COUNTER -A F F I D A V I T

I, SPO3 of legal age, married, Filipino Citizen, residing at Bengao, Bakakeng Central,
Baguio City and a bonafide member of the Philippine National Police assigned at the Traffic
Enforcement Unit of Baguio City Police Office, after having been sworn to in accordance with
law hereby depose and state the following:

1.That on January 29, 2018 at about 8:00 PM, I reported for duty at Station 4 whereby
we are supposed to have PICE and Accounting of Personnel but the deputy station commander
informed us it will be conducted on the following day instead at exactly 8:00 AM;

2. That on January 30, 2018 at about 6:20 AM, I observed that all duty personnel are
present at the station so I called on PO2 and PO1 for us to proceed at Nevada Square for the
rush hour deployment which will start at 6:30 AM whereby we conducted traffic direction and
control; (Attached is the affidavit of John Bugnay Kimo)

3. That while conducting traffic direction, SPO3 send me text message if I could pay my
long time balance to him anyway there is already increase so I was confused because it was not
only him asking payment for my debts and I don’t know how to explain and unknown to them,
my ATM was loaned at PSSLAI at that time for emergency purposes;

4. That at about 7:45 AM of same date, we observed that the traffic situation was
already light so we decided to withdraw and proceed to station 4 so that we can attend the
PICE and Accounting of Personnel to be conducted by the station commander as instructed to
us by the deputy station commander and at exactly 7:50 AM still bothered and due to limited
time and urgency for the said PICE, we left Nevada Square and proceeded to our station but
forgot to seek permission from TOC;

5.That while at first gate of Camp John Hay, PO2 informed me that the City director
PSSUPT is calling through radio asking about traffic situation at Nevada Square so I instructed
PO1 Airon Bayan to maneuver our mobile and go back to Nevada Square;

6. That while I was signaling the vehicles to give way for us, PO2 Magno already
answered the query of the City Director so I asked him as to his reply wherein he replied
”inbound is light and outbound is moderate” but then we are already near Nevada intersection
whereby we saw the service car of the City director parked thereat so there is no ample time
to correct the said reply because he is already calling us towards him;
 7. That we approached the City Director and then I explained we left the area because it
was already light to traffic and that we need to attend the PICE and Accounting of Personnel
and then he reiterated to us his instructions regarding rush hour deployment and further
instructed us to further direct traffic then he left;

8. That after traffic directions and observing it to be light to traffic, we proceeded to

station 4, to catch up for the said PICE and Accounting Of Personnel but then it was nearly
finished; Attached is the copy blotter dated January 30, 2018 of station 4;

9. That I am executing this affidavit to attest to the foregoing facts and further prays
that if I have committed any violation/s, it is not intentional or intended to defy legal orders. I
further interpose that being 19 years in the service, I am a recipient of numerous medals and
commendations; (Attached herewith are photocopies of my medals and commendations)

10. IN WITHESS WHEREOF, I hereby affixed my signature this 27th day of March 2018 at
