DETAILS OF INVESTIGATION

On December 23, 2017, at approximately 1331 hours, Homeland Security Investigations (HSI)
Special Agent (SA) L(b)(6);(b)(7)(C) 7. eceived notification from Immigration and Customs Enforcement
(ICE) Enforcement and Removal Operations (ERO) Officer that the San Antonio
Police Department (SAPD) encountered twelve (12) suspected undocumented aliens (UDAs) in the
rear of a tractor trailer to include the driver and a passenger near the Splash Town water park
located in the vicinity of 1-35 and the AT&T Center exit in San Antonio, Texas. ERO Officer
(13)(6Mb0 also provided SA (WO)) with the name and telephone number for SAPD officer NIVR1- fhli
(b)(6);(b)(7X at the scene. SA (WO* was also contacted by Sector Communications concerning the
same information. Immediately after receiving the aforementioned details SA (h)/ called the
number given to him by ERO and was able to contact SAPD Officer (b)(6);(b)(7) on scene. SA (b)(6);(b)(
was given a brief telephonically by SAPD Officer kb)(6):(b)Md as to the latest details of the
incident. SA (b)(6);(b) also explained to SAPD Officer that he was the HSI duty agent
and that his approximate response time would be approximately 1.5 hours from his residence in
Bulverde, Texas. SAPD Officer fhV61- (h)(7A was also advised by SA (b)(6):N(that he would arrange
with ERO for transportation as soon as possible, in the event all 12 subjects were in fact
undocumented.

After talking with the SAPD Officer, SA (b)(6); (b)( :Immediately contacted the duty ERO Officer
requesting assistance with the transportation of the 12 suspected UDAs to include a driver and
a passenger. SA (101(61:lb)( was advised by the ERO Duty Officer that they would respond to the
scene to transport the 12 subjects to the HST office at Jackson-Keller in San Antonio. The Duty
ERO Officer also stated that they would only be able to provide transport and were unable to
assist any further once the suspected UDA's were turned over to him. SA (b)(WYKcontacted the
SAPD Officer on scene once again to advise him that ERO was enrouLe.

Upon making the arrangement for transport, SA (b)(6);(b)( departed his residence in Bulverde and
headed to the scene. While enroute, SA kbWftliOlc ontinuously updated the SAPD Officer of his and
ERO transport estimated time of arrival. The SAPD Officer on scene advised SA (13)(6)0X that ERO
had not yet arrived. The SAPD Officer on scene then advised SA (b)(6);(b)( that S PD woul.
transport the suspected UDAs to the SAPD Headquarter Office located at 315 Santa Rosa Avenue in
San Antonio Texas. SA (b)(6);(b) then stated that he would meet the SAPD Officer at SAPD HQ. SA
(b(6: (b arrived at SAPD Headquarters at approximately 1500 hours and learned that the suspected
UDAs had not yet arrived. SA then contacted the SAPD Officer to determine his location
and was advised that they were still at the scene. SA (b)(6);(b) then requested from the SAPD
Officer it he could transport the suspected UDAs to the HST Jackson Keller Office. The SAPD
Officer agreed to transport the suspected UDAs to the HSI Office.

Since the suspected UDAs were still on scene, SA (b'(6': (b' decided to respond to the scene from
SAPD HQ. Upon arrival to the scene at approximately 3:20 pm, SA (b(6: (b'( was approached by a
plain clothes SAPD officer who advised him that the b)(6);(b)(7)(C)
wanted to speak with him. (b)(6);(b)(7)(C) approached SA (b)(6);(b)( then asked him to speak in
private. SA (b)(6);(b)( then walked a short distance withl(b)(6);(b)(7)(C) I away from other officers,
and conveyed to SA l(h)(61•0111 that SAPD would take the case under the state smuggling statute. SA
(b)(6);(b)( then responded to (b)(6);(b)(7)(C) of his willingness to respond to SAPD Headquarters and
assist his Detectives with the investigation, to which (b)(6);(b)(7)(C) stated "No". SA (b)(6);(b) in
an effort to affirm (b)(6);(b)(7)(C) response asked "No?" l(b)(6);(b)(7)(C) then proceeded to explain
to SA (131(61:(b) that he didn't want SA (b)(6);(b)(7)( appearance to scare people. SA (b)(6);(b)( responded
that he could not scare anyone, pointing out his short stature. Ifh)(61:(h)(71(C) I stated that he
did not want SA (b)(6);(b)(7)( HSI badge to be seen at SAPD Headquarters by the suspected UDA's. SA
(b)(6);(b)( told (b)(6);(b)(7)(C) that he would wear a jacket to cover his Homeland Security badge, so
that no one would be scared. At that point no further exchange of information was made and
f(b)(6);(b)(7)(C) walked away.

At approximately 1528 hours SA (b)(6);(b)( returned to his government vehicle and contacted Sector
communications requesting to be put in contact with ASACI (b)(6);(b)(7)(C) I After briefing ASAC
(b)(6):(b)( a plain clothes SAPD officer approached SAI(b)(6):(b)(7)(Ivehicle. SA (b)(6);(b)( then stated to
the plain clothes officer that he was available if they needed anything further then provided

floor, where he encountered Chief McManus speaking with SAPD Sergeant (SGT) (b)(6);(b) SA (b)(6);(b)(7
approached and overheard SGT (b)(6); telling (b)(6);(b)(7)(C) that he only had one detective with the
ability to interview the suspected UDAs in Spanish. SA (131(61:(131 then advised(b)(6);(b)(7)(C) that
he was able to interview in Spanish and offered his assistance. l(b)(6);(b)(7)(C) did not comment
and ignored SA kb)(6);(b)(7)offer for assistance and departed the area soon after. SGT (b)(6);(b then
directed SA (b)(6);(b)I to a room equipped with several monitors where the interviews of the
suspected UDAs where being conducted simultaneously. SA (b)(6);(b)( sat with other SAPD detectives

was told if there is no further request to assist from SAPD to depart the area. After ASAC
call and prior to departing SAPD HQ, SA (b)(61:(bld headed to SGT (b)(6); (b office to let
him know he was departing.

Upon SA (b(6) (b)(7) arrival to SGT (b)(61:(b)(7)(C) Office, he was notified by SGT (131(611 that Kb)(6);(b)
(b)( himself ordered the release of all the suspected UDAs. SGT (b)(6):(then proceeded to show
SA (b)(6);(b) his phone where he displayed a text message fromODX6MX7XC) I ordering the release
of the suspected UDAs. SA Vh1(61- (hV then advised SGT (b)(6); to please contact ERO and have them
transport the suspected UDAs to an HSI Office to interview and to determine the immigration
status of all the suspected UDAs. SGT (b)(6);( stated that he had to follow (b)(6);(b)(7)(C)
orders. Upon learning the aforementioned, SA 1(b)(6):(b)( contacted ASAC kb)(6):(ID)(A and briefed him on
what he learned. ASAC (b)(6);(b)(7 then directed SA I(b)(6);(b) to depart SAPD Headquarters. SA
(b)(6); (b) departed from SAPD Headquarters at 3:50 pm. Approximately forty (40) minutes later,
after SA (b)(6):(b) had departed, SGT In,vAvd contacted SA Iffivgwbv to advise him that the suspected
UDA'swere in fact released from SAPD custody and did not elaborate on their whereabouts.
