DIRECTION UNDER SECTION 18(1)(b) OF THE WATER (PREVENTION AND CONTROL OF


POLLUTION) ACT, 1974 — IN THE MATTER RELATED of M/s BISALPUR KISAN SHAKARI CHINI
MILL BISALPUR, PILLBHIT (UP).

WHEREAS, under Section 17 of the Water (Prevention and Control of Pollution) Act, 1974 one
of the functions of the Utter Prdesh Pollution Control Board is to plan a comprehensive
programme for the prevention, control or abatement of pollution of stream and wells in the
State of Uttar Pradesh and to secure the execution thereof; and

WHEREAS, the Central Pollution Control Board (CPCB) team inspected of M/s Bisalpur Kisan
Shakari Chini Mill, Bisalpur, Pillbhit (UP), under NGRBA programme (herein after referred as
'the Unit') on April 06, 2014, and made the following observations:

The unit is engaged in production of Sugar with installed capacity of 2750 TCD (Ton cane
crushed Per Day). The unit was not in operation since 02.04.2014 due to closure of
current crushing season. It started the crushing season as on 01.12.2013.
The unit is meeting its fresh water requirement through three tube wells. No water
meter is installed in any of the tube wells.
The status of ETP could not be verified, as there is no access to the ETP area due to
dense bushes and no paved road. However, as reported, ETP comprises of Primary
Clarifier, Aeration Tank (diffuse type) and Secondary Clarifier. ETP was not in operation
and treated effluent from ETP is discharged into Deva River, which meets Garra River
and ultimately meets River Ganga.
During inspection, Spray pond overflow was found discharged into adjoin nalla and
analysis results indicated that it is contaminated with effluent. The analysis result shows
that Suspended Solids as 403 mg/I and BOD as 41 mg/I against the limit of 30mg/I.
The Unit has three boiler with capacity of 2x20 TPH and 30 TPH using bagasse as fuel.
Boiler with capacity 20 TPH has stack height of 30 m attached with multicyclone as
APCD. Similarly, boiler with capacity 30 TPH has stack height of 30 m with multicyclone
as APCD.
The ash generated is used for land filling and waste oil is mixed with bagasse and burnt
in the boiler. The Press mud and ETP sludge is used as manure.
7. The unit has not developed environmental lab for analysis of the operation parameters
of the ETP.

AND NOW THEREFORE, in view of the above observations and in exercise of the powers
conferred under section 18(1)(b) of the Water (Prevention & Control of Pollution) Act, 1974
directions are being issued to Uttar Pradesh Pollution Control Board for directing Ws Bisalpur
Kisan Shakari Chini Mill, Bisalpur, Pillbhit (UP) to implement the following directions in a time
bound manner and not to start crushing season till these are complied;

The Unit shall ensure the operation of ETP at least one month before
commencement of the next crushing season, stabilize and operate it as per
the design criteria and also operate the ETP even after completion of the
crushing season so that any effluent generated during washing and
maintenance is discharged after proper treatment so that the treated effluent
meets the prescribed standards prior to the disposal.
The unit shall not be permitted to start its operation in the next crushing
season till the unit upgrades/modifies/augments/dismantles all illegal bypass
lines and produces documentary evidence and assures the operation of the
ETP as per the prescribed effluent quality norms.
Unit shall upkeep the log book of ETP energy meter system, log book of ETP
system and establish an Environmental Laboratory to analyse minimum
parameters.
Uttar Pradesh Pollution Control Board shall ensure all the above directions
and if necessary, impose a Bank Guarantee to ensure compliance within
stipulated time or forfeit the Bank Guarantee.

The action taken report shall be submitted by UPPCB to CPCB within 30 days from the date of
receipt of these directions. UPPCB shall also acknowledge the receipt of these directions to
CPCB within 15 days from the date of receipt.

DIRECTIONS UNDER SECTION 18(1)(b) OF THE WATER (PREVENTION AND CONTROL OF


POLLUTION) ACT, 1974

WHEREAS, amongst others, under Section 17 of the Water (Prevention and Control of
Pollution) Act, 1974, one of the functions of the State Pollution Control Board (SPCB)/ Pollution
Control Committee (PCC), constituted under the Water (Prevention & Control of Pollution) Act,
1974 is to plan a comprehensive programme for prevention, control or abatement of pollution
of streams and wells located in the State/ UT and to secure the execution thereof; and

WHEREAS, the Central Government has notified the standards for discharge of environmental
pollutants from various categories of industries under the Environment (Protection) Act,1986
and the rule framed there under; and

WHEREAS, the SPCBs / PCCs can stipulate stringent standards for discharge of environmental
pollutants from various categories of industries than those notified by the Central Government,
under the Environment (Protection) Act, 1986 and rules framed there under; and

WHEREAS, pulp & paper industries and other highly polluting industrial units located in the
State of Uttar Pradesh discharge effluent in the rivers Ramganga, East Kali, West Kali and
Hindon and their tributaries in catchment of river Ganga basin, which adversely affect the water
quality of river Ganga and its tributaries; and

WHEREAS, CPCB, during November 2009, has carried out survey of Ramganga — Kali sub-
catchment area to assess the impact of industrial effluent discharges on river water quality.
Some of the observations made are as under:

River Kali, which is a tributary of river Ganga carries effluent discharges from agro based
industries like pulp & paper mills and contributes the maximum pollution load to the
river Ganga.
In the Moradabad- Muzzafarnagar area, clusters of agro and waste paper based units
discharge their effluent into rivers Ramganga/Kali.
Some of the Pulp & Paper units manufacturing chemical pulp do not have requisite black
liquor management facilities such as Chemical Recovery Plant (CRP) or Lignin Recovery
Plant (LRP) and discharges their wastewater, including black liquor generated from
chemical pulping, into river Ganga and its tributaries without complying with the
prescribed effluent discharge standards.
Performance of Lignin recovery plants installed in agro based Pulp & Paper Mills for
black liquor management is not satisfactory.
Industrial Units discharging effluent into river Ganga or its tributaries have been
directed not to discharge their effluents into the Ganga or its tributaries during Mela
period and to store their treated coloured effluent in the lined lagoons till the Mela is
over and to release the treated effluent in a staggered manner. However some units do
not provide requisite treatment to their stored effluent and release untreated/partially
treated effluent into river.
The effluent treatment plants installed by the individual industrial units are not
adequate to treat the entire effluent generated during the production and even the
operation and maintenance is poor. ETPs are not operated by trained staff.

AND WHEREAS, Ministry of Environment & Forests (MOEF), vide D.O. No. 1-19011/2/2010-
NRCD-II, dated 4/3/2010 instructed CPCB for issuance of directions under the Water Act, 1974
to SPCBs concerned in respect of the prescribed pollution control measures; and

WHEREAS, in pursuance to the MOEF D.O. letter dated 4/3/2010, CPCB issued directions under
section 18(1)(b) of the Water Act, 1974, to UPPCB, vide letter no. B-23012/1/PCI-III, dated
March 12, 2010 to issue directions to the concerned industrial units to take action for
compliance of the following points in a time bound action plan and submit bank guarantee for
an amount to the satisfaction of the UPPCB:

All the agro based industrial units located in the Moradabad and Muzaffarnagar (Bhopa
Road) area shall submit at the earliest possible a time bound action plan for setting up
of common effluent treatment facility, to provide requisite treatment of effluent
generated from industrial clusters. This will avoid water pollution.
All the Pulp & Paper Mills without adequate chemical recovery plant (CRP) for black
liquor management shall stop chemical pulping immediately.

Agro based Pulp & Paper Mills, with lignin recovery plants for black liquor management
shall use waste paper as raw material within 30 days or switch over to chemical
recovery for which time bound action plan shall be furnished.
The practice of storing of effluent shall be done away to avoid possible discharge of
untreated effluent.
Individual effluent treatment plants shall be comprehensively assessed and action
initiated for augmentation of capacity/ up-gradation of ETP as and where required.
Distilleries operating on zero-discharge should ensure compliance of the stipulated
norms.

AND WHEREAS, UPPCB issued directions under section 33 (A) of the Water (Prevention &
Control of Pollution) Act, 1974, vide their letters dated 19/04/2010, to concerned Pulp & Paper
industries without having adequate chemical recovery plants (CRPs) to stop chemical pulping
immediately, to shift to wastepaper based production within 30 days, to submit time bound
progarmme for installation of CRP and to stop storage of effluent immediately; and

WHEREAS, UPPCB submitted their action taken reports vide their letters dated 20/4/2010 and
dated 27/8/2010 and informed that the 24 concerned Pulp & Paper units have stopped use of
agro waste as raw material and out of these, 19 units have submitted their proposal for black
liquor management; and

WHEREAS, the Hon'ble High Court of Allahabad in its order dated 21.12.2010 in PIL No. 4003 of
2006 has directed to ensure that the trade effluent of different industries situated on the banks
of river Ganga is not discharged in river Ganga, and to constitute a Monitoring Committee
comprising of officers of CPCB, UPPCB and UEPPCB to constantly monitor the quality of the
water flowing from the tributaries of river Ganga namely, Kosi, Dhela and Ramganga entering
State of Uttar Pradesh from State of Uttarakhand, which merge with river Ganga; and

WHEREAS, CPCB issued further directions under section 18(1)(b) of the Water Act, 1974, to
UPPCB, vide letter no. B-23012/1/PCI-III, dated January 10, 2011 to take appropriate actions for
compliance of following points in a time bound manners:

UPPCB shall carry out daily monitoring of quality of the water flowing from the
tributaries of river Ganga entering State of Uttar Pradesh from State of Uttarakhand for
the identified monitoring locations and parameters as prescribed. UPPCB may increase
the monitoring locations and parameters, if required. UPPCB shall report the monitoring
results to the Member Secretary, CPCB and the Member Secretary, UEPPCB on daily
basis through e-mail/ fax.
UPPCB shall commence daily river water quality monitoring and reporting immediately
on receipt of these directions.

3. UPPCB shall issue appropriate directions following applicable procedure under section
33A of the Water (Prevention and Control of Pollution) Act, 1974 to take action for
compliance of the following pollution control measures:

The industrial units not complying with the prescribed effluent quality norms shall
not be permitted to operate.
The practice of storing of effluent shall be done away to avoid possible discharge of
untreated effluent.
Individual effluent treatment plants shall be comprehensively assessed and
augmentation of capacity/ up-gradation of ETP shall be carried out, as and where
required.
The industrial units shall be allowed to operate at the capacity for which the
effluent generated can be treated in the ETP to the prescribed norms, but not more
than the consented capacity.
All the agro based Pulp & Paper industrial units without adequate chemical
recovery plants (CRP) for black liquor management shall stop chemical pulping
immediately.
All the Pulp & Paper industrial units located in clusters, namely, Moradabad and
Muzaffarnagar (Bhopa Road/ Jansath Road), Meerut (Village Saini, Meerut-Mawana
Road), etc. shall be directed for setting up of common effluent treatment facility, to
provide requisite effluent treatment of industrial clusters. Agro based Pulp & Paper
industrial units located in these clusters should be promoted for setting up of
common chemical recovery plant for black liquor management.
g. Distilleries and Fermentation industries shall be directed to submit a time bound
action plan within 30 days to adopt emerging technologies namely Membrane
Filtration/ Reboiler/ Evaporation/ Concentration followed by incineration of
concentrated spent wash in boiler (for power generation) or co-processing in
cement kilns, thermal power plants and Steel plants to achieve zero liquid
discharge.

AND WHEREAS, UPPCB issued directions under section 33 (A) of the Water (Prevention &
Control of Pollution) Act, 1974, vide their letters dated 2/2/2011, to concerned Pulp & Paper
industries to not to manufacture without obtaining valid consents, to stop storage of effluent
immediately, to set up common CRP, and not to resume chemical pulping without installation
of CRPs; and

WHEREAS, UPPCB submitted their action taken report vide their letter dated 09/02/2011 and
informed the following:

a. The digesters used for the chemical pulping in the agro based pulp & paper industry
have already been sealed by UPPCB.

Surprise inspections were carried out by the team comprising of the officers of the
local administration and UPPCB to ensure compliance of directions.
Industries situated at the Bhopa Road, Muzaffarnagar have submitted DPR for
establishing common CRP.

AND WHEREAS, UPPCB vide their letter dated 09/02/2011 informed the following:

29 digesters in 12 agro based Pulp & Paper Units situated in district Muzaffaranagar
were sealed on 31/01/2011 by Regional Office, UPPCB, Muzaffarnagar.
All digesters in 12 agro based Pulp & Paper units situated in district-Muzaffarnagar
were again re-sealed in an effective manner during 2/6/2011 to 10/06/2011 by the
Regional Office, Muzafarnagar.

AND WHEREAS, a techno-economic feasibility study for setting up of Common Effluent


Treatment Plant (CETP) and Common Chemical Recovery Plant (CCRP) in identified clusters of
pulp & paper industries located in the Ganga catchment area of Uttarakhand and Uttar
Pradesh (hereinafter referred to as 'the feasibility study') was conducted during 2010-11. A
'Charter for water recycling and pollution prevention in pulp & paper industry in Ganga River
basin' (hereinafter referred to as 'the Charter') was formulated as a part of the feasibility study,
which prescribes amongst other action points, setting up of individual or common chemical
recovery plants based on either conventional chemical recovery process or fluidized bed
process in agro based chemical pulping/ kraft paper making mills; and

WHEREAS a detailed Implementation Programme of the Charter was formulated in


consultation with Pulp & Paper industry representatives, experts from Central Pulp & Paper
Research Institute (CPPRI), Saharanpur, IIT-Roorkee, IIT-Delhi, IIT-Kanpur and officials from
Uttarakhand Environment Protection & Pollution Control Board (UEPPCB) and Uttar Pradesh
Pollution Control Board (UPPCB), Ministry of Environment & Forests (MOEF) and National
Mission Clean Ganga (NMCG); and

WHEREAS, CPCB issued direction vide letter no. F.No.B-23012/1/PCI-III, dated 12.07.2012,
under section 18(1)(b) of the Water (Prevention and Control of Pollution) Act, 1974, to UPPCB
to issue appropriate directions following applicable procedure under section 33A of the Water
(Prevention and Control of Pollution) Act, 1974 to Pulp & Paper mills operating in identified
clusters of Moradabad, Meerut and Muzafarnagar to take appropriate action for
implementation of the Charter as per the detailed implementation programme, including the
following pollution control measures:

Pulp & Paper industrial Units having chemical pulping facilities, namely, digester,
blown tank, pulp washers (brown stock washer/ pressure washer), etc., but not
having chemical recovery process (CRP) shall be directed to submit supporting
documents such as work orders, pay orders, photographs, etc. towards their
commitment for installation of CRP/ common CRP based on either conventional or
fluidised bed processes, to the satisfaction of UPPCB/ CPCB within 45 days, failing
which such pulp & paper industrial units shall be directed to dismantle and remove
chemical pulping facilities from the Unit's premises before November 30, 2012; and

Pulp & Paper industrial Units operating in the identified clusters of Muzaffarnagar
(Bhopa Road/ Jansath Road), Meerut (village-Saini, Mawana Road) and Moradabad
shall be directed to submit affidavit and Bank Guarantee of suitable amount
towards their commitment for implementation of the Charter and to comply with
the prescribed environmental compliance as per the DIP within the prescribed time
period, to the satisfaction of UPPCB & CPCB, with provision for forfeiture in case of
non compliance.

AND WHEREAS, UPPCB issued directions under section 33 (A) of the Water (Prevention &
Control of Pollution) Act, 1974, vide letters issued during August 3-13, 2012 to 50 Pulp & Paper
industries operating in the identified clusters of Muzaffarnagar, Meerut and Moradabad to plan
and secure the execution of the activities as described in the detailed implementation
programme for implementation of the Charter in a time bound manner, to the satisfaction of
UPPCB and CPCB; and to submit supporting documents such as work orders, pay orders,
photographs, etc. towards their commitment for installation of CRP/ common CRP based on
either conventional or fluidised bed processes, to the satisfaction of UPPCB/ CPCB within 45
days, failing which such pulp & paper industrial units to dismantle and remove chemical pulping
facilities from the Unit's premises before November 30, 2012; and

WHEREAS, it has been observed that in compliance of UPPCB directions as mentioned above,
only five individual CRPs/ common CRPs have been installed/ under installation since 2010,
namely M/s Rayana Papers Boards industries Ltd., Khalilabad, Sant Kabir Nagar, M/s Rama
Shyama Papers Ltd., Bareilly, M/s Garg Duplex Paper Mills Ltd., Bhopa Road, Muzaffarnagar,
M/s Bindlas Duplex Ltd., Unit-1, Bhopa Road, Muzaffaranagar, and M/s Silverton Papers Ltd.,
Bhopa Road, Muzaffarnagar. However, chemical pulping facilities, namely, digester, blown tank,
pulp washers (brown stock washer/ pressure washer), etc., are still lying intact/ operational and
not dismantled/ removed from the premises of many Pulp & Paper mills which do not have
requisite CRP facilities in Uttar Pradesh, and these mills have all possibility to restart chemical
pulping operation using agro based raw material and discharge untreated black liquor into local
drains and rivers, which has potential to contaminate the river water/ ground water; and

WHEREAS, the available data of river water quality monitoring done by CPCB for rivers Kali Nadi
(West), Kali Nadi (East) and Hindon near Pulp & Paper industry clusters at Muzaffarnagar,
Meerut and Ghaziabad shows river water pollution at these stretches for several years. The
possibility of discharge of industrial effluent in these river stretches cannot be rules out.

WHEREAS, Workshop was held on 25 th September, 2014 with the experts/ representatives from
Pulp & Paper industries and their associations, NMCG, Ministry of Environment, Forests &
Climate Change, Department of Industrial Policy & Promotion, IIT-Roorkee, SPCBs and CPPRI to
discuss and finalise the 'Charter for Water Recycling and Pollution Prevention in Pulp & Paper
industries', including 'Protocol for Operating Chemical Recovery Plants (CRPs)'; and

It has been observed that the Pulp & Paper Mills have been given more than four years for
installation and commissioning of CRPs (individual or common) and the mills are
unreasonably delaying the installation and commissioning of CRPs. The possibility of use of
digesters for chemical pulping using agro based raw material by Pulp & Paper Mills not
having CRP cannot be ruled out, thereby posing potential threat to river water pollution.

Now therefore, in view of the above referred observations and in exercise of the powers
conferred under section 18(1)(b) of the Water (Prevention and Control of Pollution) Act, 1974,
you are hereby directed to take appropriate actions for compliance of the following in a time
bound manner:

1. UPPCB shall issue appropriate directions following applicable procedure under section
33A of the Water (Prevention and Control of Pollution) Act, 1974 to take action for
compliance of the following pollution control measures:

Pulp & Paper Mills shall be directed to ensure that no black liquor is discharged
from the Unit's premises.
Pulp & Paper Mills having chemical pulping facilities, namely, digester, blown
tank, pulp washers, etc., shall be directed to install and commission Chemical
Recovery Plants (CRPs) (individual or common) and seek appropriate consent/
authorization from UPPCB by December 31, 2014, failing which such Pulp &
Paper mills shall be directed to dismantle and remove chemical pulping facilities
from the Mill's premises by December 31, 2014.
Pulp & Paper Mills having common CRP shall be directed to inform names of the
Pulp & Paper Mills which are members of the common CRP facility to UPPCB and
CPCB by December 31, 2014.
The transportation of black liquor from the member Pulp & Paper Mill(s) to the
common CRP shall be made only through pipelines, which should be visible and
accessible for inspection. Any other mode of transportation, like tankers, etc.,
shall not be permitted.

Pulp & Paper Mills having chemical pulping facilities shall be directed to properly
operate CRPs (individual/ common), maintain records and start reporting to
UPPCB as per the enclosed "Protocol for operation of CRP" (hereinafter referred
to as "the protocol") by January 31, 2015. The 'Protocol for operation of CRP
(individual/ common)' is placed at Annexure-I.
Pulp & Paper Mills having chemical pulping facilities and CRPs shall be directed
to ensure installation and commissioning of requisite measurement/ metering,
recording and monitoring systems as prescribed in the protocol, and all the flow
measurements shall be connected to PLC based logic or DCS by January 31, 2015.
g. Pulp & Paper Mills not having CRP facilities/ membership of common CRPs shall
not be permitted to keep digesters for pulping of raw material or pulp.

UPPCB shall take appropriate actions as per the provisions of the Water/ Air Acts and
the Environment (Protection) Act, 1986, against the Pulp & Paper Mills not having
operational CRPs (individual/ common) or membership of a common CRP, and have not
dismantled & removed chemical pulping facilities from their premises, and forward the
compliance status report/ action taken report to CPCB by January 31, 2015.
UPPCB shall verify on monthly basis the records/ data submitted by the Pulp & Paper
Mills having CRPs/ membership of common CRPs as per the protocol and provide a copy
of the verified records/ data to the Mills for their record. Such verification shall be made
on the basis of inspection of the Mills/ CRPs (individual/ common), PLS/ DCS records,
meter readings, log books, daily/ monthly production records, excise records and any
other relevant documents.
UPPCB shall take appropriate action against the Mills in case the information provided is
found to be incorrect.
UPPCB shall also submit compliance status/ progress report on quarterly basis to CPCB.

The action taken report shall be submitted by UPPCB to CPCB within 30 days from the date of
receipt of these directions along with a time bound action plan for compliance of the directions.
UPPCB shall also acknowledge the receipt of these directions to CPCB by return fax.

1.0 Measurement of Black Liquor

2.0 Production data of soda ash

4.0 Caustic Consumption

Caustic (lye or soda) consumption figures should be noted on daily basis.

Agro-based kraft paper mill should keep the record of caustic consumption
in cooking (digester).

Agro-based w
riting-printing paper mill should keep record of caustic

onsumption in cooking and alkali extraction separately.
Normally, the p
roduction of Soda Ash is between 1 to 1.2 times the
c onsumption of caustic in cooking.

5.0 M easurement and Reporting Points

All the input raw materials utility (like steam, power, chemicals etc) effluent
flow and pulp p
roduction data in Pulp Mill shall be recorded on daily /
monthly / yearly basis

measured and recorded

6.0 Submission of reports to State Pollution Control Boards (SPCBs)/ Pollution


Control Committees (PCCs)

Monthly reports shall be submitted based on the measuring points by the mills as
follows:

Daily, monthly and yearly raw material consumption, pulp production,


steam consumption in Cooking, Fresh Water / Condensate consumption in
Washing, Caustic consumption, Weak Black Liquor Flow to evaporation
Plant, SBL & HBL flow, effluent flow and power consumption per ton of
pulp, Soda Ash production.

Daily, monthly and yearly running hours of Pulp Mill separately.

Daily, monthly and yearly running hours of Evaporator section and FBR
section separately.

Logging of running hours of evaporators and FBR separately.

v. Monthly purchase of Caustic (Lye/Soda) by the mill.

7.0 Information to SPCBs/ PCCs

Monthly schedule of running of CRP in the coming month shall be submitted by


every mill in the last week of current month to SPCB/ PCC. The schedule shall
contain the following:

Expected total running hours of evaporators and FBR separately.


Expected production of WBL, SBL and HBL
Expected production of Soda Ash
Whenever there will be a shut down or break down of the FBR, the
same shall be reported to SPCB. The reporting to SPCB should be
through email followed by letter.

The SPCBs will also inspect mills, which are running CRPs and will verify that the
concerned mill has operated its CRPs as per its monthly declaration for that
month.

8.0 On Line Monitoring of CRP

The confirmation of running FBR for an outsider is only through the


chimney of the CRP. If thick white vapors are coming from the chimney,
FBR is in operation.

A camera (facing chimney) should be installed to online monitor the


running of the FBR. This camera should be connected to SPCBs/ PCCs server

iii. All the Flow measurement & Power meter shall be connected to PLC based
logic or DCS with required password

9.0 Miscellaneous points

For Common CRP (CCRP), the black liquor has to be transported only
through pipe lines. Any other mode of transportation, like tankers, shall not
be permitted.

All the Pulp Mill effluents shall be separate and cameras should be installed
at the discharge points

iii. There should be no permission to run digesters for pulping of imported
waste paper/ agro or wood based raw material or pulp by any Paper Mill
without having CRP facility or membership of a common CRP.

10. The SPCBs/ PCCs shall verify on monthly basis the records/ data
submitted by the Pulp & Paper Mills having CRPs and by members of
common CRPs, and provide a copy of the verified records/ data to the
Mills for their record. Such verification shall be made on the basis of
inspection of the mills, PLS/ DCS records, meter readings, log books, daily/
monthly production records, excise records and any other relevant
documents. SPCBs/ PCCS shall take action against the Pulp & Paper Mills
or the CRPs in case the information provided is found to be incorrect.
