 TERMS AND CONDITIONS
Upon acceptance of this Application by AMWAY of Australia (hereinafter called “Company”)
the undersigned applicant for an Independent Business agrees that:
1. The Company reserves the right to accept or reject applications at its sole discretion without
having to assign any reason for its acceptance or rejection. I understand that if my Application
is accepted I will be appointed as an Independent Business Owner for the limited purpose
of the retail sale of the Company’s products and the Company’s distributed products and
soliciting applications for appointment as IBOs or Clients. As an IBO, I will be an independent
contractor and not a partner or employee of my sponsor, my Platinum or of the Company.
I understand that my appointment as an IBO will be effective immediately my application
is processed by the company.
2. I will fully and promptly observe and comply with the Rules of Conduct for IBOs (which
incorporate the AMWAY Sales and Marketing Plan) and will indemnify the Company from
and against all actions, damages, claims, demands, prosecutions, fines, penalties and the
costs thereof in respect of or arising out of my breach of any of the Rules of Conduct. I
understand that my Independent Business may be terminated if any of the information given
or representations made in this application are false or if I fail to comply with the terms of
my contract with the company of which the Rules of Conduct and these conditions form a part.
I acknowledge that the Rules of Conduct may be amended from time to time and notice
of these amendments will be published in AMWAY’s literature and/or AMWAY Online Website
www.amway.com.au.
3. I understand that Business Support Materials (BSM) such as books, magazines, audio and
video tapes, or tickets to motivational or business-building seminars and rallies may be
available for purchase. I understand that the purchase of such products and services is
always optional. The decision whether to purchase BSM is entirely up to me. In making this
decision, I will use my own good judgement as to what is best for my independent business.
Some IBOs earn income from the sales of BSM apart from their earnings as IBOs. I
acknowledge that should I have a dispute with regard to any aspect of my contract as an
IBO or with regard to my decision to purchase BSM I will resolve that dispute via dispute
resolution procedures in terms of Section 13 of the Rules of Conduct for IBOs.
4. I expressly acknowledge the provisions of Rule 3.19 of the Rules of Conduct for IBOs
(the Business Protection Rule), with regard to the operation of alternative multi-level
marketing businesses and the requirement of Rule 4.12 that I hand a current AMWAY Leave
Behind Brochure to any person to whom I have shown the AMWAY Sales and Marketing Plan.
5. If I have previously been an AMWAY Distributor/IBO or Member; this application will not
offend the six months inactivity rule; and I have not breached any of the other Rules of
Conduct for IBOs.
6. I will receive a Registration Kit, which includes a copy of the Rules of Conduct for IBOs and
the AMWAY Sales and Marketing Plan with an introductory product pack offer of my choice
(if one selected). I understand that the payment covers the cost of the wholesale (IBO) price
of the introductory pack I have selected, the business literature pack (Registration Kit),
access to company publications and the AMWAY On-line www.amway.com.au
7. I understand if my IBO application is not accepted my Registration Kit (including my
application and introductory product pack I have selected at time of application)
may be returned to AMWAY of Australia for a full refund.
8. I understand that if accepted, this application will cover my Independent Business until 31
December (except that applications processed from 1 December to 31 December are valid
until 31 December of the following fiscal year-the Company fiscal year running between 1
January and 31 December inclusive). Renewal fees are advised on AMWAY Online amway.com.au
9. I understand if I wish to retain my right to service Clients, sponsor IBOs and access company
publications from year to year, I must renew my Independent Business annually by 31 December
and that the Company may reject my application for renewal of this Independent Business.
10. I acknowledge that the "Welcome to Amway" presentation must be completed at time of
registration or within 30 days of registration as per Rule 2.2.1
11. I understand that:
Payment/Non Payment:
• All payments under deferred payment arrangements (including direct debit and instalment
plans) must be paid on or before the due date – any default on a payment will represent
a breach of the Rules of Conduct and of the deferred payment agreement. In case of default
all deferred payments will become immediately due and payable.
• Misrepresentation/Nondisclosure: Any misrepresentation or nondisclosure in an application
for terms payment arrangements will render the application void and the full amount payable.
• Title to Goods: Title to goods remains with AMWAY until all payments have been made.
• Cancellation/Returns/Refunds: Any cancellation or return of product other than for exchange
or quality purposes will be subject to deduction of 5% freight and 5% handling charges,
recovery of bonuses or other commission payments, and rework of PV/BV through the line
of sponsorship.
• Credit Reference Enquiry: Should you apply for commercial credit under any instalment plan
you agree that AMWAY may obtain a credit report about you from a credit reporting agency.
• Debt Recovery Cost: In any case of default AMWAY reserves the right to recover any reasonable
costs incurred in recovering the debt from you.
• Credit Card Expiry: If you have undertaken to pay terms instalments by credit card AMWAY
will endeavor to contact you prior to expiry of the card, however, it is your responsibility to
ensure that your credit card remains current and available during the period of instalment
deductions.
• Notification of Default: Given that any non payment or return of product will have an effect
within the line of sponsorship AMWAY reserves the right to notify your up-line that a default
has occurred and that PV/BV will be deducted from the line of sponsorship.
• Future Purchases: An indebted IBO who is in default may not be permitted to place orders
unless the full amount outstanding is paid; any payments to AMWAY by an indebted IBO
may be applied at AMWAY’s discretion against any debt outstanding in the name of the
debtor.
• Bonus Payments: AMWAY reserves the right to apply any bonus payments or returned
merchandise credits directly against any outstanding indebtedness.
• Future Recovery Action: Should indebtedness not be cleared AMWAY may refer the matter
to a Collection Agency for recovery action. The indebted IBO may be liable for any costs
associated with recovery.
• Consequences of Default: At its discretion AMWAY reserves the right to withhold qualification

for incentive payments, events and seminars and IBO qualification may be revoked.
Right to Vary
AMWAY has the right to vary these General Terms of Trade from time to time as it sees fit. Your
continuing to trade with AMWAY after your renewal date will signify your agreement to be bound
by the revised General Terms of Trade. The most recent version of the General Terms of Trade can
be viewed in amway.com.au or can be obtained by contacting AMWAY on 1800 454 647.
Australia/New Zealand
Australia and New Zealand form one AMWAY market which allows you to sponsor directly into
New Zealand. This means your Australian business activity will be governed by the Laws of Australia
and the AMWAY IBO Rules of Conduct and AMWAY General Terms of Trade for AMWAY of Australia
(ABN 49 004 807 756) and your New Zealand business activity will be governed by the laws
of New Zealand and AMWAY IBO Rules of Conduct and AMWAY General Terms of Trade for AMWAY
of New Zealand and AMWAY Services New Zealand Limited.
Where these General Terms of Trade conflict with the Rules of Conduct for AMWAY IBOs then the
Rules of Conduct shall take precedence.
If these General Terms of Trade conflict with a specific written agreement between AMWAY and
the IBO then the specific written agreement shall take precedence.
Recipient Created Tax Invoice Terms and Conditions Where:
• Supplier is the IBO
• Supplies is the provision of services for which bonuses are paid
• Recipient is AMWAY of Australia
• RCTI is recipient created tax invoice
• Tax Invoice includes an adjustment note
The supplier warrants that the supplies are taxable supplies for GST purposes and will advise
AMWAY should any supplies be GST-free, input taxed or outside the scope of GST.
The Recipient and the Supplier agree that:
a) The Recipient can issue Recipient Created Tax Invoices in respect of the Supplies;
b) The Supplier will not issue tax invoices in respect of the Supplies;
c) The Supplier acknowledges that it is registered when it enters into the agreement and that
it will notify the Recipient if it ceases to be registered;
d) The Recipient acknowledges that it is registered when it enters into the agreement and that
it will notify the Supplier if it ceases to be registered or if it ceases to satisfy any of the
requirements of any Australian Taxation Office (ATO) ruling required for the issuance of a RCTI;
e) The Supplier indemnifies the Recipient for any liability to tax, overclaimed credits and
penalties as a result of an error by the recipient on any supply for which it issues a RCTI
that might arise due to the failure of the supplier to notify cessation of registration, or other
ATO requirements;
f) The above terms are modified in accordance with current GST law and ATO Rulings as
required for the issuance of a RCTI from time to time; and
g) The supplier will inform the recipient if he considers that relief from GST should be afforded
under the transitional provisions of the GST law. The recipient will then examine the legal
position to determine availability of relief.
PAYG Withholding
I/We acknowledge that until I am/we are advised by Amway that I/we have achieved the ‘in
business’ criteria for the Administrative Position for IBOs, I/we will not be conducting an enterprise
for taxation purposes and consequently will not be required to quote an Australian Business
Number (ABN) to Amway.
OR
I/We do not subscribe to the Administrative Position in that I/we am/are carrying on a business
under general law and will immediately provide the Australian Business Number for my/our
enterprise to avoid the requirement for Amway to deduct PAYG withholding from bonuses payable
in my/our enterprise.
Privacy Policy
We recognise that your privacy is very important to you. We never sell or rent your personal
information. You may reasonably obtain access to the personal information we hold. AMWAY will
send you product and business information to keep you informed and help you succeed in your
business. In addition, from time to time AMWAY and its associated companies may make specific
marketing offers which may also be available to your upline or downline. If you do not wish to
receive such offers you can opt out by ticking the box on the front of this form.
Credit Reference Enquiry
Should you apply for commercial credit under any instalment plan, you agree that Amway may
obtain a credit report about you from a credit report agency.
IBO’s Declaration and Acceptance
I apply for appointment as an IBO contracted to Amway of Australia. I declare that: 1. I am over
the age of eighteen (18) years. 2. I am not bankrupt or a party to any arrangement or composition
with my creditors, nor do I own any property or assets the subject of receivership or official
management. 3. I am not suspended or debarred from practising my usual trade or profession
by any trade or professional association, institute or society. 4. I am not confined to any corrective
institution. 5. If not an Australian citizen, I am the holder of an entry permit under the Migration
Act 1958 which is in force and has not been granted subject to any condition imposing restrictions
on the applicant performing work (or work of a kind which would include work done by IBOs as
independent contractors in Australia) or I quote below my Australian Tax File Number (TFN) or
Australian Business Number (ABN) and Australian bank account number details and will complete
a Non-Resident Management Agreement for my business as a matter of urgency.
