1 Introduction
This document details the requirements of the Contract Plan to be prepared and submitted by the
Contractor.

2 Details of the Contract Plan


Each plan which comprises part of the Contract Plan must include the following elements:

a) purpose and policy statements regarding the content of the plan

b) brief description of each individual management plan and how they will be integrated across
the services

c) key Contractor contacts

d) consortium and multi supplier relationships, communication strategy and key accountabilities,
and

e) sub-contractor management system.

The Contract Plan must be submitted and updated by the Contractor in accordance with the General
Conditions.

3 Contract Plan Inclusions


The Contract Plan must include the following documents:

a) Quality Plan

b) Environmental Management Plans

c) Workplace Health and Safety Plan

d) Traffic Management Plan

e) Community Engagement Plan

f) Incident Management plan

g) Maintenance Management Plan, and

h) Risk Management Plan.

These documents must be included in one, loose leaf volume titled Contract Plan.

The Contract Plan also includes the plans outlined in Clause 13.1 of the General Conditions.

4 Project Program
A ‘Project Program' is a statement in writing showing the dates by which, or the times within which, the
various stages or parts of Programmed Maintenance Work or Rehabilitation Maintenance Work in
respect of a Project are to be executed or completed.

Each Project Program submitted to the Principal's Representative under Clause 53.3 of the General
Conditions, or included in a Project Proposal in accordance with Clause 17.1 of the General
Conditions, must comply with the requirements of this Clause 4.

4.1 Content of Project Program

Each Project Program:

a) shall be consistent with the current Final Annual Works Program approved under Clause 17.4
of the General Conditions

b) shall show the Contractor’s bona fide planned work activities and sequences for bringing the
Project to Practical Completion by the Date for Practical Completion specified in the Project
Proposal, and

c) shall not affect the time for performance by the Principal or the Principal’s Representative of
any of their obligations or oblige either of them to do anything earlier than is necessary to
enable the Contractor to bring the Project to Practical Completion by the Date for Practical
Completion specified in the Project Proposal.

4.2 Bar Chart Program

Each Project Program must be in the form of a bar chart which includes:

a) all significant key dates and milestones, including dates by which the Principal is required to
supply information or materials, or is required to have done anything

b) an appropriate number of activities not less than the number of individual roads involved in the
Programmed Maintenance Work and the Rehabilitation Maintenance Work and the key
milestones

c) activity durations of not longer than 21 days

d) a separate detailed activity listing showing coding, estimated duration and full logic links
between activities

e) one start activity (approval of the Project Proposal) and one end activity (Practical Completion
attained)

f) one or more continuous paths of zero float from the start activity to the end activity or end
activities, and

g) at least two calendars, one for calendar days and one for working days.

5 Quality Plan
The Quality Plan must be consistent with:

a) Transport and Main Roads Specification MRS50 Specific Quality System Requirements, and

b) any Quality Plan outline submitted with the Contractor’s tender (except to the extent that any
Quality Plan outline is inconsistent with MRS50 or any of the other documents comprising the
Contract, then the outline must be amended to the extent of any inconsistency).

The Quality Plan must include:

i. procedures for the implementation and management of the plan

ii. procedures for demonstrating design life of the work under the Contract (where applicable)

iii. systems for complying with the Performance Measurement Plan in Appendix B, including the
Maintenance Levels of Service and rectification of defects

iv. systems for reporting against the Performance Measurement Plan, including:

a) reporting against compliance with the Maintenance Levels of Service, and

b) reporting against the KPIs as set out in the Performance Management Plan.

v. quality standards applied to achieve compliance for each element of the Works

vi. the Contractor’s internal non-conformance system to be applied, and

vii. methods for continual improvement through learning from non-conformance and
developments throughout the Term.

6 Environmental Management Plans


The Environmental Management Plans must be consistent with:

a) the Environmental Protection Act 1994 (Qld) (the Act)

b) Transport and Main Roads Specification MRS51 Environmental Management, and

c) any Environmental Management Plan (EMP) outline submitted with the Contractor’s tender
(except that if any Environmental Management Plan outline is inconsistent with the Act,
MRS51 Environmental Management or any of the other documents comprising the Contract,
then the outline must be amended to the extent of any inconsistency).

All applicable environment protection measures must be implemented prior to commencing the work
under the Contract.

Nothing contained in this Clause will limit or exclude any of the Contractor’s obligations or liabilities
under the General Conditions.

All relevant Australian Standards, Statutory Requirements, Local Authority Regulations, other
documents and the requirements in or referred to in the Contract shall be taken into account in the
preparation and implementation of the EMP (M) and EMP (C).

The Contractor shall take all reasonable actions necessary to prevent (where feasible), or otherwise
minimise, nuisance to others generated by the work under the Contract.

6.1 Environmental Management Plan (Maintenance)

The EMP (M) shall be the Contractor’s plan of management to ensure that all Works (including the
repair of any damage to the environment as a result of such works) undertaken by the Contractor
(including all subcontractors) shall have minimal impact on the environment and shall be in
accordance with all relevant Statutory Requirements. The Contractor is reminded that he has a “duty
of care” under some state legislation for environment and cultural heritage. Where the requirements of
other Specifications relate to higher Environmental Control Standards than this Contract, the higher
standards shall be adopted. The requirements of this Contract shall always be the minimum
requirements that apply.

The EMP (M) shall address at least the following issues:

a) all Off-Site disposal of excavated, demolished and surplus materials

b) erosion and sediment control

c) vegetation management including the disposal of the cleared and grubbed vegetation,
declared plant and weed seed management, revegetation, habitat log identification and
relocation

d) cultural heritage

e) noise and vibration management, and

f) environmental issues included in the Specifications and relevant attachments.

The Contractor shall prepare an EMP (M) to cover all Routine Maintenance Work (including variations
to the Contract) required for the completion of the Contract including On-Site and Off-Site work. The
Contractor must include the following content and processes in the preparation, submission, annual
revision, review and maintenance of the content of the Environmental Management Plan
(Maintenance):

i. The Contractor shall include its Environmental Management Statement which shall define its
commitment to addressing environmental issues within the EMP (M).

ii. Incorporate best practice environmental management which is defined as "the management of
an Activity to achieve an ongoing minimisation of the Activity's environmental harm through
cost-effective measures assessed against the measures currently used nationally and
internationally for the Activity".

iii. Describe how the Contractor will identify and abide by all relevant Statutory Requirements.
This should focus on how the Contractor will develop productive working relationships with the
Principal’s Representative to ensure that any legislative or policy changes that increase or
decrease the regulatory framework of the Contractor are efficiently provided to the Contractor
and implemented by the Contractor.

iv. Document how the Contractor will obtain, implement and supply copies to the Principal’s
Representative of all relevant approvals, licences, permits, etc. relating to the Routine
Maintenance Work. Document how the Contractor will obtain, implement and comply with
approvals, codes, licences and permits that have been obtained by the Principal.

v. Document how any reporting of data to the Principal’s Representative, required by the
Statutory Requirements regardless of which party manages the Statutory Requirements, will
be available within five business days of request by either the Contractor or the Principal’s
Representative.

vi. Document how the Contractor shall supply copies of such licences, permits, etc. to the
Principal two working days prior to commencing the relevant Routine Maintenance Work.

vii. Maintenance of a register of all licences, permits, approvals and codes being used by the
Contractor. The Contractor is able to adopt the Principal’s Legislation Register but if this does
not occur the Contractor will need to maintain a Legislation Register relevant to the Contract.

viii. To ensure the EMP (M) is practicable and achievable the Contractor shall develop, document
and implement for each maintenance activity:

a) environmental controls (e.g. erosion and sediment controls, clearing limits, waste
disposal processes) and commitments (e.g. all waste will be recycled for sign removal
activities)

b) monitoring and maintenance requirements for devices nominated in the environmental


controls described above (including all testing and reporting of test results required under
this Specification)

c) an asset register detailing temporary and permanent controls installed on the Road
Infrastructure to protect the environment, access provisions and long term maintenance
requirements for such devices

d) restoration procedures should a control fail or an environmental incident occur

e) supervision protocols and the assignment of responsibility for environmental


management, and

f) internal and external auditing and reporting procedures to ensure best practice.

Additional activities may be applicable as a result of variations to the Contract at which time the
information requested in this appendix will need to be submitted for these activities to the Principal for
acceptance prior to works commencing.

6.2 Environmental Management Plan (Construction)

An EMP (C) is required to be prepared and submitted in accordance with Clause 53.1 of the General
Conditions for each Project of Programmed Maintenance Work and Rehabilitation Maintenance Work.

Each EMP (C) is to be prepared in accordance with the requirements of Transport and Main Roads
Specification MRS51 Environmental Management and Technical Specification MRTS51.

The Principal will consider a combined EMP (C) for a series of projects if they are similar in nature, in
relative close proximity and programmed for delivery within proximate timeframes.

7 Workplace Health & Safety Management Plan


Without limiting Clause 30 of the General Conditions, the WHS Management Plan must comply with
the requirements of the WHS Act and WHS Regulation (as those terms are defined in Clause 30 of the
General Conditions) and any other associated Statutory Requirements.

The WHS Management Plan must include:

a) the names, positions and health and safety responsibilities of all persons at each Site whose
positions or roles involve specific health and safety responsibilities in connection with the work
under the Contract

b) the arrangements in place, between any persons conducting a business or undertaking at the
Workplace where work under the Contract is being undertaken, for consultation, cooperation
and the coordination of activities in relation to compliance with their duties under the WHS Act
and the WHS Regulation

c) the arrangements in place for managing any work health and safety incidents that occur at the
Site

d) any Site-specific health and safety rules, and the arrangements for ensuring that all persons at
the Workplace are informed of these rules, and

e) the arrangements for the collection and any assessment, monitoring and review of safe work
method statements at the Workplace.

A copy of any amendments to the WHS Management Plan shall be submitted to the Principal’s
Representative within seven days after the date of such amendments.

8 Traffic Management Plan


8.1 Definitions

The terms used for Traffic Management Plans are defined in Table 8.1.

8.2 Traffic Guidance Schemes

The Traffic Guidance Scheme must aim to:

a) first, maintain or improve safety and ensure the safety of road workers, and

b) second, balance:

i. the safe and convenient movement of traffic, and

ii. the construction and traffic management costs.

The Traffic Guidance Scheme must be provided to the Principal seven days prior to commencement
of each Project in accordance with Clause 53.1 of the General Conditions.

8.3 Traffic Management Plan

The Traffic Management Plan must be consistent with:

a) MRTS02.MTC, MRTS02-1.MTC Annexure (contained in the Supplementary Specifications)

b) MUTCD

c) TRUM Volume 7, and

d) any Traffic Management Plan outline submitted with the Contractor’s tender. If any Traffic
Management Plan outline is inconsistent with MRTS02.MTC, MRTS02-1MTC, MUTCD,
TRUM Volume 7 or any of the other documents comprising the Contract, then the outline must
be amended to the extent of any inconsistency unless the Principal has given its express
approval of the inconsistency.

The Traffic Management Plan must include, but is not limited to, details of all:

i. objectives, policy statements and overall strategy

ii. proposed road closures

iii. detours

iv. staged construction

v. speed limit changes

vi. the relevant Authorities whose approval is required to be obtained and required approvals

vii. the procedures to comply with any minimum traffic restrictions and must be accompanied by
duly completed Form M994

viii. traffic control devices

ix. communications

x. resources, including people, systems, plant, and so on, and

xi. details of specific requirements for each category of work under the Contract.

Alternative or innovative Traffic management solutions that provide improved value for money
outcomes are encouraged.

8.4 Traffic Management obligations

Without limiting the provisions set out above in relation to the Traffic Management Plan, the Contractor
must comply with the requirements set out in this Clause 8.4 in relation to traffic management.

8.4.1 Restrictions to Traffic

Restrictions to the passage of vehicular traffic through the Site shall be subject to any limiting
requirements stated in MRTS02.MTC and in accordance with guidance within TRUM Volume 7.

8.4.2 Excavation Adjacent to Road under Traffic

This Clause 8.4.2 applies to excavation works being carried out at a Site which is adjacent to roads
still being used by passing Traffic.

Where an excavation within 1 m of a lane under Traffic exceeds 150 mm in depth, backfilling to within
150 mm of the adjacent pavement level shall be completed within 48 hours of the commencement of
the excavation. Alternative arrangements may be approved by the Principal’s Representative, but only
where it can be shown that the excavation is adequately supported against partial or complete
collapse.

Excavations within 1 m of roads under Traffic shall be completed and backfilled to final levels as soon
as possible to permit safe and unhindered passing of adjoining Traffic. The Principal’s Representative
may direct the Contractor to backfill the excavation at its cost if the Contractor does not attempt to
expedite the return of traffic to its previous status where it is practical to do so.

Any excavation that presents a danger to adjacent Traffic must be substantially highlighted to passing
motorists by adequate traffic control devices.

8.4.3 Notification of Traffic Changes

Unless otherwise required under Clause 8.4.3 of this Appendix D:

a) the Contractor shall give the Principal’s Representative a minimum of 14 days written notice of
changes in Traffic movements necessary to perform Programmed Maintenance Work or
Rehabilitation Maintenance Work, and

b) all road closures shall be subject to approval by the relevant Authority which shall be given a
minimum of 14 days notice, or such other period as the Authority may require, of traffic
changes which affect it.

8.4.4 Traffic Management Company Register

The Principal maintains a register of Registered Traffic Management Companies.

Any company undertaking the traffic management work must be a Registered Traffic Management
Company.

9 Community Engagement Plan


9.1 Contents of Community Engagement Plan and Project Specific Communications
Control Plan

a) the Contractor shall prepare, manage, implement and maintain a Community Engagement
Plan (CEP) for the Contract

b) the CEP will include the following sections:

i. CEP purpose

ii. Contract background

iii. Contract scope

iv. Contract benefits

v. community engagement goals

vi. community engagement objectives

vii. key performance indicators

viii. Issues analysis / management

ix. key messages

x. stakeholders

xi. community engagement strategy

xii. community engagement action plan

xiii. resources and approvals, and

xiv. evaluation plan.

c) the CEP must reflect the following overarching obligations of the Contractor:

i. to comply with the department’s community engagement policy, standards, principles and
guidelines

ii. to obtain approval from the Principal’s Representative for all materials and activities related
to community engagement prior to publication and execution, and

iii. to supplement the Community Engagement Plan the Contractor must prepare and submit a
Project Specific Communications Control Plan (PSCCP) for all Projects of Maintenance
Work Programmed and Rehabilitation Maintenance Work and high impact Routine
Maintenance Work Activities.

d) the Project Specific Communications Control Plan will include the following sections:

i. purpose

ii. project details

iii. issues analysis / management

iv. key messages

v. stakeholders

vi. community engagement strategy, and

vii. community engagement action plan.

e) templates for the CEP and PSCCP will be provided by the Principal upon request.

9.2 Detailed requirements in relation to community engagement

Without limiting the provisions set out above in relation to the Community Engagement Plan, the
Contractor must comply with the requirements set out in this Clause 9.2 to Clause 9.4 in relation to
community engagement.

9.2.1 Works Not to Commence Without Approval

The Contractor must not commence work under the Contract until all relevant communication
materials and activities have been approved and issued to key stakeholders and the community within
the timeframes agreed in the CEP.

9.2.2 Dealing with Elected Members

a) If required, applicable elected representatives shall be offered a briefing prior to the start of
work under the Contract. This requirement will be outlined in the PSCCP Action Plan. The
Principal’s Representative will arrange and must attend all meetings with elected
representatives. A summary of meeting outcomes must be provided to the Principal's
Representative and the Principal’s Communication Officer.

b) Importantly, the Contractor must ensure the Principal is given sufficient notice to be able to
notify the applicable federal and / or state member at least a week prior to any other
stakeholder notification. That is, notifying affected property and business owners, other
impacted stakeholders and the local community of works commencing, works required outside
the working hours contained in the Contract, significant operational changes, traffic disruptions
and associated controls, construction of temporary detours and so on.

c) The Contractor must immediately refer all enquiries from federal, state and / or local
government representatives to the Principal.

d) If required, the Contractor shall provide content for monthly electorate news briefs to the
Principal at the start of the third week of every month. This brief is a department requirement

to keep the elected representative up-to-date on the work under the Contract. Transport and
Main Roads will provide a template if necessary.

9.2.3 Notice to Affected Stakeholders

a) It is a requirement that affected property and business owners, key stakeholders and the local
community are provided with at least seven working days notice prior to works commencing,
or of any works required outside the working hours contained in the Contract, significant
operational changes, traffic disruptions and associated controls, construction of temporary
detours and so on.

b) It is acknowledged that there are occasions when the work program changes unexpectedly,
however every effort must be made to notify key stakeholders and the community within the
seven working days timeframe.

c) Prior to receiving any notices to allocated stakeholders, the Contractor must:

i. give sufficient notice to the Principal to allow the Principal to inform the applicable federal
and/or state member at least a week prior to any stakeholder notification being issued
(refer to Section 9.2.2(b)), and

ii. obtain the approval of the Principal to issue the relevant notification (refer to Section 9.2.4).

9.2.4 Style of Communication Materials

a) The Contractor shall notify the Principal of any significant upcoming projects in advance and
submit a PSCCP and applicable communication materials to enable the Principal to obtain the
required level of approval.

b) The Contractor shall develop appropriate communication materials for the Principal's review
and approval as agreed in the CEP and / or PSCCP Action Plan. For example web content,
stakeholder notification letters, media statements, advertisements, project updates, factsheets
and so on, which aim to notify key stakeholders and the community of significant maintenance
activities and associated impacts. The Principal will provide applicable templates and style
guides.

c) Language shall be targeted at an audience that is unskilled in technical road knowledge and
terms. Communication materials must be written so they are clear to most people. Jargon and
technical language shall be avoided.

d) Quotes or statements are only allowable in media statements and can only be attributed to the
Minister for Transport and Main Roads (i.e. not departmental staff). It is permissible and often
desirable to quote statements which were made by the Minister on a previous occasion.

9.2.5 Delivery of Communication Materials

a) The printing and physical distribution of communication materials including letterbox drops to
distribution areas shall be coordinated by the Contractor.

b) The Contractor will be required to doorknock local property and business owners who are
directly impacted by upcoming works to discuss any access or timing considerations. The
Contractor will only undertake doorknocking if previously discussed and agreed with the
Principal. For health and safety reasons, the Contractor must always be accompanied by
another project team member. It is desirable for the CLO to be present. A record of contact

and applicable actions shall be recorded in a stakeholder database / register of engagement


(refer to Clause 9.2.7 of this Appendix D).

9.2.6 Notification of Issues

a) The Contractor must immediately notify the Principal of any issues related to the delivery of
the work under the Contract that may have the potential to affect the reputation of the Principal
and provide a suggested communication strategy, if applicable.

b) Issues include but are not limited to, safety or environmental incidences (including ‘near
misses’), unplanned disruptions to traffic, concerns or complaints raised by stakeholders, any
community protests or unannounced onsite media or elected representative visits.

9.2.7 Enquiries and Complaints

a) The Contractor shall manage and maintain a stakeholder database / register of engagement
for the Contract and record all maintenance enquiries and complaints and applicable actions.

b) Complaints in connection with the work under the Contract shall also be recorded in a
complaints register. The Contractor shall manage and maintain a complaints register and
report any trends monthly to the Principal for reporting purposes. The Principal will provide a
template for monthly complaints reporting.

c) The Contractor can respond to verbal enquiries or complaints that are directly related to the
Contract. In that case, details of the Contact and associated action must be recorded in a
stakeholder database / register of engagement and a complaints register.

d) If the Contractor receives written enquiries or complaints, a draft response must be provided
to the Principal along with the incoming correspondence as soon as possible following receipt
of the enquiry or complaint, for approval and distribution by the Principal.

e) If the Principal is required to respond to an enquiry or complaint, the Principal will send a
request for information to the Contractor and identify a timeframe for the draft response to be
provided. The Contractor is responsible to liaise in a timely manner with subcontractors for
input as required.

f) The Principal shall forward a copy of all enquires and complaints received and associated
actions to the Contractor for recording purposes in a stakeholder database / register of
engagement and a complaints register.

g) If the Contractor receives any enquiries or complaints that are not directly related to the
Contract, they must refer them to the Principal either by:

i. giving the stakeholder or community member a regional contact card and asking them to
contact the Principal direct, and

ii. making note of their name and contact details and providing the information to the Principal
within 24 hours.

9.2.8 Contractor’s Site Staff

a) As part of Site inductions, the Contractor must include a section about communication and
engagement that should be presented by the CLO and otherwise ensure all staff and
sub-contractors are aware of their responsibilities and any constraints associated with contact

with the media, elected representatives, the community, residents, business and other
stakeholders.

b) All Contract staff must be made aware of where enquiries or complaints must be referred to.

c) It may also be necessary to regularly remind site crew and sub-contractors about the
communication and engagement expectations or raise community and stakeholder-related
issues at site toolbox talks and start up meetings.

9.2.9 Planning and Reporting

a) The CLO is required to attend meetings with the Principal’s Representative to discuss
significant upcoming projects and associated communication activities and potential issues
and milestones.

b) The Contractor’s monthly Performance Report shall include a communication and


engagement summary that will include, but not be limited to communication activities
undertaken in the previous month, planned communication activities in the upcoming month,
key milestones and opportunities, any interesting facts and statistics and any outstanding
issues.

c) An example of a milestone is a major traffic switch associated with significant rehabilitation


works. The Contractor is required to notify the Principal at least eight weeks prior to a
milestone so a media event opportunity can be considered by the Minister’s Office.

9.2.10 Media Events

a) At times, the Principal's or the Minister’s Office may wish to host a site visit or hold a media
event. The Principal will liaise with the Contractor regarding the coordination of these site
visits and media events.

b) The Contractor may be required to provide support on project related communication events.

9.2.11 Evaluation

a) The Contractor shall prepare a Community Engagement Evaluation Report at the end of each
Year to evaluate and measure the effectiveness of community engagement activities against
the CEP.

b) The report shall be provided to the Principal’s Representative by 1st August each year.

9.3 Limitations Concerning Communication and Engagement

9.3.1 Release of Information

a) The Contractor must not publicly release any information, in any form, regarding the work
under the Contract, to any organisation or person without prior agreement with the Principal.
In particular:

i. the Contractor must not make any statement or provide any information to any media or
political representative or their staff. The Contractor must refer the enquiry directly to the
Principal, and

ii. should the Contractor be contacted by the media (including industry magazines, websites,
and local print and radio) concerning the Contract, it must take the name, phone number,

email, nature of the enquiry, deadline and media outlet of the journalist and immediately
advise the Principal.

b) The Contractor must not directly respond to stakeholder or community enquiries or complaints
that are not related to the Contract. All such enquiries or complaints must be referred to the
Principal as outlined in Clause 9.2.7 above.

c) The Contractor must publicly issue any project information or materials that have not been
agreed with or approved by the Principal. This includes, but is not limited to, preparing letters
to residents and businesses and doorknocking.

9.3.2 Contractor’s Logo

a) The Contractor’s logo must not appear on any public contract information, including
publications, display materials, website, videos, non-moving / fixed plant (including
containers), roadside signage, bridges, retaining walls or other structure at a Site.

b) The Principal's logo must appear on all federally funded project material.

c) Any use / application of logos or branding across the project will adhere to the department’s
signage branding policies and guidelines.

9.3.3 Recognition of the Principal

The Contractor will recognise and identify the Principal's role in any promotional material or award
submissions that it develops in relation to the Contract.

9.4 Liaison with the Principal’s Communications Team

9.4.1 Principal’s Communications Officer

The Principal has a nominated Communications Officer (CO) responsible to assist with the overall
coordination of communication and engagement in regards to the delivery of the work under the
Contract in each region. The CO is responsible to provide guidance on the Principal's policies and
procedures and secure all approvals of materials, events and engagement activities.

9.4.2 Contractor to Nominate Community Liaison Officer

a) The Contractor shall nominate a Community Liaison Officer (CLO) with adequate experience
in communication and engagement on road construction or maintenance projects.

b) The CO will work with the CLO to ensure a proactive approach to keeping key stakeholders
and the community informed of the progress of applicable work under the Contract. This will
generally include advice of maintenance activities and impacts including changed traffic
conditions, significant milestones and any other issues that may impact on identified
stakeholders and the successful delivery of the work under the Contract.

c) The CLO will be the primary point of contact between the Contractor and the Principal for all
community communication and engagement related matters. The relationship between the
CLO and the CO is demonstrated in the following diagram:

10 Incident Response Management Plan


The Incident Response Management Plan must set out the roles, practices and procedures for and
during an emergency event or incident (See Appendix I – Incident Management Arrangements for
more detail).

The Incident Response Management Plan must set out the procedures for responding to incidents and
dealing with emergencies, including:

a) links to the Traffic Management Plan regarding signage, road or lane closures, etc.

b) procedures on how the Principal’s Traffic Management Centre is linked / contacted

c) detailed response procedures

d) personnel, including the nominated incident manager

e) links to the Community Engagement Plan, and

f) detailed procedures for interfacing with the various infrastructure owners and other responders
to emergency events and incidents to ensure a coordinated approach to the incident.

11 Maintenance Management Plan


The Maintenance Management Plan must detail the Contractor’s strategy and procedures for
programming and planning to ensure the performance criteria set out in the Contract (including the
Maintenance Levels of Service) are achieved.

The Maintenance Management Plan must include details of:

a) the frequency of inspection of the Routine Maintenance Work

b) how forward programs for Routine Maintenance Work and Planned Routine Maintenance
Work are to be prepared

c) how records of completed Activities are to be submitted and in what format

d) how a log of the defects backlogs is to be prepared and updated, and

e) interaction with the Compensation and Performance Framework.

12 Risk Management Plan


The Risk Management Plan should include:

a) a risk register that identifies project risks and shows how these risks are managed and
moderated

b) a process that includes consultation with the Principal or the Contract Leadership Team to
review risks, update as necessary related to the individual risks and their consequences and
mitigation

c) compliance with the Principal's risk policy, and

d) a process for risk control of any innovative works procedures.

13 Work on or adjacent to Queensland Rail Property


13.1 General

13.1.1 Application of Clause 13

Clause 13 applies where the Contractor is required to work in, on, over, under or adjacent to
operations or property owned, operated or controlled by Queensland Rail.

Nothing in this clause shall in any way limit or exclude any of the Contractor’s obligations or liabilities
under the rest of the Contract.

13.1.2 Clause 13 Enforceable by Queensland Rail

Clause 13 is separately and severally binding:

a) as between the Principal and the Contractor, and

b) as between Queensland Rail and the Contractor.

and may be enforced against the Contractor by the Principal or Queensland Rail or both, but the
obligations and liabilities of the Principal and Queensland Rail under this clause are several only and
not joint or joint and several.

With respect to sub-paragraph (b), this clause:

i. has been included in the Contract and agreed to by the Principal acting as agent for
Queensland Rail, and

ii. has been agreed to by the Contractor in consideration of Queensland Rail permitting the
Contractor to carry out any work in, on, over, under or adjacent to operations or property
owned, operated or controlled by Queensland Rail.

13.1.3 No Contract between Principal and Queensland Rail

Clause 13 does not impose any obligations as between the Principal and Queensland Rail and:

a) neither of those parties is the agent of the other (except as provided in Clause 13.1.2(b)(i)) of
this Appendix D, and

b) neither of them warrants to the Contractor the due performance of the other under this
Clause 13.

The Regional Manager of Infrastructure and the Site Protection Supervisor are not employees, agents
or consultants of the Principal, and

i. are not authorised to give any directions or make any agreements that would alter or amend
the Contract or constitute a variation under Clauses 55 or 62 of the General Conditions, and

ii. are not authorised to give any directions or make any agreements that would alter or amend
the Contract or constitute a variation under the Contract.

13.1.4 Definition of Terms

Terms used in Clauses 13 and 14 are defined in Table 13.1.4 below unless the context requires
otherwise.

equipment may be operating.
Overhead Line Equipment The arrangement of conductors, suspended over or adjacent to
the Operating Railway, for supplying electricity to electric trains,
together with the associated foundations, structures, fittings,
insulators and other attachments by means of which the
conductors are suspended or registered in position.
Project Manager The person appointed by Queensland Rail as a representative for
the Regional Manager Infrastructure to oversee and coordinate
the works.
Protection Officer The person appointed by Queensland Rail to protect the safe
operation of the Operating Railway.
Queensland Rail The body corporate of that name existing pursuant to the
Transport Infrastructure Act 1994 and having its offices at Railway
Centre, 305 Edward Street, Brisbane.
Queensland Rail property Land owned by or under the control of Queensland Rail.
Regional Manager The Regional Manager Infrastructure in the Queensland Rail
Infrastructure Infrastructure Services Group responsible for the area in which
the Works are located, or a duly appointed representative.

Terms Definitions
Site Protection Supervisor The person appointed by Queensland Rail to oversee and advise
the Contractor on all railway safety requirements associated with
the work under the Contract.
Track Closure The closure of a section of the Operating Track to all rail traffic
other than construction related rail traffic.
Track Possession The period within a Track Closure when the Contractor is
authorised to carry out work over, under or adjacent to the closed
Operating Track.
Rail Site Each separate location where part of the work under the Contract
is to be carried out over, under or adjacent to the Operating
Railway.

13.1.5 Safety Training

The Contractor shall ensure that all staff, employees, subcontractors and all other persons for whom
the Contractor is responsible:

a) are fully informed of the dangers and procedures while working near existing railway tracks
and Overhead Line Equipment, and

b) have attended a Queensland Rail safety induction course (including electrification safety
where relevant) and are issued with a Queensland Rail safety induction card.

Persons not holding a Queensland Rail safety induction card will not be permitted to work on any
Queensland Rail property or to enter any part of Queensland Rail’s property not open to the general
public.

This requirement shall also apply to visitors, vendors and suppliers to the site and may only be waived
by the Protection Officer if the visitors, vendors and suppliers are attended by an employee of the
Contractor who is the holder of a Queensland Rail Safety Induction Card.

13.1.6 Safety Clothing

The Contractor shall ensure that all employees, visitors and other personnel present in an Excluded
Area are at all times wearing orange shirts or safety vests. Where work is to be carried out at night,
reflectorized orange safety shirts or vests shall be worn.

The requirement to wear safety clothing will not generally apply to drivers delivering materials or
equipment to Site except where such drivers are required or likely to get out of the delivery vehicle in a
location adjacent to the Operating Railway.

The Contractor shall ensure that no red or green clothing, including hats and safety helmets, is worn
by any employee, visitor or other personnel while in an Excluded Area.

13.1.7 Work Authorisation

All work which could affect the safety of Queensland Rail operations and / or property shall be carried
out by the Contractor to the satisfaction of the Project Manager.

All such work may be subject to constant supervision by a Protection Officer and shall be carried out
only at times authorised by the Project Manager.

The Contractor shall advise the Project Manager and Principal at least four weeks in advance of the
date on which work under the Contract, or any part of it, are located adjacent to a railway track with
Overhead Line Equipment is planned to commence. The Project Manager will determine the need for
Protection Officers and will advise the Contractor which work will require Protection Officers.

13.2 Construction Methods


13.2.1 General

The Contractor shall execute the work under the Contract in such manner as not to impede, obstruct,
interfere with, or endanger in any way the operations and / or property of Queensland Rail.

The safe operation of rail traffic shall take precedence over all Contract work and nothing shall be
done or suffered to be done by the Contractor, its subcontractors or the agents or employees of either
of them which will endanger or delay rail traffic.

13.2.2 Environmental Management Plan (Construction)

The EMP (C) shall ensure that all work undertaken by the Contractor on Queensland Rail property is
in accordance with all relevant Statutory Requirements.

No construction work will be permitted on Queensland Rail property until the written approval of the
relevant sections of the EMP (C) has been given by the Project Manager.

13.2.3 Site Protection Supervisor

No operation which, in the opinion of the Site Protection Supervisor, could affect in any way the
Queensland Rail operations and / or property shall be performed unless a Protection Officer is in
attendance.

The Contractor shall advise the Site Protection Supervisor and the Superintendent at least 48 hour (in
addition to non-working days) in advance, stating the period or periods for which Protection Officers
are required.

The Site Protection Supervisor will arrange for the services of a Protection Officer for the period or
periods required. The number of Protection Officers employed at any time shall be at the discretion of
the Site Protection Supervisor but not less than one.

13.2.4 Asset Management

Details of the Asset Management Plan, together with details of all falsework and formwork to be used
over or adjacent to railway tracks, shall be submitted to the Project Manager and the Principal. Work
will not commence until the Asset Management Plan, falsework and formwork details are authorised
by the Project Manager.

13.2.5 Track Clearances

All types of plant, fixed or mobile, used about or in connection with any work under the Contract shall
be so operated that no portion of the plant is at any time closer than 3.0 m (measured horizontally) to
the centreline of any railway track , except for the times and locations as otherwise agreed or provided
under this Appendix D.

All work on or inside Queensland Rail property shall be supervised by a Protection Officer, unless
otherwise approved by the Project Manager. Work further than 3.0 m horizontally from the track
centreline, but at a higher level where objects could fall within 3.0 m horizontally of the track
centreline, must be supervised by a Protection Officer.

The Contractor shall erect and maintain throughout the Contract period an approved high visibility tape
or other barrier 3.0 m horizontally from the track centreline to indicate the limits of the safe work area.

All falsework and formwork erected over the railway tracks shall provide a minimum of 4.3 m vertical
clearance above the railway tracks for non-electrified lines. When working on or adjacent to electrified
lines, the Contractor shall also comply with Clause 14.

13.2.6 Track Possessions

Any work under the Contract which could involve undermining the track, damaging the track, blocking
the track with rock or spoil, blasting and other operations which could prevent the safe operation of
trains shall be only scheduled for, carried out during, approved Track Possessions.

Prior to receiving approval Contractor to commence work under Track Possession the Contractor must
satisfy the Site Protection Supervisor that the proposed procedures are suitable and that adequate
plant and labour are on hand to complete the work within the proposed time period.

All costs associated with the provision of Track Possessions as well as any costs associated with the
withholding of approval or the provision of additional or backup plant or labour shall be borne by the
Contractor.

13.2.7 Cost of Delays to Trains

Where the operations of Queensland Rail trains are delayed by more than five minutes as the result of
any breach, act or omission of the Contractor or its employees, agents or subcontractors, the cost of
such delays shall be recoverable by Queensland Rail from the Contractor.

The cost of delay shall be calculated for the train standing at the point of obstruction and trains
delayed further along the line in either direction. The maximum number of trains to be taken into
account in determining the cost of any delay will be four. The cost of delay per train per hour or part
thereof shall be the amount notified from time to time by Queensland Rail.

These costs will be subject to review and amendment by Queensland Rail, in conjunction with any
revision of freight charges or fares generally.

If alternative transport arrangements are necessary for passengers or freight due to the delay, the full
cost of providing the alternative transport will be recoverable by Queensland Rail from the Contractor.

13.2.8 Stopping Work

If the Contractor is executing any work in a manner which in the opinion of the Protection Officer could
endanger Queensland Rail operations and / or property, the Protection Officer shall have the right to
instruct the Contractor to stop such work.

If such instructions are not carried out, the Protection Officer shall have power to stop immediately all
work which could endanger Queensland Rail operations and / or property until adequate safety
measures are implemented.

13.2.9 Removal of Contractor’s Employee

Should any employee of the Contractor disobey an instruction given by the Protection Officer, the
Protection Officer may request Principal's Representative to order the Contractor to remove that
employee from the Works.

13.2.10 Excavation Near a Railway Track

The Contractor shall give the Project Manager at least two weeks notice of any intention to excavate
adjacent to or under railway tracks. Excavations adjacent to or under railway tracks shall be carried
out by methods authorised by the Project Manager.

The Contractor shall be responsible for the safety of excavations within Queensland Rail property and
shall cover and / or protect any such excavations with barriers and lights as necessary. Excavations
on Queensland Rail property shall not be backfilled until the methods and material proposed have
been submitted to and approved by the Project Manager.

13.2.11 Blasting

The Contractor shall give the Project Manager at least two weeks notice of any intention to excavate
by blasting and shall furnish full details of the location thereof and the proposed methods as well as
the name and permit number of the licensed shot firer.

Such blasting shall be carried out only at locations authorised by the Project Manager and at times
authorised by the Site Protection Supervisor. A Protection Officer shall be in attendance.

Blasting will not be permitted near any structures, fixtures, foundations and the like, the stability or
integrity of which, in the opinion of the Project Manager or Site Protection Supervisor, may be
endangered by blasting. The Contractor shall provide screens, barriers, mats and the like to limit the
effects of blasting.

The Contractor will be held responsible for any loss, damage or injury sustained by the public or by
workers (whether employees of the Contractor, the Principal, Queensland Rail or any other authority)
and for any damage to property of any description whatsoever caused directly or indirectly by such
blasting.

13.3 Relocation or Alteration of Railway Services

The Contractor shall advise the Project Manager and the Superintendent, in writing, at least six weeks
before the date that any alterations to Queensland Rail services such as signalling,
telecommunications or power supply systems will be required.

The cost of any such work shall be borne by the Contractor.

13.4 Work on Rail Property

If the Site of any work under the Contract is on Queensland Rail property the Contractor shall advise
the Project Manager in writing at least two weeks before commencing the work of the Site Information.

The Contractor must not commence any work under the Contract on Queensland Rail property until
the extent and limits of all work areas on railway land have been authorised by the Project Manager.

The Contractor shall erect safety fences and any other necessary protective measures to ensure that
the Contractor's possession of such areas does not interfere with or endanger in any way whatsoever
members of the public, Queensland Rail agents or employees and Queensland Rail operations or
property.

The Contractor shall ensure that existing public access is maintained throughout the construction to a
standard at least equal to that existing prior to the start of the work under the Contract.

13.5 Demolition of Existing Structure

Demolition work shall not commence until full details of proposed demolition methods and of the types
of plant and equipment to be used have been submitted to and authorised by the Project Manager.

The demolition work shall be carried out in such a manner that no material falls on Queensland Rail
tracks or other Queensland Rail installations.

If there is a possibility of material falling on Queensland Rail tracks or other Queensland Rail
installations, the Contractor shall provide protection to such tracks and / or installations as approved
by the Site Protection Supervisor.

Demolition shall be carried out only at times authorised by the Project Manager, and a Protection
Officer shall be in attendance.

13.6 Removal and Re-erection of Fencing

If it is necessary to remove any fences along the railway boundary as part of the works under the
Contract, all such fences shall be replaced or repaired by the Contractor in the same order and
condition as they were at the commencement of the work under the Contract.

The Contractor shall keep the fence stockproof at all times when access is not required.

13.7 Removal of Buildings and Cleaning Up

Upon completion of work on Queensland Rail land, the Contractor shall remove all buildings, offices,
workshops, temporary structures, plant, materials, surplus earth, and rubbish and other construction
items and shall restore the site to its original condition.

13.8 Liabilities of Contractor

The cost of the Site Protection Supervisor, Protection Officers and any other Queensland Rail
employees necessary for the protection of Queensland Rail operations and / or property, or for the
isolation of overhead Line equipment, together with all other expenses incurred by Queensland Rail in
safeguarding its operations and property during the course of the Works, shall be borne by the
Contractor.

Queensland Rail will advise the Contractor of the estimated cost of the above requirements and the
Contractor shall provide an order to Queensland Rail for this amount at least two weeks before such
work is required. Actual costs, whether more or less, will be subsequently charged to the Contractor.

The Contractor shall be responsible for the cost of any damage to the rolling stock and other property
of Queensland Rail and for any injury or damage to any person or property caused by or arising from
the operations of the Contractor in carrying out the Works, or in any way howsoever associated with
the Works. In addition, the Contractor shall be responsible for the costs of any and all alternative
arrangements and / or additional expenses which Queensland Rail may find necessary arising out of
such damage by the Contractor in the carrying out of the Works, or in any way whatsoever associated
with the Works.

13.9 Indemnity

The Contractor shall indemnify Queensland Rail against:

a) loss of or damage to property of the Principal, including existing property in or upon which the
work under the Contract is being carried out, and

b) claims, losses, damages and expenses by any person against Queensland Rail in respect of
personal injury, death or loss of or damage to property.

arising out of or as a consequence of the performance or non-performance of the work under the
Contract, but the Contractor's liability to indemnify the Principal shall be reduced proportionally to the
extent that any act or omission of the Principal or its employees or agents may have contributed to
such loss, damage, injury or death.

Clause 13.9 shall not apply to:

i. the extent that the liability of the Contractor is limited by another provision of the Contract

ii. exclude any other right of the Principal to be indemnified by the Contractor, and

iii. claims in respect of the right of the Principal to construct the work under the Contract.

14 Work Adjacent to Overhead Line Equipment


14.1 General
14.1.1 Application of Clause 14

a) Clause 14 shall be read in conjunction with Clause 13

b) nothing in Clause 14 limits any of the Contractor’s obligations or liabilities under the rest of the
Contract,

c) if there is any inconsistency or discrepancy between the requirements of this Clause 14 and
any other requirements in the Contract, Clause 14 will prevail.

14.1.2 Clause 14 Enforceable by Queensland Rail

Clause 14.1.1 is separately and severally binding:

a) as between the Principal and the Contractor, and

b) as between Queensland Rail and the Contractor, and may be enforced against the Contractor
by the Principal or Queensland Rail or both.

The obligations and liabilities of the Principal and Queensland Rail under Clause 14.1 are several only
and not joint or joint and several.

With respect to sub-paragraph (b), Clause 14.1:

i. has been included in the Contract and agreed to by the Principal acting as agent for
Queensland Rail, and

ii. has been agreed to by the Contractor in consideration of Queensland Rail permitting the
Contractor to carry out any work adjacent to, under or over electrified railway tracks.

14.1.3 No Contract between Principal and Queensland Rail

Clause 14 does not impose any obligations as between the Principal and Queensland Rail, neither of
the parties:

a) is the agent of the other (except as provided in Clause 14.1.2(i)), and

b) warrants to the Contractor the due performance.

Further, the Project Manager, the Traction Power Engineer, the Electric Control Operator, the
Nominated Person, the Protection Officer and the Site Protection Supervisor are not:

i. employees, agents or consultants of the Principal, and

ii. are not authorised to give any directions or make any agreements that would alter or amend
the Contract or constitute a variation under Clauses 55 or 62 of the General Conditions.

14.2 Work Adjacent to Overhead Line Equipment

Overhead Line Equipment shall always be regarded as energised with 25,000 volts of electricity
unless an Isolation has been carried out and a Permit to Work has been issued.

If, in the opinion of a Protection Officer or the Site Protection Supervisor, any activity of the Contractor
is considered dangerous or contravenes any of the requirements of Clause 14, then the Protection
Officer or the Site Protection Supervisor shall have the authority to direct that such activity cease
immediately.

14.3 Definitions

Unless the context requires otherwise, in Clause 14:

Terms used in Clauses 14 are defined in Table 14.3 below unless the context requires otherwise.

Terms Definitions
Safety Clarification Advice The written advice of the Electrical Engineer given to the
Contractor stating the conditions under which the Contractor
may carry out specific work in the vicinity of the Overhead Line
Equipment without requiring an Isolation.

14.4 General Requirements

In the event of an emergency all enquiries and correspondence to Queensland Rail associated with
the work under the Contract are to be directed to the Project Manager, unless otherwise agreed.

The Contractor shall at all times be responsible for work performed near the Overhead Line
Equipment.

The Contractor shall ensure that:

a) its employees and any subcontractor are fully informed of the dangers of working adjacent to
the Overhead Line Equipment and comply with this Clause 14

b) nothing is fixed to, attached to or allowed to make contact with the Overhead Line Equipment
without first obtaining the approval in writing of the Project Manager

c) materials, plant, tools or equipment such as, but not limited to, electrical extension lead, metal
tape, metal-reinforced tape, rope and wire shall not under any circumstances be used in a
position where it may fall, be thrown or be blown into contact with the Overhead Line
Equipment, and

d) caution is used in the handling of water hoses, and water jets so that contact is not made with
the Overhead Line Equipment or the electrical equipment mounted under or on top of
stationary or passing electric trains.

The Contractor's employees must not attempt to remove objects such as string, rope, wire and the like
from the Overhead Line Equipment or from its immediate vicinity, nor approach such objects. The
Contractor's employees shall immediately report the matter to a Protection Officer or the Site
Protection Supervisor.

14.4.1 Isolation and Permit to Work

The Contractor shall ensure that:

a) if a vehicle, plant or equipment is to be used on or near to an Operating Track and is likely to


approach within 2.75 m of the Overhead Line Equipment, unless approved, that an Isolation
has been obtained and a Permit to Work issued

b) all employees, subcontractors, suppliers and other invitees of the Contractor are fully informed
of any electrical hazards and the limits of the work under the Contract to be performed during
an Isolation, and

c) care is taken to prevent contact with any part of the Overhead Line Equipment during an
isolation.

14.4.2 Contravention

If the Contractor contravenes 14, the Protection Officer or the Site Protection Supervisor are
authorised to direct the Contractor to take immediate steps to comply with Clause 14.

If the Protection Officer or the Site Protection Supervisor's directions are not carried out, the Protection
Officer or the Site Protection Supervisor may direct the Contractor to immediately stop all work under
the Contract being undertaken at the Site until compliance with the directions.

The Contractor acknowledges and agrees that it will not be entitled to claim for any cost, loss or
damage, or for any extension of time, as a result of any such direction.

14.5 Contractor’s Safety Liaison Representative

The Contractor’s Safety Liaison Representative and all assistant and relief representatives shall be
required to attend the appropriate training course nominated and conducted by Queensland Rail and
to produce a current safety training course completion card (called a Green Card) suitably endorsed
and issued by Queensland Rail.

14.6 Responsibilities

The Contractor’s Safety Liaison Representative shall have the following responsibilities:

a) safety of the Contractor's employees, plant and equipment during the execution of work over,
under or adjacent to the Overhead Line Equipment

b) coordination and programming of all of the Contractor's work which may require Isolations

c) receiving safety clarification advices from the Project Manager, and receiving and
relinquishing Permits to Work from and to the Nominated Person

d) receiving any other directions from the Project Manager, the Site Protection Supervisor or the
Protection Officers on matters relating to the Overhead Line Equipment, and

e) ensuring that all plant and equipment are operated and all employees of the Contractor act in
accordance with such directions.

14.7 Presence on Site

The Contractor shall ensure that:

a) the Contractor’s Safety Liaison Representative is present on Site at all times while work under
the Contract is being undertaken over, under or adjacent to Overhead Line Equipment

b) if the Contractor’s Safety Liaison Representative leaves the Site at any time during
performance of the work under the Contract, a competent relief representative will be
appointed to perform the functions of the Contractor’s Safety Liaison Representative

c) a replacement appointment will be notified to the Site Protection Supervisor prior to the
Contractor's Safety Liaison Officer leaving the Site, and

d) where the Contractor is carrying out work at more than one Work Site, the Contractor shall
appoint one or more assistant representatives with the same powers and functions as the
Contractor’s Safety Liaison Representative provided that the Contractor’s Safety Liaison
Representative retains final responsibility to ensure compliance with Clause 14.

14.8 Electrification Safety Basic Awareness Training

The Contractor shall ensure that:

a) all persons for whose safety it is responsible under Clause 30.2(b) of the Contract are
informed of the dangers of and procedures to be adopted while working over, under or
adjacent to the Overhead Line Equipment, and

b) all persons referred to in (a) above have, prior to commencing work on Site, attended a
“Electrification Safety Basic Awareness” training course conducted by Queensland Rail and
can produce a current safety training course completion card (called a Yellow Card) suitably
endorsed and issued by Queensland Rail.

The requirement to hold such Yellow Cards applies to visitors to the Site and to drivers delivering
materials or equipment to the Site unless otherwise authorised and under the conditions directed by
the Site Protection Supervisor.

Protection Officers are entitled to exclude from Site any person not holding or able to produce a
certificate of attendance at such "Electrification Safety Basic Awareness” training courses.

The Contractor acknowledges and agrees that it not be entitled to claim for any cost, loss or damage,
nor for any extension of time, as a result of any such exclusion from the Site.

14.9 Work Procedures

The Contractor shall ensure that no work under the Contract will be undertaken which requires
persons, material, tools, plant or equipment to approach or which has the potential to approach closer
than 2.75 m to the Overhead Line Equipment at a Work Site unless either:

a) an Isolation has been obtained and a Permit to Work issued by the Nominated Person to the
Contractor’s Safety Liaison Representative, or

b) the Project Manager has given the Contractor’s Safety Liaison Representative a Safety
Clarification Advice.

14.10 Approvals and Safety Clarification Advice

Any time the Contractor seeks to work within 2.75 m of the Overhead Line Equipment without the
need for an Isolation the Contractor must apply to the Project Manager for special approval in writing
no later than 14 days prior to the date the intended start date of the work.

If approval is given, it will be in the form of a Safety Clarification Advice issued by the Project Manager
to the Contractor's Safety Liaison Representative and will define the physical limits of the work, the
time and duration to which the approval relates, and any other conditions that the Project Manager
considers necessary.

The Project Manager may first require temporary works to be carried out, including but not limited to:

a) the placement or erection of ropes, temporary fences, warning tapes and / or warning notices
to define the limit beyond which no part of a person or any tools or equipment shall be allowed
to project towards the Overhead Line Equipment, and

b) the provision and erection of temporary screens approved by the Project Manager.

The cost of all temporary work shall be borne by the Contractor.

A Safety Clarification Advice shall be issued to the Contractor’s Safety Liaison Representative only in
response to an application by the Contractor and, where issued, shall apply only to the specific work
which is the subject of that particular application.

14.11 Limits of Isolation

Where, at the Work Site, there is more than one Operating Track which has Overhead Line
Equipment, an Isolation may not necessarily apply to all of the Operating Tracks concurrently,
including any connections of the Overhead Line Equipment between separate Operating Tracks.

The length of Electrical Section over which the Isolation applies at a Work Site may be different to the
length of Operating Track affected by any concurrent Track Closure. If a concurrent Track Closure has
not been arranged, then the Operating Track may still have non-electric trains or track mounted
equipment passing through the Work Site during the Isolation.

14.12 Duration of Isolation and Permit to Work Times

The duration of an Isolation includes the time necessary for work to be carried out by Queensland
Rail, including the times required to issue and cancel the Permit to Work.

The approved commencement time for any Isolation will considered to be approximate only and the
actual commencement times will depend on Queensland Rail's requirements at the time.

Notwithstanding any delay by Queensland Rail in commencing the Isolation or in issuing the Permit to
Work, the cancellation time for the Permit to Work shall not be varied unless approved by the Project
Manager.

Queensland Rail reserves the right at any time to cancel a Permit to Work in an emergency situation.

14.13 Notification of Program Requirements for Isolation

Before Queensland Rail gives consideration to arranging Isolations and issuing Permits to Work, the
Contractor shall notify the Project Manager of the Contractor’s requirements for Isolations and Track
Closures.

The minimum period for notification of the Contractor’s requirements for Isolations shall be six weeks
unless approved by the Project Manager or unless concurrent Track Closures are required, in which
case the minimum periods for notification prior to the proposed dates for such Track Closures shall be
as determined by the Project Manager.

Within 14 days of receipt of notification of the Contractor’s requirements for Isolations, the Project
Manager shall advise the Contractor whether or not the requested dates are acceptable to
Queensland Rail. If the Project Manager advises that any of the dates are not acceptable to
Queensland Rail, then the Contractor shall submit a revised Track Closures and Isolations program
specifying alternative dates subject at all times to the minimum notification requirements of Clause 14.

14.14 Formal Application for Permits to Work

Subject to the Contractor’s compliance with the program notification requirements of Clause 14.13, the
Contractor shall make formal written application to the Project Manager for the issue of a Permit to
Work, giving not less than 14 days notice prior to the date of the required Isolation.

The Contractor shall ensure each application for a Permit to Work shall state:

a) the name of the Contract

b) the date of the application

c) the date on which the Permit to Work is required

d) the name of the Contractor's Safety Liaison Representative and the place where the person
may be contacted at all times

e) the required time of commencement and time of cancellation of the Permit to Work

f) the line/s on which the Overhead Line Equipment is to be isolated and earthed

g) the structure numbers or location between which the work is to be carried out

h) whether it is intended that personnel or equipment touch the overhead wiring

i) the nature of work to be performed for which the Permit to Work is required, and the types of
plant and equipment to be used, including details on the closest distance between the
Overhead Line Equipment and the work to be performed, and

j) any other relevant information.

Where necessary, the Contractor shall also make or have made application for a Track Possession.
The Contractor acknowledges that, unless a Track Possession is in effect, non-electric trains or other
track-mounted equipment may still travel over the Operating Track.

The Contractor will be responsible for the accuracy of all information stated on the application for a
Permit to Work and for delivery of the application to the Project Manager.

If a Permit to Work is not granted, the Project Manager shall endeavour to give the Contractor at least
24 hours notice of such advice, except that Queensland Rail shall at all times reserve the right to
retract an approval or require the Contractor’s Safety Liaison Representative to surrender a Permit to
Work.

14.15 Issue of Permit to Work

Following isolation and earthing of the Overhead Line Equipment, a Permit to Work shall be issued by
the Nominated Person to the Contractor’s Safety Liaison Representative. The Permit to Work will
state:

a) the person to whom the Permit to Work is issued

b) the date and the time for commencement and required time for surrender of the Permit to
Work

c) the Operating Track and the Overhead Line Equipment affected by the Isolation, and

d) the working limits within which the Overhead Line Equipment has been Isolated and to which
the Permit to Work applies.

The issue of the Permit to Work will be accompanied by verbal explanations from the Nominated
Person concerning the working limits, the locations of local earths and the locations of any adjacent
Overhead Line Equipment which have not been Isolated.

14.16 Receipt of Permit to Work and Commencement of Work

The Contractor shall ensure that:

a) the Contractor’s Safety Liaison Representative has endorsed the Permit to Work by signing in
the appropriate space on the Permit to Work

b) the Contractor’s Safety Liaison Representative has fully informed the Contractor's employees
and subcontractors, and any other personnel for whom the Contractor is responsible who are
likely to be at the Site during the Isolation about the working limits, the locations of local earths
and the locations of any adjacent Overhead Line Equipment which have not been Isolated,
and

c) the Contractor’s Safety Liaison Representative, or any relief representative as provided for
under Clause 14.7(b), retains personal possession of the Permit to Work at all times during
the Isolation, and remains at the Work Site for the duration of the work, or for such other
period required by the Project Manager in an emergency situation, until such time as the
Permit to Work has been surrendered, and no preparatory or other work is carried out within
2.75 m of the Overhead Line Equipment until the requirements of Clause 14.16 have been
complied with, irrespective of the time for commencement of the Permit to Work nominated by
the Contractor on the application for that Permit to Work.

14.17 Relief of the Contractor’s Safety Liaison Representative

The Contractor shall ensure that:

a) if the Contractor’s Safety Liaison Representative leaves the Site for which a Permit to Work
has been issued, the Contractor’s Safety Liaison Representative is relieved by a competent
relief representative as provided for in Clause 14.7(b) and that such relief representative is
fully informed of the information and requirements contained in the Permit to Work

b) the Permit to Work is handed to, signed by and kept in the personal possession of the relief
representative who shall remain at the Site until such time as such relief representative is
further relieved or such other period as the Project Manager may require in an emergency
situation, and

c) the transfer of the Permit to Work to a relief representative is carried out in the presence of the
Nominated Person or, if the Nominated Person is not available, in the presence of the Project
Manager, the Site Protection Supervisor or a Protection Officer.

14.18 Surrender of Permit to Work

At the completion of the work for which the Permit to Work was issued but not later than the
cancellation time shown on the Permit to Work, or at any other time directed by the Project Manager in
an emergency situation, the Contractor shall ensure that:

a) all plant, equipment and materials are removed and all personnel have moved clear

b) of a distance of 2.75 m from the Overhead Line Equipment

c) the Contractor’s Safety Liaison Representative, or the relief representative in possession of


the Permit to Work, completes the “Clearance” statement on Part 3 of the Permit to Work and
surrenders the Permit to Work to the Nominated Person, and

d) under no circumstances shall the Contractor’s Safety Liaison Representative or the relief
representative, as the case may be, leave the Work Site without first surrendering the Permit
to Work to the Nominated Person.

14.19 Delays to Completion of Work within an Isolation

The Contractor shall be liable for all costs incurred by Queensland Rail for any delay in the re-energize
the Overhead Line Equipment caused by the non-return of the Permit to Work at or before the
cancellation time shown on the Permit to Work.

14.20 Costs of Queensland Rail

The Contractor shall pay all costs incurred by Queensland Rail in connection with Isolations.

The Contractor shall pay all costs incurred by Queensland Rail in connection with Safety Induction
Courses and / or Electrical Safety Basic Awareness Training.

The Contractor shall pay without deduction all moneys due and owing to Queensland Rail pursuant to
Clause 14 not later than 30 days from the date of Queensland Rail’s invoice.
