8. Dr. Dennis Khong will handle Tutorial Groups 1 to 7 and Ms. Julia Farhana binti Rosemadi
will handle Tutorial Groups 8 to 10.

9. Do prepare your draft answers before the tutorial classses.

10. Have your tutorial questions and lecture notes printed on hand for the tutorials.

11. The sequence of the topics for this subject will be rearranged in this trimester to cater
to the personal timetable of the lecturers. Kindly check the MMLS for details on when
certain topics are covered.

3 Attendance and MC Submission

13. Attendance in all lecture and tutorial classes are compulsory.

14. Please attend your assigned tutorial group. Only if you have a valid reason such as sick
and have an MC, that you are allowed to replace your tutorial attendance in a later class.
Inability to wake up early is not a reason for attendance in a later class.

15. In order to properly account for your non-attendance, and to make sure that you are not
barred based on your non-attendance in lectures and tutorials, all students have to submit
their MCs or official supporting documents (hereinafter “MC” or “MCs”, whichever is
applicable) to the lecturer concerned.

16. MCs must be submitted within 7 calendar days from the last stated day on the MC.

17. MCs must be pasted on an A4 size paper, or photocopied on an A4 size paper.

18. Photocopies are acceptable provided that the original is presented to the lecturer for
verification.

19. At the top right hand corner, or in a blank space, provide the following information in
blue ink:

• Subject code and subject name


• Your name

• Your student ID number
• Date that you were absent
• State whether it is for a lecture or a tutorial
• Your lecture group or tutorial group.

20. A separate MC has to be submitted for different subjects.

21. Only official documents may be accepted. Personal letters (if any) must be supported by
documentary evidence.

22. It is the duty of the students to ensure that their attendance is taken, and if they are
absent, a proper MC is submitted in time. The lecturer has no obligation to chase after
a student’s MC.

4 Blended Learning
23. This subject will have a blended learning component. Suitable YouTube videos will be
provided in MMLS whereby students are required to view before joining a discussion in
the Facebook group.

5 Assessments

25. How to do well in this subject?

(i) Read and be familiar with the subject syllabus. Know the 4 Learning Outcomes, as
they will form the content of your assessments.
(ii) Attend all lectures and tutorials. You will only know what to emphasise for the test
and exam if you attend all classes. You will also know how to answer the questions
in the required style and format if you attend all classes.
(iii) Read the mentioned cases in full.
(iv) Take lecture notes during lectures. Writing lecture notes helps to you to remember
what you learned.
(v) Make study notes and have them in the tutorials.
(vi) Prepare your answer before attending the tutorials. Please don’t come to tutorials
empty-handed.

26. Learning Outcomes:

LO1: Explain the justifications and basic characteristics of intellectual property rights in
Malaysia. (Topic 1)
LO2: Discuss a copyright and industrial design issue. (Topics 2 and 4)
LO3: Solve issues relating to patent and breach of confidence. (Topics 3 and 7)
LO4: Solve issues relating to trade mark and passing off. (Topics 5 and 6)

27. The assessment components are:

• Midterm test (LO1): 20%

• Group assignment (LO2): 20%
• Tutorial participation (All LOs): 10%
• Final exam (All LOs): 50%

28. Original and unmarked copies of statutes may be brought into the exam.

29. Students are reminded to highlight or underline case names when writing the answers in
the final exam.

(i) Tay Pek San, Intellectual Property Law in Malaysia (Sweet & Maxwell Asia, 2013).
(ii) Lionel Bently and Brad Sherman, Intellectual Property Law (4th edn, OUP, 2014).

31. Since this is an intellectual property law subject, you are not allowed to bring a
photocopied copy of the textbook into the lectures and tutorials.

(iii) Industrial Designs Act 1996
(iv) Trade Marks Act 1976

7 Discplinary Warning

33. All students are reminded of the following disciplinary warning against cheating in all
assessments:

Before a law graduate is admitted as an advocate and solicitor, the Bar


Council will request for a Confidential Report from the university on whether
there is any ground of objection against the admission of the graduate as well
as whether the graduate is of good character.
The clarification from the Bar Council on what is ‘not good character’ is that
it “includes, but is not limited to, any act of a criminal nature which involves
fraud or dishonesty . . . including cheating during an examination or being found
to have committed an act of plagiarism.”
Kindly be warned that you do not attempt to cheat in the exam or in
any assessment or be found to have committed any disciplinary offence. The
university has a legal obligation to convey this information to the Bar Council
before the admission of the candidate, and this may affect the candidate’s
admission as an advocate and solicitor.
