PAY REVISION RULES, 1978

1. Increments in the Basic Pay Scales: The increments in the Basic Pay Scales
shall fall due on Ist day of December, following the completion of at least six
months service at a stage in the relevant Basic Pay Scales.Rule-7.

Decision:
With effect from the calendar year 1998 onwards, the civil servants retiring on or
after the first day of June of a year shall be entitled to the usual annual increment,
for the purpose of calculation of his pension only, on completion of six months
service in the year of his retirement, irrespective of due date of 1st December
following the completion of six months. The above benefit would equally be
admissible in the cases of civil servants who die while in service.

2) Fixation of Pay on Transfer from a lower scale to a Higher Scale. (i.e. on


Moveover/Upgradation of Post).

When a civil servant is allowed to draw pay in the next higher Basic Pay
Scale by Moveover or his post having been upgraded, his pay in the higher scale
shall be fixed at a stage next above his pay in the lower scale. (Rule-9)

3). Fixation of pay on promotion: (1) Subject to the provisions of rule-II. (See
S.No.4 below)

i) Where a civil servant is promoted from a lower to a higher post in BPS-2


to 19 where the stage in the Basic Pay Scale of the higher post, next above
the pay of the civil servant concerned in the pay scale of the lower post,
gives a pay increase equal to or less than a full increment of the pay scale
of the higher post, the initial pay in the Basic Pay Scale of the higher post
shall be fixed after allowing a premature increment in the Basic Pay Scale
of the higher post; Rule 10(1) (i)

*Decision:
Fixation of pay on appointment to a higher post from the lower post by
initial recruitment.
The provision contained in rule 10(1)(i) as referred above shall also
equally apply in the cases where appointment to a higher post from a lower post is
made by initial recruitment.

allowed on account of refixation of pay prior to 16.3.1999.

Note:- Selection grade is treated as at par with promotion for the purpose of fixation of
pay.

ii) Where a civil servant is promoted from a lower post to a higher post in
BPS 20 and above after completion of the minimum length of service
prescribed for the relevant grade, his pay in the scale of the higher post
shall be fixed at the stage next above his pay in the scale of the lower post;
and
iii) Where a lower and a higher pay scale have been prescribed for the
same post, the pay on promotion from the lower to the higher scale upto
Basic Pay Scale 19 shall be fixed in the manner given in clause (1) above.

Note: With effect from 1.6.1991 one premature increment will be granted to the officer
B-20 and above on promotion.

2) "If a civil servant:


i) at the time of his promotion to a higher post is already drawing pay by
way of move-over in the pay scale of the higher post or in a pay scale
above the pay scale of the promotion post; or

ii) before his promotion to a higher post from a post for which a lower and a
higher pay scale has been prescribed, is already drawing pay in the pay
scale of the higher post; or

iii) is promoted to a post in the same scale in his own line with the only
difference that the higher post carries a special pay; or

iv) is promoted to a higher post where higher and lower post carry the same
scale,

He shall be allowed one advance increment in that pay scale


w.e.from the date of his promotion."
These orders shall take immediate effect.

Fixation of Pay on Promotion to Higher post Carrying Pay Scale to which the
Civil servants have already reached by way of Move-over.

i- It has been decided in consultation with the Finance Division that a Civil
servant who is promoted to a higher post carrying pay scale to which he
has already reached by way of move-over, will be entitled to the benefit of
a premature increment i.e. next stage plus one premature increment over
the stage which he had reached by way of move-over but not beyond the
maximum of pay scale of the higher post to which he has been promoted.

ii) These orders would be effective from 1.12.1985 but no arrears would be
allowed on account of his re-fixation of pay prior to 01.01.1990. The cases
decided prior to 1.12.1985 shall not be re-opened.

iii) It has been further decided to allow fixation pay to Civil Servants on their
regular promotion from BPS-20 (by move-over) to BPS-20 under
F.R.22(a)(i), but not beyond the maximum of the scale of the higher post
to which he has been promoted.

iv) The orders in para-iii above would be effective from 1.12.1985 but no
arrears will be allowed on account of re-fixation of prior to 01.05.1991.

OPTION FOR RE-FIXATION OF PAY IF PROMOTED BETWEEN 2ND JUNE


AND 30TH NOV.

3) If a civil servant before reaching the maximum of a Basic Pay Scale is promoted
to higher scale between the 2nd June and the 30th November, of a calendar year
and his initial pay in the later scale in fixed with reference to his pay in the former
scale, he may, at his option, get his pay re-fixed in the higher scale with effect
from the Ist day of December of the year of his promotion with reference to his
presumptive pay on that date in his pre-promotion scale; provided that if the
promotion of a civil servant is subject to the length of prescribed service, he shall
be entitled to opt for re-fixation of his pay only if he has completed the prescribed
length of service.

The above provision equally applies in the cases of selection grade, which is
treated at par with promotion for the purpose of pay fixation.

Decision: The Government servants promoted between 2nd June and 30th November to a
higher post carrying the same pay scale in which they are already drawing pay
shall also be entitled to the re-fixation of pay in the above manner. This
decision will be effective from Ist; June, 1991 without arrears.

3) Admissibility of increments on promotion to a post in Basic Pay Scale 18 and
above. If a civil servant is appointed by promotion to a post in Basic Pay Scale
18 or above before he completes the length of service prescribed for the higher
post, he shall be entitled to draw the pay;

i) at the minimum of the Basic Pay Scale of the higher post till such time as
he completes the prescribed length of service and the next increment shall
accrue to him on the first day of December, following the completion of
the prescribed length of service or following the completion of at least six
months service in the scale, whichever is later,

ii) admissible to him from time to time in the lower post held by him
immediately before his promotion to the higher post, if that be more
beneficial to him till such time as he completes the prescribed length of
service when his pay shall be fixed in the manner prescribed in rule 10 and
the next increment shall accrue to him on Ist day of December, following
the completion of at least 6 months service in the relevant Basic Pay Scale.
Rule 11

Prescribed length of service for the purpose of pay and increments.


(See S.No.3 and 4)

a) The minimum length of service (in BPS-17 and above) prescribed for the
purpose of drawal of pay and increments on promotion to posts carrying BPS-18
and above shall be as under:

In calculating the service rendered in BPS-17 and above, half of the


service rendered in BPS-16 and 1/4th of service rendered in scale below-16, if
any, shall be added for the purpose of computing total length of service. These
orders shall take immediate effect.

b) Service rendered in the Federal Government or any other Provincial


Government shall also be taken into account for the purposes of, and in the
manner specified in Clause(a).

5. ENTERTAINMENT OF ADDITIONAL CHARGE AND GRANT OF
EXTRA RENUMERATION FOR HOLDING ADDITIONAL CHARGE
OF POSTS UNDER F.R.49

With a view to streamlining the cases of additional charge and payment of


extra remuneration the following consolidated instructions are issued: -

i) Distribution Of Work Of A Vacant Post.


The work of a vacant post, as far as possible, be distributed among more
than one Govt.: Servant of the same status and designation available in the
Department/Office.

ii) Additional Charge Arrangement.


Where the distribution of the work among more than one Government
Servant is not feasible, the charge of the vacant post may be entrusted in
the entirety, to another Government Servant in an equivalent scale/status.
This arrangement should not be made for a period less than one month and
should not exceed three months and it should be allowed with specific
approval of the Secretaries/Heads of the Attached Departments/Heads of
Department not below BPS-20. However, it may be extended by another
three months with the approval of next higher authority. Immediately on
the expiry of six months of the full additional charge of the particular
vacant post, the post shall be treated as having been abolished and its
duties automatically becoming part of the normal duties of the other
existing posts of the same category in the department concerned. The post
so treated as abolished shall not be revived without the concurrence of the
Finance Department.

iii) Prior Approval Of The Finance Department.


a. Before making full additional charge arrangement prior approval
of the Finance Department may be obtained.

b. Where it is not possible to obtain prior approval of Finance


Department for cogent reasons, the proposal should be initiated
immediately after making such arrangement and in any case not
later than ten days from the date of making such arrangement. In
such cases detailed reasons for which prior approval of Finance
Department could not be obtained may invariably be given.
However, Finance Deptt; reserves the right to accept or reject the
reasons advanced by the department concerned after examination
of the case on merits.

iv) Additional Remuneration.
Additional Charge/Duel Charge Allowance shall be sanctioned by the
Finance Department at a uniform rate of 20% of basic pay subject to
above conditions. In special cases of heavy and sensitive nature of
additional charge, more special dispensation can be considered by the
Finance Department/Provincial Government on case to case basis.

6. APPOINTMENT ON ACTING CHARGE BASIS.


A Civil Servant on appointment to hold a post on acting charge basis,
shall:
a). Assume full duties and responsibilities of the post and exercise all
statutory, Administrative and financial powers vested in the regular
incumbent of the post; and
b). during the period of such appointment, be entitled to draw fixed pay equal
to the minimum stage of the pay at which his pay would have been fixed
had he been appointed to that post on regular basis. Service rendered on
acting charge basis in the scale applicable to the post shall not count for
purposes of drawl of increments in that grade. It shall, however, count to
wards increment in the scale of pay held immediately before appointment
on acting charge basis so that on reversion from acting charge
appointment his pay in the lower grade should be fixed at the same stage
which he would have reached, but for appointment to the higher post.

7) Fixation of Pay on Re-Employment:


When a retired civil servants is re-employed under Govt. or under the
Government owned/controlled autonomous/semiautonomous bodies and
corporations, after superannuation or after completion of 30 years pensionable
service, the initial pay of such a Civil Servant shall be fixed at the minimum of
the scale of pay of the post in which he is re-employed. Increments will be earned
under normal rules and full pension will be admissible in addition to pay.
In the case of retired Civil servants other than those above, the mode of
fixation will be as under:-
a) Where the new post carries a fixed pay, he should be allowed the pay of that post
less pension.

b) Where the new post carries a time scale of pay;


i) If the substantive pay last drawn by the officer before retirement was less
than the minimum of the scale of the new post, he should be allowed the
minimum of the scale less pension.

ii) If the substantive pay last drawn was more than the minimum of the scale
but less than the maximum of the scale of new post, his pay should be
fixed at the stage in the scale corresponding to the pay last drawn or if
there be no such stage, at the next lower stage in the scale. From the pay
so fixed the amount of pension should be deducted.
iii) Where the substantive pay drawn immediately before retirement was more
than maximum of the scale of the post in which the officer is employed,
his pay may be fixed at the minimum of the scale of the post in which he
is re-employed and he may be allowed to draw his pension in addition to
the pay fixed subject to the condition that the initial pay fixed plus the
amount of pension does not exceed the substantive pay drawn by him
immediately before retirement. Once the pay is so fixed he will be entitled
to draw increments in the scale of the post provided that the amount of pay
(including increments) plus pension does not, at any stage, exceed the
substantive pay drawn before retirement.

iv) A re-employed Civil servant should earn increments in all cases where pay
has been fixed in a scale at a stage lower than the maximum.
v) In case a re-employed pensioner is promoted to a higher post, his pay
should be fixed in such a manner as if he was a serving officer with the
difference that from the pay so determined the pension would be deducted.
vi) In a case where officiating pay higher than the substantive pay was drawn
for a continuous period of 3 years or more immediately before retirement,
the officiating pay drawn before retirement may be treated as substantive
pay for the purpose of these orders.
vii) The pay of the retired military personnel re-employed in civil posts may
also be fixed in accordance with the above principles. In their case
substantive pay shall also include the following employments; provided
that they were drawn before retirement/release/leave/leave pending re-
retirement for a continuous period of three years or more:
a) Command/Staff/Charge Pay.
b) Instructional Pay.
c) Qualifications Pay.
d) Disturbance Pay.
e) The word "Pension" wherever used in these orders means pension
before commutation and/or surrender.

Note-I: With effect from 1.1.1984, pay of the retired Defence Services Personnel
below commissioned Rank will be fixed with reference to pay of the substantive
rank or temporary rank if held for one year before retirement plus full military
pension.

8) PROTECTION OF PERSONAL PAY FOR HIGHER QUALIFICATION


It has been decided that the personal pay on account of higher qualification shall
not be absorbed/adjusted but shall be treated as part of the time scale of pay for
the purpose of fixation of pay of the Civil Servant concerned on the
promotion/selection grade/move-over. No arrears prior to 1-1-1999 shall,
however, be admissible.

9. UPGRADATION OF POST BETWEEN 2ND JUNE & 30TH NOVEMBER


Where a post is upgraded between the 2nd June and 30th November of a calendar
year, the increment of such a post shall be allowed refixation of pay with
reference to his Notional Pay in the lower scale on Ist December of that year
subject to the exercise of an option by the incumbent of the post, provided that
other conditions of earning the increment are fulfilled.

These orders will take effect from 5.6.1986.

10. ADMISSIBILITY OF ANNUAL INCREMENT DUE TO INTRODUCTION


OF BPS-1983
Promotion between 2.6.1983 and 30.6.1983.
The conditions of 6 months service to earn increment has already been relaxed in
BPS-83, the employees promoted to higher posts between 2.6.1983 to 30.6.1983
are entitled to receive their normal increment on 1.12.1983.

Promotion between 1.7.1983 and 30.11.1983.


Increment on 1.12.1983 is not admissible to employees promoted between
1.7.1983 and 30.11.1983, since they have not completed 6 months service in term
of rule-7 of NWFP Civil Service Pay revision rules, 1978.

Appointment between 2.6.1983 and 30.11.1983.


Employees appointed upto 30.6.1983 and who were in receipt of pay in Revised
National Pay Scale would receive their Ist increment in BPS on 1.12.1983, but the
employees appointed between Ist July and 30th November, 1983, would be
entitled to receive their Ist increment in BPS on 1.12.1984 instead of 1.12.1983.

Employees who have opted For refixation of Pay on or after 1.7.1983.
They will not be entitled to receive increment in BPS on 1.12.1983. Their cases
will be regulated under rule-7 read with rule 10(3) of the NWFP civil services pay
revision rules, 1978.

11. AWARD OF SELECTION GRADE IN DIFFERENT CADRES.


It has been decided in consultation with the Federal Government as well as
the Services & General Administration Department to lay down the following
conditions for grant of Selection Grade/Senior Scale:-

a. Selection Grade may be granted on the basis of Seniority-cum-fitness.

b. The official to whom Selection Grade is proposed to be granted must have


successfully completed his probationary period and must possess the
following length of service in his existing Pay Scale:-

i. For grant of As prescribed for


Selection Grade promotion to those
in BPS-18 and above. Pay Scales.

ii. For grant of Three years service


Selection Grade in the existing pay
in BPS-17 and below. Scales of the post.

The above provisions shall operate after the posts are placed in selecting
grade/senior scale.

Subject:- REVISION OF BASIC PAY SCALE AND FRINGE BENEFITS OF


CIVIL EMPLOYEES (BPS.1-22) OF THE FEDERAL
GOVERNMENT (2001).

The President has been pleased to sanction, with effect from 1st December
2001, a scheme, as detailed below, of the Basic Pay Scales, Allowances and Pensions,
2001 for the civil employees of the Federal Government in BpS-1 to 22 paid from the
Civil Estimates and from the Defence Estimates respectively as shown in the following
paragraphs.

PART-1. BASIC PAY SCALE AND ALLIED MATTERS.

2. Basic Pay Scales. The existing basis pay scales and the revised basic pay
scales are shown in Annexure-I to this O.M. The revised basic pay scales shall replace
the existing Basic Pay Scales, 1994, and shall be effective from 1st December, 2001.

3. Discontinuation of Allowance. The following allowance shall cease to


be payable on introduction of the revised pay scales w.e.f., 01-12-2001.

i. Cost of Living Allowance to BS-1 to BS-22 @ 7% of basic pay.


ii. Adhoc relief of Rs.300/- p.m. and Rs.100/- p.m. to BS-1 to 16 (inclusive
of BPS-17 by virtue of Move-Over).
iii. Secretariat/Personal Allowance.

4. Special Additional Allowance. Special Additional Allowance sanctioned


vide Finance Division O.M. No.F.1(7)Imp/99, dated 23rd July, 1999 shall be frozen at the
level drawn as on date of issue of this O.M.

5. Initial Fixation of Pay. (1) Pay of the employees in service on 30-11-
2001 shall be fixed at the stage in the revised pay scales which is as many stages above
the minimum as the stage occupied by him above the minimum of the 1994 Basic Pay
Scale.

5. Pay Fixation on Promotion (2) The existing provisions regulating the


fixation of pay in case of promotion from lower to a higher post shall continue to apply.

6. Selection Grade and Move-Over. Selection Grade in the scheme of


Basic Pay Scales and Move-Over scheme shall stand discontinued w.e.f. the date of issue
of this O.M.

7. Pay Fixation of employees in Selection Grade and those who have


Moved Over to higher scale. Pay of an existing employee drawing pay by move-over
shall be fixed with reference to the pay scale of the post for the time being held by him.
In case the employee was drawing pay in a Selection Grade, his pay will be fixed in the
Selection Grade Pay Scale. The stage of fixation will be arrived at after allowing
increments on notional basic in the original scale of the post or the Selection Grade, in
1994 Basic Pay Scales, up to the point of existing pay. Pay of the employees will then be
fixed at the relevant stage in the revised pay scales 2001.

Example-I

Assistant, BS-11 Selection Grade, BS-15 Moved Over BS-16 and in


receipt of pay of Rs.5490/-. Pay will be fixed in BS-15 i.e. Selection Grade pay scale at
Rs.8320/- as under:

Example-II

Pay fixation of an employee in BS-11 who has moved over to BS-14 and
is in receipt of basic pay of Rs.4480/- will be fixed after allowing notional increments in
BS-11 of 1994 Basic Pay Scales to the stage of basic pay drawn. Pay in revised BPS-11
will be fixed at the corresponding stage of Rs.6790/- as under:

Example-III

Pay fixation of an employee in BS-5 who has moved over to BS-11 and is
in receipt of basic pay of Rs.3465/- will be fixed after allowing notional increments in
BS-5 of 1994 BPS up to the stage of basic pay drawn. Since basis pay of Rs.3465/- is
beyond the 30 stages in notional BS-5, (1994 BPS), & Resultantly more than the 30
stages of BPS 2001, therefore, his pay will be fixed at the notional 32nd stage i.e. at
Rs.5300/-. The difference of Rs.200/- (Rs.5300-5100) will be personal to him as under:

In such cases future increments upto a maximum of 3 years will also be allowed as
personal to such employees.

8. Date of Increment. Annual increment shall continue to be admissible


subject to the existing conditions, on the 1st December each year.

9. Special Pays/Allowances for Offices. The Special Pays/Allowances
sanctioned to offices as percentage of Pay shall be discontinued on the introduction of
revised pay scales w.e.f. 01-12-2001 and adjusted in future increments.

10. Advance Increments. The existing scheme of advance increments is


discontinued w.e.f. 01-12-2001. A fresh scheme, if any, will be introduced in due course.

PART-III PENSION AND COMMUTATION.

16. Pension. The Government has made the following reforms in pension/
commutation scheme w.e.f. 01-12-1991 in respect of civil pensioners of Federal
Government including civilian paid from Defence Estimates as well as retired Armed
Forces Personnel.

a) Commutation Table shall be replaced by the new Commutation Table at


Annexure-II to this Office Memorandum.

b) Commutation upto 40% of gross pension shall be admissible at the option


of the pensioner.

c) The additional benefit of 10% for extra years of service after completion
of 30 years of qualifying service in respect of Civil Pensioners shall be
discontinued.

d) The increase in pension @ 20% & 25% to Civil Pensioners allowed vide
this Division’s O.M. No.F(1)Reg.6/99, dated 23-7-1999 shall be
discontinued.

e) The benefit of restoration of surrendered portion of pension in lieu of


commutation/gratuity shall be withdrawn.

f) In future, the increase in pension to the pensioners shall be allowed on net
pension instead of gross pension.

g) All the pensioners shall be allowed an increase in net pension (inclusive of


dearness increases allowed in the past) as follows:

Increase in net pension


i) Pensioners who retired prior to the introduction of 15%
1991 Basic Pay Scales.

ii) Pensioners who retired prior to the introduction of 10%


1994 Basic Pay Scales but on or after the introduction
of 1991 Pay Scales.

iii) Pensioners who retired on or after the introduction of 5%


1994 Basic Pay Scales and upto the date of introduc-
tion of revised Basic Pay Scales i.e., 01-12-2001.

17. Option. (a) All the existing civil employees (BPS-1 to 22) of the
Federal Government shall within 45 days from the date of issue of this office
memorandum, exercise an option in writing addressed to the Audit Office concerned in
the case of employees in BPS-16 and above and to the DDO concerned in the case of
employees in BPS-15 and below, either to draw pay in the existing pay Scales of 1994 or
in the Revised Basic Pay Scales and Pension/Commutation Scheme, 2001 as specified in
this O.M. option once exercised shall be final.

(b) An existing employee as aforesaid, who does not exercise and


communicate such an option within the specified time limit, shall be deemed to have
opted to continue to draw salary in basic pay scales of 1994 and Pension/Commutation as
per existing formulate.

18. The government servant who will retire w.e.f. 01-07-2001 shall be given
the benefit of revised pay scales on presumptive basis discounted by 5% increase in

pension if availed, subject to the condition that all those who may like to avail this benefit
should opt for the entire package i.e. revised schemes of Basic Pay Scales as contained in
Part-I and revised package of pension as contained in part-III of this O.M.

19. All existing rules/orders on the subject shall be deemed to have been
modified to the extent indicated above. All existing rules/orders not so modified shall
continue in force under this scheme.

20. Anomalies. An Anomalies Committee shall be setup in the Finance


Division (Regulations Wing) to resolve the anomalies if any, arising in the
implementation of this Office Memorandum.
