and says, Hahay, toxic kaayo sa
office ganiha. But the morning after,
she’s up early and arrives at the office
on time. When she says, toxic, it doesn’t
mean she hates her job, she’s simply
describing how it was for that particular
day.
Toxic people, toxic relationships and
toxic friendships, however, are another
story. They’re people and situations that

WE need to give due attention and
care for our spiritual faculties of the of ours. We just cannot allow them
intellect and will. As our Christian
faith tells us, of all the powers At the Core guided by what our senses
and capabilities we have,
it is the intellect and the
will that make us image
and likeness of God
before all the other com-
ponents of our humanity,
like our body, can partake
of the same dignity.
That’s simply because
these powers of ours enable
us to know and to love, and Cimagala faculties of intellect and
therefore, allowing us to enter
into communion with the objects of
our knowledge and love. They are
spiritual powers that transcend the
dynamics of our physical or materi-
al constitution, i.e., our biological,
chemical make-up, etc.
As such, these powers of ours
are capable of receiving and acting
not only on things of nature, but
also on the spiritual and supernat-
ural realities. A philosophical term
is applied to this phenomenon.
And this is called their “obediential
potency,” that allows them to be
elevated to the supernatural order,
to the world of grace, the world of
the spirit and of God.
As a Catholic dictionary would
put it, obediential potency is “the
capacity to receive either a mi-
raculous change or a supernatural
perfection that exceeds the natural
capacities of a being.” Of all the
creatures of God, we, together with
the angels, have that potency.
It stands to reason therefore that
we have to give due attention and

to develop on their own, simply
can discern.
They have to be inspired
and guided by the things of
God who give us a share not
only of his knowledge but
also of his very life through
the gifts of faith, hope and
charity, or the gift of grace in
general.

hope and charity, they can only go
anywhere and nowhere, and in fact
can expose and lead us to a lot of
dangers.
Indeed, they can be our worst
enemy, our gravest curse!
Without faith, hope and charity,
or without grace, we may know a
lot of things and get involved also
in significant human affairs, but we
will fail to reach the goal meant for
us. We would be prone to get entan-
gled in controversies and endless
contentions.
That is why nowadays we see
a lot of controversies and wran-
glings, bashings, not to mention
sins that are now considered as the
right things to do, like abortion,
contraception, corruption, same-sex
marriage, divorce, etc.
With faith, hope and charity, or
with grace, we get to see and be-
have beyond the physical sense and
to reason beyond the human sphere.
In short, we get to reflect the life
and the ways of Christ in our own
lives, Christ who is the very pattern
of our humanity and the redeemer
of our wounded humanity.
To be sure, letting our intellect
and will to be inspired and guided
by faith, hope and charity does not
undermine the natural operations
of these spiritual faculties of ours.
If at all, it will only enhance their
functions, using them in their fullest
potentials.
With faith, hope and charity,
our intellect and will can avoid
getting trapped in a bubble that
isolates them from the spiritual
and supernatural world. With faith,
hope and charity, even the smallest
and insignificant activity of these
spiritual faculties can acquire an
eternal value.
We need to see to it that our
intellect and will are truly inspired
and guided by these theological vir-
tues, going deep in our knowledge
of the doctrine of our faith, availing
of the sacraments, developing the
virtues, and waging a lifelong ascet-
ical struggle.

The sinner and his sin. It is
said that we have to love the sinner
but hate the sin. I suppose that’s
simply because what is wrong is sin
itself, but the one who committed
it, though he may be guilty of what
he did, is still a brother or a sister of
ours whom we have to love and help
to get back to the right way.
It is easier said than done, of
course. What usually happens is that
we are easily overtaken by our feel-
ings and emotions and, in a sense,
throw the baby with the bath water.
That is, while we hate the sin for the
inconvenience, damage and other
evils it causes, we end up hating the
sinner also. This is a very common
phenomenon.
We have to find ways of dis-
tinguishing the sinner from the sin.
But the basis for this effort to keep
loving the sinner in spite of his sins
is the example of Christ. We need to
meditate often on the life and death
of Christ, because it is where we are
shown how to love the sinner while
hating the sin.
And the example of Christ is
clearly that of proclaiming the truth
about what is right and wrong, what
is good and evil, and of offering
forgiveness for everyone, even if the
requirements of justice were not fully
met yet. Anyway, with what we owe
Christ, we can never fully fulfill the
requirements of justice.
This is something we have to
learn as early as possible.
We just have to deepen our
knowledge of what is right and
wrong, what is good and evil, and
conform our life to it as best as we
can. And then like Christ, let us be
quick to forgive, or at least, to offer
forgiveness, just as we have to be
quick to ask for forgiveness if we are
ones in the wrong.
Of course, we should also be in-
terested in living as best as we could
the requirements of justice among
ourselves. But we should also real-
ize that no matter how much we try
to live justice, we can never have it
perfectly. And the last word we have
to give is that of mercy. Mercy is
the ultimate expression of justice.

Like Christ, we have to be
willing to bear the burdens of the
others. That’s precisely what St.
Paul said in his Letter to the Gala-
tians. “Carry each other’s burdens,”
he said, “and in this way you will
fulfill the law of Christ.” (6,2)
Yes, Christ just bore all our sins
to save us, to bring us back to where
we came from and to whom we be-
long—God. He just had to forego the
requirements of justice to reconcile
us with God. That was why he just
kept silent when he was tried and
sentenced to death in the most unfair
trial of all times. He did it to save us.
That is the attitude we ought to
have when we are faced with the
sins of men. While sins will always
be sins and ought to be condemned,
we have to do everything, including
foregoing justice and just handing
mercy, to save the sinner.
We may even have to find
excuses for the sinner who can be
ourselves too. Not only that, we
can and should take the initiative
to bring the sinner back to the right
path, even if that effort would meet
resistance and hostility.
In other words, let’s have the
magnanimity of Christ, his heart
that is full of love and compassion.
Otherwise, if we just get stuck with
our concern for justice, we will
never end in our wrangling, our
quarreling, our animosities, etc.
Remember, the sinner is still our
brother or sister. He or she is still a
child of God.

funds generated?
• Does it make regular
financial report?
If the answer is no to
these very important ques-
tions, the investment is a
100-percent pyramiding
scam because the income
does not come from busi-
ness but through new in-
vestments recruited by the
members. It is a matter of
time that it will collapse
because it cannot anymore
pay the millions or billions
in overdue earnings once
all possible investors have
been recruited and there
are no longer new ones. Of
course, the new investors
will earn in a few months
or years but can no longer
recover their millions in
investment when the in-
vestment scam collapses.
Then the investor will find
out that the Internet records
that always appear on their
cellphones and computers
are no longer there. Biglang
naglaho parang bula! And
they have nowhere to re-
trieve them.
In the Philippines, the
so-called “huloga scam”
where a P10-investment will
become P400 has long col-
lapsed but later resurfaced in
the so-called Aman Futures
and Rasuman scams that of-
fered interest rates as high as
45 percent in 30 days which
victimized hapless investors
a total of P30 billion.
Now, many investment
scams are surfacing, offer-
ing as high as 30 percent
investment. One invest-
ment scheme came to me
personally and asked that if
I have P1 million, I will re-
cover my investment within
four months because they
will be offering 30 percent
earnings per month and
even brought me to their
office to show that they are
really paying their investors
and that was true. Many
have long recovered their
investments and even had
to re-invest their principal
including interest earnings
with a P1-million invest-
ment expected to grow to
P10 million in less than
two years. Who will not
be convinced? Many are
putting their hard-earned
money there.
I never invested. I’d
rather invest my money in
jewelry, land or building or
time deposits in coopera-
tives because I know they
will grow, not in hundred
percentages in a few months
but low but sure increase
in a much longer time. I’d
rather be 100-percent sure
than shed rivers of tears
later because I was conned
and could never recover the
money that I might lose.
I have worked with the
Regional Trial Court and
up to now people are still
following up on their cases
against Legacy Plans with
P20 billion in unpaid in-
vestments of “Double Your
Money in Five Years” long
after its owner had died. The
biggest of them all, the Mul-
titel of Balajadia, victimized
two million Filipinos with
unpaid investment of P100
billion.
I know that these types
of investments will surely
fail because the interests
are so outrageous because
no business in the world
will give you that kind of
return per month. Even
San Miguel Corp., with
its mega-billion business,
can only give at its highest
twelve percent dividends
on your investment for the
whole year.
To regret later for a cost-
ly venture is one memory
that will be very hard to
erase from our frail minds.

we could even say that these
projects were either invent-
ed or inserted. Going back
to our main topic however,
we should go direct to the
point and say that all of
these departments should
really identify what policies
they could formulate in
order to promote or deploy
whatever technologies are
available to them.
Also in theory, it could
also be said that ICT is
merely a derivative of S&T
and it could even be said
that as offspring, ICT will
never ever be completely
weaned from its mother. To
put it another way, there will
never be an end to the many
ways and means that S&T
could improve and upgrade
ICT, in more ways than one.
From another perspective, it
could be said that all these
departments could strate-
gize on their own as to how
they could have their own
initiatives in support of both
S&T and ICT. For practical
reasons however, it would
be more relevant to say that
whatever these departments
are planning to do however,
it should always be S&T
and ICT driven, otherwise
it would not have a rhyme
or reason, and that would
be like saying that it might
have a body, but it would
have no soul. Perhaps that
would be akin to saying that
whichever department im-
plements a project without
a policy basis, then the head
of that department would
have no soul.
What should we do if
the potential use of both
S&T and ICT would require
the actions or the partic-
ipation of more than one
department? That question
seems to be relevant when
it comes to the objective
of building or develop-
ing “smart cities”. When it
comes to this objective, the
obvious question is which
departments should be in-
volved in it? And which
should be the lead agency?
To answer that question,
the obvious answer is the
Department of Interior and
Local Government (DILG),
since the cities are supposed
to be under the DILG. That
answer is not sufficient
however, because other
agencies are needed in order
to bring “smart solutions”
to the problems of energy,
connectivity, water and
recyclability, among others.
That is just an initial list, be-
cause there are many more
solutions that could make a
city “smart”.
Aside from understand-
ing what “smart cities”
are, the officials of Local
Government Units (LGUs)
should know how to differ-
entiate between words that
are usually confused with
each other, for example
poverty reduction vs. pov-
erty alleviation, landfill vs.
dumpsite and drainage vs.
sewerage. Not understand-
ing one or more of these
differentiations could re-
sult in poor planning, even
with the use of both S&T
and ICT. That is probably
what happened in Boracay,
as the LGU officials there
seemingly did not know
the difference between
drainage and sewerage,
and that is why there was
no local implementation of
laws pertaining to Sewerage
Treatment Plants (STPs).
We now know that Boracay
does not have STPs, but do
we know whether they have
a landfill or a dumpsite?
And after many years of
having a tourism boom, was
poverty reduced, or was it
just alleviated?

BE IT ORDAINED by the Sangguniang Bayan of Maigo, Lanao del Norte.

SECTION 1. Title. This Ordinance shall be known as Anti-Bora-Bora Ordinance.

SECTION 2. Definition of Terms.

a) "Decibel" - is a unit used to express the magnitude of sound pressure and sound
intensity, based on a logarithmic scale, of the ratio of the magnitude of a particular
sound pressure to a standard reference pressure of 20 micro pascals.

b) "dB(A)" - means the sound pressure level in decibels measured on the "A" scale
of a standard sound level meter having characteristics defined by the American
National Standards Institute, Publication ANSI s1.4-1971.

c) “Motor vehicle” - refers to any vehicle propelled by any power other than
muscular power, using a road whether publicly maintained or privately owned,
but excepting road rollers, trolley cars, street-sweepers, sprinklers, lawn mowers,
bulldozers, graders, fork-lifts, amphibian trucks, and cranes, vehicles which run
only on rails or tracks, and tractors, trailers and traction engines of all kinds used
exclusively for agricultural purposes.

d) “Muffler” - means a device consisting of a series of chambers or other mechanical

designs for the purpose of receiving exhaust gas from an internal combustion
engine and effective in reducing noise.

SECTION 3. Prohibited Acts. Except as otherwise provided in Section 4 hereof,

it shall be unlawful for;

(1) Any person to use or operate any motor vehicle so modified as to cause loud
and unnecessary or unreasonable noise including the noise resulting from exhaust,
which clearly audible from nearby properties and unreasonably disturbing to the
quiet, comfort or repose of other persons; and

“A RESOLUTION ON ANTI-SMOKING OF MAIGO, LANAO DEL NORTE.”
WHEREAS, the Republic of the Philippines, under the Framework Convention on Tobacco
Control (FCTC) to which it is a Party, determined to give priority to the right to protect public health
and to promote measures of tobacco control based on current and relevant scientific, technical
and economic consideration, and agreed to implement the measures provided in the treaty;
WHEREAS, the Local Government Code of 1991 (Republic Act No. 7160) accords every
local government unit power and authority to promote the general welfare within its territorial
jurisdiction, including the promotion of health and safety of its constituents;
WHEREAS, the Philippine Clean Air Act of 1999 (Republic Act No. 8749) declares the right
of every citizen to breathe clean air, prohibits smoking inside enclosed public places including
public vehicles and other means of transport, and directs local government units to implement
this provision;
WHEREAS, the Tobacco Regulation Act of 2003 (Republic Act No. 9211) prohibit smoking
in certain enclosed or outdoors, prohibits the purchase and sale of cigarettes and other tobacco
products from and to minors and in certain places frequented by units to implement these
provisions;
WHEREAS, scientific evidence has unequivocally established that tobacco consumption and
exposure to tobacco smoke cause death, disease and disability; lead to devastating health,
social, economic and environmental consequences; and places burdens on families, on the poor,
and on national and local health system;
WHEREAS, scientific evidence has shown that there is no safe level of exposure to tobacco
smoke; that effective measures to protect from exposure to it requires the total elimination of
smoking and tobacco smoke; and that approaches other than 100% smoke-free environment,
including ventilation, air filtration and the use of designated smoking areas (whether with separate
ventilation systems or not) have repeatedly been shown to be ineffective;
WHEREAS, the Municipality of Maigo, Lanao del Norte recognizes that local governments
must act with urgency to denormalize the culture of smoking and tobacco consumption through
comprehensive and proven effective tobacco control measures as increasing number of Filipinos
die each year of tobacco-related diseases such as stroke, heart disease, and various cancers,
among others;
WHEREAS, it is the policy of the Municipality of Maigo, Lanao del Norte to promote the
health and welfare of its citizens;
WHEREFORE, on motion of SB Member Dailina R. Perang, jointly seconded by all members
present, it was;

“ANTI-SMOKING ORDINANCE OF MAIGO, LANAO DEL NORTE”
BE IT ORDAINED by the Sangguniang Bayan of Maigo, Lanao del Norte.
SECTION 1. TITLE. This Ordinance shall be known as ANTI-SMOKING ORDINANCE OF
MAIGO, LANAO DEL NORTE.
SECTION 2. COVERAGE – It shall be unlawful for any person, all minors below 18 years
old to smoke or allow smoking in a public utility vehicle, government-owned vehicle or any other
means of public transport for passengers, accommodation and entertainment establishment,
public building, public place, as defined in Section 3 (e) hereunder, enclosed public place, or
in any enclosed area outside f ones private residence, private place of works, cars owned by
the government or duly designated smoking areas, within the jurisdiction of the Municipality of
Maigo, Lanao del Norte.
SECTION 3. Definition of Terms.
a.) Smoking – refers to the lighting and/or puffing of any lighted cigarette, cigar, tobacco or
any other kind, form or type. Possession of any lighted cigarette, cigar, tobacco and the like
within the prohibited areas for smoking shall constitute a prima facie evidence as an act of
smoking prohibited under this Ordinance.
b.) Public Utility Vehicle – refers to Public Utility Jeepneys (PUJs) Public Utility Buses
(PUBs) taxis, tricycles and other public utility vehicles used in the transport of passengers;
c.) Accommodation & Entertainment Establishment – refer to restaurants, fastfoods,
eateries, hotels, motels, lodges, inns, boarding houses, disco houses, videoke bars, resto
bars, and movie houses, or any other place with pleasant environment and atmosphere
conducive to comfort, healthful relaxation and rest, offering foods, sleeping accommodation
and recreation facilities to the public for a fee;
d.) Public Building refers to any of the following :
1.) A building structure owned by the government or owned by a private person but
used, rented or occupied by the government or any of its instrumentalities;
2.) Any building or structures used, or controlled exclusively for public purposes by
any department or branch of government, local government unit or barangay without
references to the ownership of the building;

e.) Public Place – refers to gasoline stations, bank, malls, town squares, terminals, shopping
business arcades, schools, churches, hospitals, cinema houses, gymnasiums, funerals
parlors, barber shops, and other similar places where people usually congregate either to

to Maigo Public Plaza.
f.) Designated Smoking Room/Area – refers to a delineated room inside the accommodation
establishment, or public place or enclosed public place, which is totally enclosed where a
person is allowed to smoke without violating this Ordinance. Any duly designated room/
area in accommodation and entertainment establishments whether tourism accredited or not,
within the territorial jurisdiction of the Municipality of Maigo, defined, provided, the following
conditions are met:
1.) If the accommodation and entertainment establishment is not air-conditioned, it must
establish and designate a smoking area which should have proper ventilation or an open
space located in or within 10 meters from entrances, exits or any place where people pass
or congregate.
2.) The designated smoking area shall not be larger than 10 square meters.
3.) No government building shall have more done one designated smoking area.
4.) No food or drinks shall be served in the designated smoking area.
5.) All smoking area shall be covered by a Certificated of Compliance (COC) from the
Municipal Government.
G.) Enclosed Area - refers to an area which is closed whether totally or partially at the sides
and is roofed or make use of the flow above it as a ceiling, or even if open on all sides but is
covered by a roof, permanent or temporary in nature;
H.) Enclosed Public Place - refers to a room, building, structure or edifice that is constructed
with a shelter or covered by a roof with panels or concrete wall, which structure is open to the
public.
I.) Cigarette – refers to any roll or tubular construction, which contains tobacco or its derivatives
and is intended to be burned or heated under ordinary conditions of use.
SECTION 4. PROHIBITED ACTS. The following acts shall be prohibited.
A.) Any minor below 18 years old as mentioned in Section 2 hereof;
B.) Smoking in any of the places enumerated in Section 2 hereof, except in duly designated
smoking areas;
C.) Knowingly allowing, abetting, or tolerating smoking in accommodation establishments,
whether tourism accredited or not, except when smoking is done inside or within the duly
designated smoking areas referred to in this Ordinance;
D.) Smoking while inside a government-owned or public utility vehicle whether moving or
stationery or while solicitation of passengers is going on or while the vehicle is waiting for
passengers;
E.) Smoking within one hundred (100) meters radius from school, playgrounds and other
similar public places frequented by minors.
F.) Smoking within one hundred (100) meters radius from health institution premises such as
hospitals, clinics.
SECTION 5. PERSONS LIABLE. The following persons/ individuals are deemed liable under
this Ordinance:
A.) Any person smoking within the prohibited rooms, areas/ individuals are mentioned in
Section 2 hereof;
B.) Any passenger, driver, conductor, or inspector of government-owned vehicles or public
utility vehicles (PUVs) smoking as stated in Section 5 (c) hereof;
C.) The President or Manager in case of a company, corporation, or association or the owner/
proprietor or operator in case of single proprietorship, of accommodation and entertainment
establishments, whether tourism-accredited or not, who knowingly allows, abets or tolerates
and/ or fails to warn, advise or report violators of this Ordinance to any policeman or nearest
station within three (3) hours of the violation;
SECTION 6. The Rural Health Unit and the Municipal Engineer’s Office are tasked to inspect
and certify the appropriateness of the designated smoking areas provided by accommodation
establishments whether tourism-accredited or not, taking into consideration the purpose of the
law which is to protect non-smokers from the pernicious effects of tobacco smoke;
Sixty (60) days after affectively of this Ordinance, the Anti-Smoking Task Force, the Rural
Health Unit in coordination with the Municipal Tourism and the Office of the Municipal Treasurer
shall conduct an ocular inspection of all accredited establishments in Maigo, Lanao del Norte to
determine compliance with the requirements of this Ordinance.
Non-compliance with the requirements set forth in this section shall be a ground for
cancellation of the business permit by the Office of the Treasurer.
SECTION 7. The Maigo Anti-Smoking Task Force will be created to oversee the implementation
of the ordinance provisions and will issue citation ticket to violators which shall be subject to a
fine of not less than Php300.00 nor more than Php1,000.00 or imprisonment of not less than
one (1)month nor more than six (6) months or both, at the discretion of the Court, except for
Paragraphs 2 & 3 hereunder.
1.) In case of establishment which do not opt to declare their establishment as totally free
from smoking but fails to provide the appropriate designated smoking areas as certified by
the Rural Health Unit and Municipal Engineer’s Office within the 60-day period specified
in Section 6 hereof, their business permit may be revoked;
2.) In case where there is failure to warn or advised would-be violators of this Ordinance, or
failure to report violators as required in Section 5 (c ) hereof or smoking is allowed, abetted
or tolerated in establishment in violation of this Ordinance, a penalty shall be imposed upon
the President or Manager in case of corporations, partnerships or associations, or the owner,
proprietor or operator in case of single proprietorship, whether tourism-accredited or not as
follows:
First Offense Php300.00 or 1 month imprisonment or
both at the discretion of the court.
Second Offense Php500.00 2 months imprisonment or both at
the discretion of the court.
Third and subsequent offenses Php1,000.00 or 3 months imprisonment
or both at the discretion of court.
3.) For drivers/ passengers of Public Utility Vehicles (PUVs)
