RESEARCH METHODOLOGY:
The method used for research purposes is entirely doctrinal. The data has been
gathered by referring through various books of the given subject. Analysis of that
particular data has been done by breaking the data into different sections and then
drawing out conclusions from those different sections. Primary source is the
Constitution of India and secondary sources include books by reputed authors and
also web resources.
INTRODUCTION:
In India, marriage is treated as a sacrosanct institution, and earlier divorce was not
even available as a legal recourse. Divorce is the legal dissolution of a marriage. In
India, religious communities have their own marriage laws and hence the divorce
procedure also depends on the religion of the couple. Hindus, along with Buddhists,
Sikhs and Jains are governed by the Hindu Marriage Act, 1955. Because of the
importance accorded to marriage in India, the divorce procedure here is a long drawn
affair, and can be a source of great agony to both the parties. However, the process
can be considerably shortened if the couple seeks divorce on the grounds of mutual
consent.
