PARTICULAR CONDITIONS OF CONTRACT

1. Definition

1. (Ref. 1.2) The Adjudicator of this contract is secretary to the Minister of Irrigation and
Water Management.

2. (Ref. 1.32) The start Date is the date that the contract is awarded. (……………- 2010)

3. (Ref. 1.7) The completion date is 365 days from the date of acceptance.

4. (Ref. 1.18) “Employer” is Director General of Irrigation, Irrigation Department,


Bauddhaloka Mavatha, Colombo 07.

5. (Ref. 1.19) “Engineer” means the Deputy Project Director of Uma Oya Downstream
Development

6. (Ref. 1.9) “Contractor” means the Factory Engineer, Govt. Factory, Kolonnawa

The “Contractor’s representative” means the competent person that Contractor shall
employ to constantly oversee the Design works, Temporary works and Construction
works as the person in-charge and any instructions given to him by the Employer shall
be deemed have been issued to Contractor.

“Works” means Design work, Preparation of Construction documents, Temporary


works and Permanent works required for the execution and completion of the works
and remedying of any defects therein.

7. (Ref.1.16) Defect liability period - Defect liability period is 365 day from the date of
completion.

8. (Ref. 43) Payment - An advance payment of 20%of the contract sum


excluding provisional sums as stated in the letter of
award shall be paid to the Contractor on signing of
contract agreement.
Up to 80% of the assessed value of material at site
shall be paid on invoice. As the gates are fabricated
at Government Factory workshop at Kolonnawa,
materials are verified at the workshop for the
purpose of payment of material at site.
Interim payments are made with the progress of the
work.
a. After fabrication of Sluice Gates and Trash
rack'
b. After Transportation of Gates, Hoisting
Equipments, Machines, Tools etc. to the Alikota
Ara reservoir sluice site.
c. After successful installation and testing of
the gates and hoisting system.

9. (Ref. 47) Price Adjustment - Price adjustment will be paid according to the
invoice for material submitted by the Contractor.

10. (Ref. 48) Retention - The proportion of payment retained is 10% of the
certified work done. The limit to the retention shall
be 5% of the initial contract price.

11. (Ref. 49) Liquidated Damages - The liquidated damages of the whole of the works
shall be 0.05% of the initial contract price per day.
The maximum amount of the liquidated damages for
the whole of the work is 5% of the initial contract
sum.

12. (Ref. 51) Advance Payment - Advance payment of 20% of the contract sum
excluding provisional sum, as stated in the letter of
award shall be paid without Guarantee.

The advance payment shall be repaid by deducting


proportionate amounts from payments otherwise
due to the contractor following the schedule of
complete percentage of the works on the payment
basis.

The advance payment shall be repaid in full when


the total certificate value of the work reaches 90%
of the initial contract sum.

13. (Ref. 52) Security - Since the Government Factory is a Govt. Institute,
no security bond shall be needed.
