Schuette Files for Reinstatement of Charges Against

CMU Sexual Assault Suspect, New Court Date Set

LANSING – Michigan Attorney General Bill Schuette today filed a motion in Isabella County to
reinstate three felony charges against Ian Daryl Elliott, 24, of Cheboygan, Michigan. Elliot was
originally charged with two felony counts of sexual misconduct in the third degree and one felony
count of assault with attempt to penetrate against relating to an alleged 2016 assault that occurred
on September 1, 2016 in Mt. Pleasant, near the campus of Central Michigan University.
Elliott was previously charged by then Isabella County Prosecutor Risa Hunt-Scully on January 9,
2017. The case was then bound over to Circuit Court by Isabella County District Judge Eric R.
Janes, and scheduled for a jury trial on May 7, 2018. However, the case was dismissed by an
interim prosecutor on April 6, 2018. As the Chief Law Enforcement Officer of the State of Michigan,
Schuette reserves the right to intervene in any case statewide and is doing so in this case.
“Reinstating these charges is about justice for survivors of sexual assault and making sure that
those that hurt others know the consequences of their actions,” said Schuette.
A hearing date on the motion to set aside the dismissal, resume proceedings and set the case for
trial is set for November 16, 2018 at 1:45 pm in front of Isabella County Circuit Court Judge Mark H.
Duthie.

CASE BACKGROUND
Elliott was a 22-year-old student at Central Michigan University at the time of the alleged assault.
The assault was alleged to have occurred at an off-campus apartment in the City of Mt. Pleasant.
The victim, then a fellow CMU undergraduate student, underwent a sexual assault nurse
examination at McLaren Central Michigan Hospital and informed police that she believed she had
been assaulted.
A criminal charge is merely an accusation and defendants are presumed innocent until proven guilty.
