PRELIMINARY CONFERENCE ORDER

A Preliminary Conference was conducted by this Court to determine the issues

and secure admissions from the Parties. The Prosecution was represented
by Public Prosecutor Tristan Colosaga and Private Prosecutor Ian Marigmen and the
defendant by Atty. Philip Castillo and Atty. Betsy .
STIPULATION OF FACTS:
PROSECUTION:
The following proposals were admitted by the accused through counsel, to wit:
1. The identity of the accused, Casimir Orolaza;
2. That on or about September 07, 2018, the accused was driving a Black Euro
motorcycle with Plate No. AA-237 along the highway of Barangay Buntun,
Tuguegarao City, Cagayan;
3. The fact of the existence of Death Certificate and its genuineness and due
execution;
4. That the incident was investigated by SPO1 Harley Umoso who responded to
the scene of the incident;
5. That the incident was reported to the police authorities by the witness Dane
Garcia; and
6. That SPO1 Zeneth Quilenderino arrested the Accused.
DEFENSE:
The following proposal was admitted by the prosecution, to wit:
1. That the accused went to Enrile Cagayan for his Uncles’ wake.
2. That Dra. Laiza Frogosa is an expert witness;
3. That the accused with Police Officers Harley Umoso and Zeneth Quilenderino
went to the hospital to save the victim.

1. Whether or not the Accused commited the crime charged; and
2. Whether or not the accused is under the influence of liquor at the time of the
commission of the crime;
TRIAL DATES
The parties agreed on the date of the trial, to wit: Septembe 28, Oct. 16, and
25, 2018.

Considering that the preliminary conference has been terminated, the paties
are directed to go over the Preliminary Conference Order so that if there be any
error, they may take steps to correct the same within ten(10) days from receipt of
this order;otherwise, they will be barred from doing so, and the parties shall be
bound by the Preliminary Conference Order.
Let the initial presentation of evidence for the prosecution be set on
September 28, 2018
