LuisGustavo MorenoRivera(hereinafterreferred toastheEtdefendanf')enterintothefollowing
agreem ent:

1. The defendant agrees to plead guilty to Count Four of the Superseding Indictm ent,

w hich countcharges the defendantw ith Conspiracy to Launder M oney, in violation ofTitle 18,

UnitedStatesCode,Section l956(h).
This Office agreesto seek dismissaloftherem aining countsofthe indictment, as to

thisdefendant,after sentencing.

3. The defendantisaw arethatthe sentence w illbe im posed by the Courtafterconsidering

the advisory Federal Sentencing Guidelines and Policy Statements (hereinafter %Gsentencing
Guidelines'). The defendantacknowledges and understands thatthe Courtwillcompute an
advisory sentence under the Sentencing G uidelines and that the applicable guidelines w ill be

detennined by the Courtrelying in parton the resultsofa pre-sentence investigation by the Court's

probation oftk e,which investigation willcomm ence afterthe guilty pleahasbeen entered. The

defendantisalso aw are that,tm dercertain circum stances, the Courtm ay departfrom the advisory

sentencing guidelinerange thatithascomputed,and m ay raise orlowerthatadvisory sentence

underthe Sentencing G uidelines. The defendantis furtheraw are and understandsthatthe Court

isrequired to considerthe advisory guideline range determined underthe Sentencing Guidelines,

butis notbound to im pose a sentence w ithin thatadvisory range;the Courtisperm itted to tailor

the ultimate sentence in lightofotherstatutory concerns, and such sentence m ay be either m ore

severe or less severe than the Sentencing Guidelines'advisory range. K now ing these facts,the

defendantunderstandsand acknowledgesthattheCourthasthe authority to impose any sentence

w ithin and up to the statutory m axim um authorized by 1aw forthe offenses identified in paragraph

1andthatthedefendantm ay notwithdraw thepleasolely asaresultofthe sentenceim posed.

4. The defendantalso understands and acknowledgesthatthe Courtm ay impose, as to

CountFour,a statutory m axim um term ofim pdsonm entofup to 20 years, follow ed by a term of

supervised release ofup to 3 years. ln addition to a term ofim prisonm entand supervised release,

the Courtmay impose a fine ofup to $500,000 ortwicethevalue oftheproperty involved in the
offense and m ay order forfeiture and restitution.Furtherm ore, the Courtm ay also im pose a civil

penalty in the greaterofthe value ofthe property,funds, orm onetary instrum ents involved in the

offenseor$10,000.
5. Thedefendantfurtherunderstandsand acknowledgesthat, in addition to any sentence

imposed underparagraph 4 ofthisagreement,a specialassessm entin theam ountof$100willbe


imposed on the defendant. The defendantagrees thatany specialassessm entimposed shallbe

paid atthetim e ofsentencing. Ifthe defendantisfinancially unableto pay the specialassessm ent,

the defendantagreesto presentevidence to this O ftk e and the Courtatthe tim e ofsentencing as

to the reasonsforthedefendant'sfailureto pay.

ThisOffice reservesthe rightto inform the Courtand theprobation officeofal1facts

pertinent to the sentencing process,including a11relevant inform ation concerning the offenses

com mitted,whether charged or not,as well as concerning the defendant and the defendant's

background. Subjectonlytotheexpresstermsofanyagreed-upon sentencingrecommendations


contained in this agreem ent,thisO ffice furtherreservesthe rightto m ake any recom m endation as

to the quality and quantity ofpunishm ent.

This Office agrees thatitw illrecom m end atsentencing thatthe Courtreduce by two

levelsthe sentencing guideline levelapplicable to the defendant's offense, pursuantto Section

3E1.1(a)ofthe Sentencing Guidelines,based upon the defendant'srecognition and affirmative


and tim ely acceptance of personalresponsibility.If at the tim e of sentencing the defendant's

offense levelis detennined to be 16 or greater,this Oftice will file a m otion requesting an

additionalone leveldecrease pursuantto Section 3E 1. 1(b)oftheSentencing Guidelines,stating

thatthe defendanthas assisted authoritiesin the investigation orprosecution ofthe defendant's

ow n m isconductby tim ely notifying authorities of the defendant's intention to enter a plea of

guilty, thereby perm itting the governm ent to avoid prepadng for trial and perm itting the

governm entand the Courtto allocate theirresourceseftk iently. ThisOftk e, how ever,w illnot

berequiredtomakethismotion ifthedefendant:(1)failsorrefusestomakea111,accurateand
completedisclosureto theprobation ofticeofthe circum stancessurrounding therelevantoffense

conduct;(2)isfoundtohavemisrepresentedfactstothegovermnentpriortoenteringintothisplea
agreement;or(3)commitsanymisconductafterenteringintothispleaagreement,includingbut
notlim ited to com m itting a state orfederaloffense, violating any term ofrelease,orm aking false

statem entsormisrepresentationsto any governm entalentity oroftk ial.

8. The defendantis aw are thatthe sentence has not yet been determ ined by the Court.

The defendantalso isaw are thatany estim ate oftheprobable sentencing range orsentence thatthe

defendantm ay receive,w hetherthatestim ate com esfrom the defendant's attorney,this Office,or

theprobation oftice,isaprediction,notapromise,andisnotbinding on thisOffice,theprobation

office orthe Court.The defendantunderstands furtherthatany recomm endation thatthisOffice

m akesto the Courtasto sentencing,whetherpursuantto thisagreem entorotherwise,isnotbinding

on the Courtand the Courtm ay disregard the recom m endation in its entirety. The defendant

understands and acknowledges, as previously acknowledged in paragraph 3 above, that the

defendant m ay not withdraw his/her plea based upon the Court's decision not to accept a

sentencing recomm endation m adeby the defendant,thisOffice,or a recomm endation made

jointlybythedefendantandthisOffice.
9. Thedefendantfurtheragreesto forfeitto theUnited Statesvoluntarilyand imm ediately

allproperty,realorpersonal,involved in the Conspiracy to LaunderM oney charged in CountFour

oftheSupersedingIndictment,andanypropertytraceableto suchproperty. Thepropertysubject


to forfeittlre includes,butisnotlimited to,the sum of$10,000 which isa sum equalin value to
the totalamountlaundered to,by,and/orforthe benefitofthe defendantaspartofthe charged

m oney laundering conspiracy. The defendantagreesto deliverto theUnited Stateson orbefore

sentencing a certitied check for $7,000,payable to the ''United States M arshals Service''. This

willbein fullsatisfaction ofhisportion ofthe$10,000.


10. The defendantagrees to consentto the entry oforders offorfeiture forsuch property.

The defendantadm its and agrees thatthe conductdescribed in the Indictm entand FactualProffer

providesa sufficientfactualand statutory basis for the forfeiture ofthe property soughtby the

Governm ent.

11. The defendantalso agreesto fully cooperate w ith the G ovem m entin allproceedings,

whetheradministrativeorjudicial,involvingtheforfeituretotheUnited Statesofa1lrights,title,
and interest,regardless oftheirnature or form ,in al1assets, including realand personalproperty,

cash and other monetary instnzments,wherever located, which the defendant or others to the

defendant's know ledge have accum ulated as a resultof illegalactivities. The defendant agrees

thatthe U nited States shall,at its discretion, beentitled to forfeitureofany property (substitute

assets)ofthe defendantto satisfy the moneyjudgment. The defendantfurtheragreesthatal1


elem ents of Title 21,U nited States C ode, Section 8531)havebeen satisfied. The defendant

further agrees to take a11 steps necessary to locate property that could be used to satisfy the

forfeituremoneyjudgmentandtopasstitletotheUnitedStatesbeforethedefendant'ssentencing.
To thatend,defendantagrees to fully assistthe Governmentin the recovery and return to the

United States ofany assets,or portions thereof, wherever located.The assistance shallinclude:

identitkationofanypropertysubjecttoforfeiture,agreem enttotheentryofanorderenjoiningthe
transferorencum brance ofsuch property,and the transferofsuch property to the U nited Statesby

delivery to thisOftk e,upon thisOftke'srequest, any necessary and appropriate docum entation,

including consentsto forfeiture and quitclaim deeds, to deliver good and m arketable title to such

property. The defendantfurtheragreesto liquidate assets, orcom plete any othertaskswhich w ill

resultin immediate paymentofthe forfeiture money judgmentin 111,orfullpaymentin the


shortestam ountoftim e,asrequested by the Governm ent.

The defendant know ingly and voluntarily waives all constitutional, legal and

equitable defenses to the forfeiture ofthe assets in any judicialoradministrativeproceeding,


including any claim ordefense underthe Eighth Am endmentto the United States Constitution;

waivesany applicabletimelimitstotheinitiation ofadministrativeorjudicialproceedings,and


w aives any rightto appealthe forfeiture.

13. Thisistheentireagreementandunderstandingbetween thisOfficeand thedefendant.

There are no otheragreem ents,prom ises,representations,orunderstandings.
