Annual Survey of Philippine Business and Industry (ASPBI) - by PSA

Presents the final results of the survey on the structure, trends, and levels of economic activity in the
country. Contains statistical tables on national and regional levels that include data on number of
establishments, employment, compensation, revenue, costs, fixed assets, capital expenditures, inventories,
and value added by industry classification for easy reference by data users. Also presents comparative table
showing summary results of current and previous years. ASPBI data assist planners in the government and
private sector in the formulation of policies and economic development plans

REPUBLIC ACT NO. 10625

Section 5. Philippine Statistics Authority. – There shall be created a Philippine Statistics Authority,
hereinafter referred to as the PSA, attached to the National Economic and Development Authority (NEDA)
for purposes of policy coordination. It shall be comprised of the PSA Board and offices on sectoral statistics,
censuses and technical coordination, civil registration and central support and field statistical services.

1. Creation of PSA under RA 10625 (2013)

Under Executive Order No. 121 (February 1, 1987)

a. National Statistical Coordination Board (NSCB). There is hereby created National


Statistical Coordination Board, hereinafter referred to as NSCB, which shall be the highest policy-
making and coordinating body on statistical matters. One of its key functions is to allocate statistical
responsibilities among government agencies by designating the statistics to be collected by them,
including their periodicity and content. The NSCB shall not engage directly in any basic data collection
activity. All government agencies shall adopt statistical standards prescribed by the NSCB, including
standard concepts and definitions, techniques, procedures and classification systems.

b. The National Statistics Office. The National Census and Statistics Office is hereby renamed
the National Statistics Office (NSO). It shall be the major statistical agency responsible for generating
general purpose statistics and undertaking such censuses and surveys as may be designated by the
NSCB.

2. Relation of PSA with NEDA

Policy Coordination

As defined under Book IV, Chapter 7, Sec. 38 of the Administrative Code of 1987, policy
coordination is defined as follows:

“The coordination shall be accomplished by having the department (NEDA)


represented in the governing board of the attached agency or corporation, either as
chairman or as a member, with or without voting rights, if this is permitted by the charter;
having the attached corporation or agency comply with a system of periodic reporting
which shall reflect the progress of programs and projects; and having the department
(NEDA) or its equivalent provide general policies through its representative in the board,
which shall serve as the framework for the internal policies of the attached corporation or
agency.”
Under RA 10625 (2013)

Sec. 7 Composition of the PSA Board. – The PSA Board shall be composed of the
following: the NEDA Director-General, as Chairperson. xxx

Section 11. The National Statistician. – The National Statistician, as head of the PSA,
shall be appointed by the President of the Republic of the Philippines from among a list of
nominees submitted by a Special Committee. The Special Committee shall be composed of
representatives from the Philippine Statistical Association, the University of the Philippines’
School of Statistics (UPSS), the University of the Philippines-Los Baños Institute of Statistics
(UPLB-INSTAT), the Department of Economic Statistics of the BSP and the NEDA.

Section 32. Implementing Rules and Regulations. – The PSA Board together with the
PSA, the PSRTI, the NEDA and other concerned agencies of government that may be
determined by the PSA Board, shall formulate the implementing rules and regulations of this
Act.

NEDA

The National Economic and Development Authority is the country’s premier socioeconomic
planning body, highly regarded as the authority in macroeconomic forecasting and policy
analysis and research. It provides high-level advice to policymakers in Congress and the
Executive Branch. Its key responsibilities include:

1. Coordination of such activities as the formulation of policies, plans and programs


to efficiently set the broad parameters for national and sub-national (area-wide,
regional and local development);

2. Review, evaluation, and monitoring of infrastructure projects identified under the


Comprehensive and Integrated Infrastructure Program (CIIP) consistent with the
government’s thrust of increasing investment spending for the growing demand on
quality infrastructure facilities; and

3. Undertaking of short-term policy reviews to provide critical analyses of


development issues and policy alternatives to decision-makers.

3. Composition of PSA

Under RA 10625:

1. PSA Board –

Section 7. Composition of the PSA Board. The PSA Board shall be composed of the following:
the NEDA Director-General, as Chairperson; the Secretary of the Department of Budget and
Management (DBM) or the duly designated Undersecretary, as Vice Chairperson; National
Statistician; one (1) representative each from the other departments in the national
government; a representative of the BSP; the Executive Director of the PSRTI; a
representative of the Philippine Statistical Association; a representative from the GOCCs; a
representative each from the Union of Local Authorities of the Philippines (ULAP) and the
private sector to be appointed by the Chairperson of the PSA Board for a term of three (3)
years, with reappointment, from a list of nominees submitted by the other members of the
Board.

2. Section 12. The PSA offices:

2.a. Sectoral Statistics Office - agriculture, natural resources, agrarian reform,


mining and quarrying, manufacturing, electricity, gas and water, energy, construction,
foreign and domestic trade, services, science and technology, finance, investment,
population, women and gender, health, nutrition, education, labor and employment, social
welfare, governance, public order and justice

2.b Censuses and Technical Coordination Office - Prepare, conduct, process and
disseminate census results in accordance with the approved statistical calendar; Maintain
and develop statistical standards and classification systems; Provide technical assistance to
other concerned government offices to meet their statistical requirements for policy-making,
planning and programming

2.c Civil Registration and Central Support Office - provide technical and support
services to the various units of the PSA in the areas of administrative services, financial
management services and human resources. It shall likewise provide technical and support
services for the efficient functioning of civil registration system

2.d Field Statistical Services comprising of the regional offices and provincial
statistical offices. - A Regional Statistical Services Office (RSSO) and Provincial Statistical
Office (PSO) shall be established in each of the administrative regions and provinces,
respectively. The RSSO and PSO shall:

(a) Provide technical staff support to the PSA;

(b) Provide technical assistance as may be required by the implementing agencies


and local governments in the regions and provinces;

The PSA Board shall be the highest policy-making body on statistical matters. The data produced by the PSA
shall be the official and controlling statistics of the government. The PSA shall be primarily responsible for
all national censuses and surveys, sectoral statistics, consolidation of selected administrative recording
systems and compilation of the national accounts.

Before, under EO 121, it was NSCB and NSO.

The PSA shall be constituted from among the existing personnel of the major statistical agencies engaged in
primary data collection and compilation of secondary data, i.e., the National Statistics Office, herein referred
to as the NSO; the Technical Staff of the National Statistical Coordination Board herein referred to as the
NSCB; the Bureau of Agricultural Statistics, herein referred to as the BAS; and the Bureau of Labor and
Employment Statistics, herein referred to as the BLES.
1. Constitution of PSA

Sec. 28. Abolition of Existing Government Bodies. – The NSO, the BAS of the Department of
Agriculture, the BLES of the Department of Labor and Employment, and the NSCB shall be abolished and their
appropriations, records, properties and personnel shall be transferred to the PSA.

The Department of Economic Statistics of the Bangko Sentral ng Pilipinas (BSP) will continue to take charge
of banking and financial statistics, including the Balance of Payments (BOP) and flow of funds.

Section 6. Functions of the PSA. – The PSA shall have the following functions:

a. Serve as the central statistical authority of the Philippine government on primary data collection;

b. Prepare and conduct periodic censuses on population, housing, agriculture, fisheries, business, industry
and other sectors of the economy;

c. Collect, compile, analyze, abstract and publish statistical information relating to the country’s economic,
social, demographic, political affairs and general activities and condition of the people;

d. Prepare and conduct statistical sample surveys on all aspects of socioeconomic life including agriculture,
industry, trade, finance, prices and marketing information, income and expenditure, education, health,
culture and social situations as well as the government and the political sector for the use of the government
and the public;

The authority and function of PSA is not only focused on matters regarding civil registrations as commonly
understood by the laymen. But covers almost every aspect of maintaining a sustainable community—
housing, agriculture, business and industry, as well as employment. PSA will gather statistical data on the
foregoing and in return report the same periodically to the NEDA to aid and assist the latter in policy decision
making and recommendations to the Congress and President of the Philippines that will affect the economic
and social development of the Republic.

RA 10625. Section 9. Powers and Functions of the PSA Board. – The PSA Board shall have the
following powers and functions: xxx

All agencies of government are hereby mandated to comply with any and all directives requested
by the PSA Board (in relation to and implementation of their mandated functions), either motu proprio or
through the PSA. Failure, without justifiable reason, by any agency to comply with this mandate shall result
in the filing of administrative and criminal cases against the erring government personnel and the
immediate superior concerned without prejudice to violation of any other law or regulation. In a criminal
case, the penalties provided in the second paragraph of Section 27 hereof shall apply.

1. Conduct of Surveys

a. RA 10625. Section 25. Obligation to Provide Information. – The National Statistician shall
determine whether a statistical inquiry or survey to be conducted is with or without an obligation to
provide information. If such obligation is stipulated, all respondents whether natural or legal
persons shall be liable to reply to the statistical inquiry or survey. This section applies to all statistical
inquiries or surveys conducted by other statistical offices in the PSS.

The respondents under this Act are required to give truthful and complete answers to
statistical inquiries or surveys of the PSA and other statistical offices of the PSS. The respondent is
considered to have complied with the obligation only upon receipt of the duly completed statistical
inquiry or survey forms. The government shall provide franking privileges, charges and postings to
the survey offices, unless otherwise disallowed by law.

The PSA is authorized to gather data from other government agencies for statistical purposes.

Vis-a-viz: Commonwealth No. 591 Sec. 3. The collection of data and information prescribed
in section two may be secured by the mailing or delivery of the necessary questionnaire or form and
explanatory matter to the persons best qualified to furnish such data or information and in which
case the proprietor, official, Government official or employee, partner, director or legal
representative to whom such questionnaire or form is mailed or delivered shall be required to
accomplish such questionnaire or form personally or cause the same to be accomplished by his duly
authorized agent or representative. Any person who fails or refuses to accomplish, mail or deliver
such questionnaire or form received by him to the Bureau of the Census and Statistics within thirty
days of its receipt by him; or any person who, in accomplishing any such questionnaire or form,
knowingly gives data or information which shall prove to be materially untrue in any particular; or
any person who signs such questionnaire or form after it has been accomplished in the knowledge
that it is untrue in any particular shall, upon conviction, be punished by a fine of not more than six
hundred pesos or by imprisonment for not more than six months, or by both.

RA 106 25 Section 27. Penalties. – Respondents of primary data collection activities such
as censuses and sample surveys are obliged to give truthful and complete answers to statistical
inquiries. The gathering, consolidation and analysis of such data shall likewise be done in the most
truthful and credible manner. xx

Violation: Gen. Provision in Sec. 27

In cases where the respondent who fails to give a truthful and complete answer to
such statistical inquiries is a corporation, the above penalty (1 year imprisonment AND fine
100K) shall be imposed against the responsible officer, director, manager and/or agent of
said corporation. In addition, such erring corporation or any other juridical entity,
depending on the category of the enterprise or business concerned whether small, medium
or large, shall be imposed a fine ranging from One hundred thousand pesos (P100,000.00)
to Five hundred thousand pesos (P500,000.00).

b. RA 10625. Section 26. Confidentiality of Information. – Individual data furnished by a


respondent to statistical inquiries, surveys and censuses of the PSA shall be considered privileged
communication and as such shall be inadmissible as evidence in any proceeding.

The PSA may release aggregated information from statistical inquiries, surveys and censuses
in the form of summaries or statistical tables in which no reference to an individual, corporation,
association, partnership, institution or business enterprise shall appear.

The National Statistician and ALL staff of the PSA shall take a solemn oath regarding
confidentiality of information. However, confidentiality of information does not apply to:

(a) Information in the form of a list or index of individual business firms, establishments or
organizations that contain any or all of the following information:
(1) The name, address and telephone numbers;

(2) The business and products that they are engaged in; and

(3) The specific ranges of number of employees.

(b) Microdata from statistical inquiries or survey form/questionnaire/schedule prepared by


the PSA for purposes of research, with care to ensure that identities of a particular person,
business or organization will not be disclosed in whatever form; and

(c) Access to census data after one hundred (100) years for historical, genealogical, scientific
or other research purposes.

Vis-a-viz: Commonwealth No. 591 Sec. 4. Data furnished the Bureau of the Census and
Statistics (NSO) by an individual, corporation, partnership, institution or business enterprise shall not
be used as evidence in any court or in any public office either as evidence for or against the individual,
corporation, association, partnership, institution or business enterprise from whom such data
emanates; nor shall such data or information be divulged to any person except authorized employees
of the Bureau of the Census and Statistics, acting in the performance of their duties; nor shall such
data be published except in the form of summaries or statistical tables in which no reference to an
individual, corporation, association, partnership, institution or business enterprise shall appear. Any
person violating the provisions of this section shall, upon conviction, be punished by a fine of not
more than six hundred pesos (Php 600) or by imprisonment for not more than six (6) months, or
by both.

Reason for confidentiality: To obtain more reliable information, information vital to the
workings of society.

Violation of confidentiality:

1. CRIMINAL LIABILITY: RA 10625 Sec. 27. Penalties. Any person, including parties within the
PSA Board and the PSA, who breach the confidentiality of information, whether by carelessness,
improper behavior, behavior with malicious intent, and use of confidential information for profit, are
considered guilty of an offense and shall be liable to fines as prescribed by the PSA Board which shall
not be less than Five thousand pesos (P5,000.00) nor more than Ten thousand pesos (P10,000.00)
and/or imprisonment of three (3) months but not to exceed one (1) year, subject to the degree of
breach of information. (refers to range only!).

2. ADMINISTRATIVE LIABILITY: RA 6713 Sec. 7(c) Disclosure and/or misuse of confidential


information. - Public officials and employees shall not use or divulge, confidential or classified
information officially known to them by reason of their office and not made available to the public,
either:

(1) To further their private interests, or give undue advantage to anyone; or

(2) To prejudice the public interest.

RA 10625 = is a special law


RA 6713 = is a general law which applies to public employees in general
GENERAL PENALTY FOR VIOLATION OF RA 10625

RA 10625. Section 27. Penalties. – xxx

To ensure compliance, ANY violation of this Act shall result in the imposition of the penalty
of one (1) year imprisonment AND a fine of One hundred thousand pesos (P100,000.00).

2. SURVEY CLEARANCE

Legal basis: RA 10625. Section 9. Powers and Functions of the PSA Board. – The PSA Board
shall have the following powers and functions: xxx

f. Provide technical assistance and exercise supervision over major government


statistical activities;

IRR, Art. 49. The PSA shall establish a Statistical Survey Review and Clearance System (SSRCS)
to provide assistance and support to the statistical work of other government agencies in the PSS,
including the LGUs and the GOCCs.

IRR, Art. 50. The SSRCS shall involve the evaluation of surveys or censuses sponsored and/or
to be conducted by government agencies at the national and sub-national level.

It shall cover several areas such as the need to conduct the inquiry; duplication; sampling
design; forms content and table format; operational plans and; the outputs.

What are the objectives of the SSRCS?

The SSRCS was formulated to ensure conformity of surveys/censuses with standard


definitions, concepts and classifications, and consequently, the reliability, comparability and accuracy
of statistics generated out of said activities. Specifically, it aims to:

 Ensure sound design for data collection


 Minimize the burden placed upon respondents
 Effect economy in statistical data collection
 Eliminate unnecessary duplication of statistical data collected
 Achieve better coordination of government statistical activities

RA 10625. Section 27. Penalties. xxx Failure to comply with the survey clearance provision
shall be penalized by a fine of Fifty thousand pesos (P50,000.00) to One hundred thousand pesos
(P100,000.00), depending on the gravity and seriousness of such noncompliance.
