Section 208-23 of the Perinton Town Code prohibits animals, birds, fowl or poultry from
being housed or kept on a non-farm residential premises, except for customary household
pets.

For clarification, a farm premises is defined in the Perinton Tourn Code as, o' any parcel
of land five acres or more, used for agricultural activitics or farm operations, or land
defined in Seetion 301, Subdivision 4, of Article 255-AA of the New York State
,A.griculture and Markets Law as nnland used in agricultural produetion." It includes
neoessary agricultural struetures and the storage of equipment used."

Additionally, an animal is defincd by klerriam-Webster Dietionary as, "Any of a


kingdom (Animalia) of living things including many-celled organisms and often many of
the single-celled oncs (sueh as protozoans) that typically differ from plants in having
cells without cellulosc walls, in laeking chlorophyll and thc capacity for photosynthesis,
in requiring more complex food materials (such as proteins), in being organized to a
grea-ter degree of complexity, and in having the eapaeity for spontaneons movement anel
rapid motor responsos to stimulation."

Therefore, based on the aforementioned eode seetion and clarified by the two definitions
above, the bees assoeiated with "bce boxes" and manufactured beehivcs would constitute
a non-customary household pet and would only be permitted on a farm premises
consisting of five aeres or more.
