AFFIDAVIT OF WITNESS

I, ALEXIS TALARI, of legal age, married and a resident of Divisoria,

Zamboanga City, after having been duly sworn to in accordance with law hereby
depose and state:

1. That I am one of the waiters of Toby’s Carenderia located at Divisoria,

Zamboanga City.

2. That on December 1, 2016, I was on duty. Around 10:00 in the morning of that
day, I was serving Mr. Povadora the chicken mami he ordered.

3. That he was the only customer inside the carinderia. After I gave Mr.
Povadora his order, I was standing near the entrance door of carenderia when
I saw a man standing half a meter away from me.

4. That to my best knowledge, it was Mr. Estilo. I came to know the person of
Mr. Estilo because he is my neighbor.

5. That I overheard Mr. Estilo talking in his cellphone saying “Si Doro, dili na
sya magdemand nga pahawaan ko. Naa siya sa sulod sa restaurant, ako jud
na siyang tudluan ron unsa ang kapait sa kinabuhi.”

6. That I did not finish hearing the conversation because I was called by my co-
waiters to the kitchen.

7. That approximately after two (2) or three (3) minutes after I went to the
kitchen, I heard a glass broken. I immediately rush to the dining area of the
carenderia to check.

8. That while still at the kitchen door three (3) meters away from the table of Mr.
Povadora, I saw Michael on the floor and afterwards stood up. I also heard
him saying, “Ano ngayon, nakita mo talaga ang hinahanap mo.”

9. That I rushed to Mr. Povadora and I saw his face, reddening and with some
chicken mami. I also saw blood at the back of his head. I gave Mr. Povadora a
tissue to clean his face and asked him if he would to be brought to the
hospital.

10. That I called a tricycle and assisted Mr. Povadora until he reached
Zamboanga Peninsula Medical Center.

11. I am executing this affidavit to attest the truthfulness of the foregoing facts
and for whatever legal purpose this may serve.
