REGULATION ORDINANCE NO. 2018-092


AN ORDINANCE ESTABLISHING HOME CARE SUPPORT SERVICES TO
INDIGENT PERSONS WITH DISABILITIES (PWD'S) AND SENIOR CITIZENS IN
EVERY BARANGAYIN THE CITY OF ILOILO

WHEREAS, Section 15, Article II of the 1987 Philippine Constitution states that "The
State shall protect and promote the right to health of the people and instill health consciousness
among them";

WHEREAS, Section 11, Article XIII of the same Constitution provides that the State
shall adopt an integrated and comprehensive approach to health development which shall
endeavor to make essential goods, health and other social services and priority shall be for the
needs of the underprivileged sick, elderly, disabled, women and children;

WHEREAS, under Section 16 of the Local Government Code of the Philippines, every
local government unit is likewise empowered to exercise powers essential to the promotion of
the general welfare of its inhabitants;

WHEREAS, hospice care services provide special care to improve the quality of life for
both patients, such as indigent PWD' s and bed ridden senior citizens and their families who
cannot afford to be treated in a private hospice care or any health institutions;

WHEREAS, the DSWD issued Administrative Order no. 04 and 05 which provides for
guidelines on the home care support services for senior citizens and general implementing
guidelines on long term care program for senior citizens, respectively;

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of Iloilo City in


session duly assembled that:

Section 1. Short Title. This ordinance shall be known as "Home Care Support Services
Ordinance in the City of Iloilo''.

Section 2. Declaration of Policy. The State shall adopt an integrated and comprehensive
approach to health development which shall endeavor to make essential goods, health and other
social services available to all people at affordable cost; Priority for the needs of the
underprivileged sick, elderly, disabled, women and children.

The services aim to improve the quality of life of indigent persons-with-disabilities


(PWDs) and bed ridden senior citizens, in order to alleviate their physical, emotional,
psychological and spiritual well-being, as well as their families.

Section 3. Purpose and objective. The Home Care Support Service is designed to
provide support to indigent PWDs, bed ridden terminally-ill patients and senior citizens and their
caregivers, who cannot afford the services of a private health care institution.

The Home Care Support Service focuses on giving comfort and quality of life; to lessen
the anxiety in terms of health care and service of the indigent patients with disabilities, bed-
ridden patients and senior citizens.

Section 4. Definition of Terms. For purposes of this Ordinance, the following shall
mean:

a. Home Care Support Service -Care designed to give supportive care to the terminally-
ill, and bed-ridden patients and focus on comfort and quality oflife, rather than cure.
b. Brgy. Health Workers - health care providers that renders primary services, such as
maternal, newborn and child care, in the barangays, and after undergoing a basic
training program under an accredited government or non-government organization.
c. Person with Disabilities (PWD) - those suffering, may it be temporary or permanent,
from restriction or different abilities, as a result of mental, physical or sensory
impairment, to perform an activity in the manner or within the range considered
normal for human being, and is dependent for support with his/her family or other
persons

d. Senior Citizens - a resident citizen of the Philippines who reaches the age of sixty
(60) years old and above and is bed ridden or suffering from an illness that renders
him/her dependence for support with others, be it a family or another person not
related to him/her.

e. FSCAP - Federation of Senior Citizens' Associations of the Philippines

f. PDAO - Persons with Disability Affairs' Office

Section 5. Services and On-site care. The Home Care Support Services shall be
established under the leadership of the Punong Barangay together with the Barangay Council, in
coordination with FSCAP, PDAO and Barangay Health Workers, to conduct the actual
monitoring and counseling in the residences of the identified indigent PWDs and bed ridden
senior citizens.

Section 6. Mandatory Hospice care service and monitoring. The Home Care Support
Services in the Barangays shall be spearheaded by the Punong Barangay and Brgy. Council
Chairman Committee on Health to be supported bt FSCAP and Brgy. Health Workers who are
trained and tasked to provide counseling and monitoring of the health conditions of identified
indigent PWDs and immobilized or bed ridden senior citizens or those indigent PWDs and senior
citizens whose existence is depending on the support of other persons. The monitoring services
should include the basic vital signs of the clients, sensorium and hygiene of the patient.

Section 7. Identification of indigent pwd's, bed-ridden patients and senior citizens.


The City Mayor shall create a Home Care Support Task Force in every barangay to be composed
of Barangay Health Worker, Barangay Nutrition Scholar, member of FSCAP, and a member of
Persons-with-Disabilities (PWD's) group and from the youth sector.

Further, the City Mayor shall designate a City Hall Officer who shall act as a point
person to oversee the operation and undertakings of the Home Care Support Task Force in every
barangay.

Section 8. Tasks and Functions. The following shall be the task and functions of the
Barangay Home Care Support Task Force:

1. Identification of indigent and bed-ridden senior citizens and pwd's;


2. Monitoring of the conditions of the identified clientele;
3. Keep record and report the identified clientele with the City Govermnent and
CSDWO;
4. Provides counselling to the family members of the patients.

Section 9. Identification of indigent, pwd's, bed ridden patients and senior citizens.
The City Social Welfare and Development Office (CSWDO) shall be required to identify
indigent PWD's, bed-ridden patients and senior citizens in every barangay and to maintain a data
base thereof.

Section 10. Trainings/seminars. The City Social Welfare and Development Office
(CSWDO) and the City Health Office shall spearhead the conduct of trainings and seminars
intended for the Punong Barangay and the Barangay Council, together with the FSCAP and
PDAO members and Barangay Health Workers, trained and tasked to undertake the
responsibilities under this Ordinance. The City Health Doctors, Nurses and Barangay Health
Workers are required to undergo trainings and seminars with Geriatrics Specialists.

Section 11. Allocation of budget. The budget for trainings and seminars, as provided for
in the preceding section, shall be included in the City's annual budget.

Section 12. Separability Clause. If any provision of this ordinance is declared void or
invalid, the other provisions not affected thereby shall remain in full force and effect.

Section 13. Repealing clause. Any ordinances, rules and regulations or any part thereof
inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

Section 14. Effectivity. This ordinance shall take effect upon its approval.
