6th Intra-Bail Argument Competition

Advocates’ Legion is organizing the 6th Intra-Bail Argument Competition, on 31st August
2018. There shall be individual participation, therefore students are requested to send their
name, class and semester, and contact number on moot@vips.edu by 25th August 2018.

The participants shall be given their respective sides for argument at the time of registration.
Kindly adhere to the following rules-
1. The memorial shall be strictly into the form of application, consisting of 2-3 pages. The
memorial may be supported by a separate compendium of judgments (the first page of
judgment and the relevant extract).
2. The participants have to submit two copies of the memorials from one side only.
3. All the participants have to mail their memorial on moot@vips.edu by 27th August till
6:00pm.
4. The hard copies shall be submitted on 29th August at 2:00pm in the Moot Court Room.
5. The participants (Applicant and respondent) shall be given 9 minutes for oral arguments
and 1 minute for rebuttal.
6. The training session shall take place on 14th August and 21st August in the Moot Court
Room at 10.30 am and 1:00 pm.

On the fateful night of 3/10/2017 the police van while patrolling found two dead bodies lying
in pool of blood on the bank of river Yamuna in Delhi. On investigation, the two victims
were identified as Anju aged 19 years and Mohit aged 25 years both residents of
NirmanVihar Delhi. On Post Mortem, the reports indicated the cause of death to be profuse
bleeding due to head injury with a sharp edged weapon. The investigation preceded CCTV
footage and the statement of security guard (PW 1) was recorded. As per the version of
security guard both the victims were accompanied with two persons, one Mr Khalid and
another Mr Akram Ali. Their entry was made in register maintained at the security gate of
NirmanVihar, where both the victims resided. It was further corroborated by the footage of
the CCTV camera.

On the basis of the statement of Anita (PW2), friend of Anju it was revealed that Anju and
Mohit were to leave for Dubai on 4/10/2017 as one person named Khalid was helping them to
seek job in Dubai. On this pretext of job opportunity, Khalid and Akram invited them to their
residence in MayurVihar on 3/10/2017 in the wee hours. On 4/10/17 they had to leave for
Dubai. On reaching the residence the victims overheard the conversation of Khalid, Akram
Ali and Amaan Ali (DW 2) that Anju and Mohit would be taken to one Mr Sheikh Ira
Mohammad in Abu Dhabi where they both would be employed in the business of begging
and Anju can also be further trafficked for prostitution. After hearing the conversation they
both tried to sneak away but they were prevented by Khalid, Akram and Amaan. They were
further prevented from raising an alarm and were threatened to death on gunpoint.

In the midnight Anju and Mohit were taken to the airport to board the flight for Dubai.
Somehow Anju managed to hide her mobile with her through which she messaged Anita
about the incident. Amaan Ali found Anju doing something on her mobile. He snatched it
from her and threw it outside the window. Thereafter he started molesting the girl at which
Mohit protested and raised the alarm for help. On this protest they were killed by the
aggressors and dead bodies were thrown near river Yamuna, which was witnessed by the
Navin (pickpocketer) (PW3). He intended to steal from those three people but hid himself
when he saw the dead bodies of Anju and Mohit being carried away by them.

The Session court has rejected the bail application on the basis on the evidence adduced by
the prosecution while the defence has strongly relied on the contention that the CCTV
footage cannot be considered credible as the faces of the assailants are not clear and voice
inaudible.
Now the matter is pending before the High Court of Delhi and accused persons have filed an
application for seeking bail.
