CHAPTERI
GENERAL PROVISIONS
SECTION l. Title. This Ordinance shall be known as the 2013 SENIOR CITIZENS
CODE of MARIKINA.
(b) To encourage their families and the communities they live with to reaffirm the
valued Filipino culture and tradition ofcaring for the elderly;
(d) To provide a comprehensive health care and rehabilitation system for disabled,
' ' lsnipensioner senior citizens to inspire and foster their will and capacity to attain
a more meaningful productive aging; and ,

(e) To seek the active participation and pa(nership of the private sectors, non-
govemmental organizations and other people's organizations in promoting the
welfare of the senior citizens.
SECTION 4. Purpose of this Code. Within Marikina City, this Code shall cover and
govem the implementation of Republic Act No. 7432, otherwise known as the "Senior
Citizens Act", as amended, Republic Act No. 9257, otherwise knoum as the "Expanded
Senior Citizens Act of 2003". and Republic Act No. 9994, otherwise known as the
"Expanded Senior Citizens Act of 2010" as well as the Implementing Rules and
Regulations covering the said Acts, as promulgated and adopted by the Department of
Social Welfare and Development (DSWD). Provisions of the Senior Citizens Acts, which
are concems of the of the national govemment, are incorporated in this Code for the
knowledge of concerned senior citizens of Marikina, as well as for the information of
those establishments that grant benefits and privileges to the elderly. All other provisions
thereof for as long as they are applicable for implementation in Marikina City shall be
enforced by this Code.
SECTION 5. DeJinition of Terms. For purposes of this Code, and as defined under
Implementing Rules and Regulations (lRR) that covers Republic Act 7432,9257, and
9994, the following terms are hereby defined as follows:

SECTION 6. Meaning of Abbreviations. For purposes of this Ordinance and for brevity,
the following abbreviations shall mean:

CHAPTER II
RIGHTS Of SENIOR CITIZENS
SECTION 7. Rights of the senior citizen. All senior citizens shall be entitled to the
rights herein set forth without distinction as to ethnic origin, sex, social status, religion,
political antecedents and other factors.
(a) Every senior citizen is endowed with the dignity and worth as a human being,
and has therefore, the right to be respected' especially by the young' and be
provided with love, care, understanding' and moral security;
(b) Every senior citizen has the right to a well-rounded development of his
personality to the end that he may become happy' useful and active member of
societY;
(c) Every senior citizen has the right to sufficient shelter, proper medical
attention, and all the basic physical requirements ofa health and vigorous life;

.o.ulity and rectitude for the enrichment and strengthening ofhis morale and
character;
(e) Every senior citizen has the right to full opportunities for safe and wholesome
recreation, and wholesome use of his leisure hoursl

influlnces, hazards and other conditions or circumstances prejudicial to his
physical, mental, emotional, social and moral preservation;

(a) Maintain an upright and virtuous life in accordance with the tenets of his/her
religious beliefs and the dictates ofclean conscience;
(b) Love and respect the members of his,/her family and share with them his/her
wisdom for the strengthening, unity and harmony of the family;
(c) Exert his,trer best effort and capability, gained potentials and suitable abilities in
serving his/her fellowmen and his/her communityl
(d) Respect his/her fellowmen, their customs and traditions, the duly constituted
authority, laws ofthe country, and the principles and institutions ofdemocracy;
(e) Involve himself/herself and participate actively and to the extent of his/her
capability in city govemment programs and projects, social affairs and civic
activities for the promotion of public welfare. bearing in mind that their past
knowledge and gained expertise will help greatly in making the good image of the
city, as well as, shaping the country's future;
CHAPTER IV
SECTION 10. Creation of the Ollice for Senior Citizen's Affairc (OSCA) of Marikina'
Section 7 of Republic Act No. 7432 provides for the establishment ofan office for senior
citizens affairs in all cities and municipalities, and pursuant with the said mandate, the
Office for Senior Citizens Affairs of Marikina was created by virtue of Ordinance No. 21,
Series of 1993.
SECTION 12. Functions of the oscA, The office for Senior citizens Affairs of
Marikina shall have the following functions and responsibilities:
(b) To draw up a list of available professional and/ or technical expertise and service
that can be offered or provided by the senior citizens of Marikina;
(c) To maintain and update regularly on a quarterly basis the record and list of senior
citizens of Marikina;
(d) To serve as a general information center lor all senior citizens of Marikina, as
well as serve as a liaison office to cater to the needs of the Marikina elderly;
(e) To monitor compliance of the provisions of the Senior Citizens Act and the
Expanded Senior Citizens Act, particularly on the grant of the special discounts
and privileges lo senior citizens:
(f) To report to the City Mayor all violations of the Senior Citizens Act and
Expanded Senior Citizens Act. with a copy of such report fumished to the
concemed Barangay OSCA;
(g) To assist senior citizens in filing complaints or charges before the Department of
Justice (DOJ), provincial or city courts the violation of any person' natural or
juridical, establishment, institution or agency refusing to comply with the benefits
and privileges granted under the Senior Citizens Act and Expanded Senior Citizen
Act of2003 and 2010;
(h) To assist and coordinate in all investigations regarding or relative to fraudulent
practices and abuses of the discounls and privileges committed by any ening
senior citizen;
(i) To establish linkages with accredited NGOs. people's organizations, other
govemment institutions, and the barangays in their respective areas;
0) To make representation in seeking financial grant, aid or resources from local,
foreign, or intemational organizations. NGOs' foundations. and other concemed
institutions in pursuit of programs and projects rebounding to the benefit and
welfare of the senior citizens or for the community;
(k) Formulate and prepare the intemal rules and procedures for application to the
intemal affairs of the OSCA;
(l) To perform such others functions and responsibilities as may be required by law
or duly constituted authorities.
SECTION 13. QuatiJications of lhe Head of the oscA, A qualified senior citizen shall
be appointed by the City Mayor to head the OSCA who must possess the following
qualifications:
(a) The senior citizen must be a natural-bom Filipino citizen and must have resided in
Marikina City for at least one ( I ) year;
(e) The senior citizen must be a bona fide and active member of the OSCA.
SECTION 14. Manner of selection and Appointment of the oSCA Head A general
assembly of the senior citizens of Marikina shall choose and recommend three
(3) senior
citizens for consideration ofthe City Councit of Marikina and subsequent endorsement to
the City Mayor who shall finally appoint the senior citizen to head the OSCA'
SECTION 15. Term of olfice of the oscA Head. The oSCA Head of Marikina shall
have a term ofthree (3) years without reappointment but without prejudice lo ai ,.

SECTION 16. Operation and Mointenonce of the OSCA. The necessary funding for the
operation and maintenance of the OSCA shall be appropriated and approved by the City
Government of Marikina. Appropriations therefor shall be based on the approved work
programs and projects and estimated operational expenditures which are to be submitted
by the OSCA.
SECTION 17. Supervision of and Assistance to OSCA. The office of the Mayor shall
exercise supervision over the OSCA relative to their plans, programs and projects, and
activities for the senior citizens of Marikina. The DSWD-Marikina and concemed city
government offrces or agencies shall assist the Head of the OSCA in the proper
implementation ofthe aforesaid plans, programs, projects, and activities.
CHAPTER V
SECTION 18. Creation of Barangay OSCA. Thete shall be created a Barangay OSCA
for each of the sixteen (16) barangays of Marikina. Each Barangay OSCA shall be
composed ofa Chairman, a Vice-Chairman, a Secretary' a Treasurer, an Auditor and four
(4) Board Members all of whom are to be elected by the senior citizens of the concemed
barangay. Period of their election will start every l " Saturday of July prior to the end of
each term of office.
SECTION 21. Term of Ouice of the Chairman of the B.arangay OSC,4. Assumption of
office of Barangay OSCA Officers shall be on every 2no Monday of August. upon their
taking of oath of office. Chairman of the Barangay OSCA shall have a term of three (3)
years without reelection. In case of demise or permanent disability of a Chairman, the
remaining and unexpired term shall be automatically assumed by the Vice-Chairman. If
the Vice-Chairman, due to a reasonable cause, is unable to assume the vacant post of
chairmanship, by operation law on succession, the next officer in line has to serve the
remaining and unexpired term of the Chairman. In this regard, the ranking provided in
Section l8 of this Ordinance shall be followed. The Vice-Chairman or any ofthe officers
(as the case may be) who will serve as Chairman may be reelected if he or she has not

served one-half (l/2) of the full term. The three-year term will only apply to the
succeeding set ofofficers who will be elected in their respective Barangays.
SECTION 22. Honorarium of the Chairman of Barangay OSCA. Each Chairman of the
Barangay OSCA shall be given a monthly honorarium ol Three Thousand Pesos
(Php3,000.00) chargeable against the funds of the Office for Senior Citizens Affairs
(OSCA). This provision shall apply to the next set of Chairmen of Barangay OSCA who
will be elected in their respective Barangays.
SECTION 23. Functions of the Barangay OSCA. The functions of the Barangay OSCA
will be the same as that of the OSCA of Marikina, for as long as they are applicable for
implementation in their respective barangays.
SECTION 24. Supervision of the Barangoy OSCA. The barangay OSCA shall be under
the administrative supervision of the OSCA of Marikina. The Barangay Captain of the
concemed barangay shall be vested with the power and authority in implementing to the
fullest the provisions of the Senior Citizens Act and the Expanded Senior Citizens Act
within the political jurisdiction of the barangay.
SECTION 25. Offrce/Staff for the Btrangay OSCA - Borangay Senior Citizen Center.
The concemed Barangay Government Llnit shall assign an office space in their respective
Barangay Halls for the use of Barangay OSCA. and provide all amenities necess.uy
therefor. Volunteer senior citizens from the barangay may serve as office staff of the
Barangay OSCA. The concemed Barangay Government Unit shall likewise provide and
designate a place within the barangay for the establishment of a Barangay Senior citizen
Center.
CHAPTER VI
SECTION 26. Creation of a Commiltee for Senior Citizens Affairc in the Sangguniang
Barangays. There shall be created a Committee for Seniors Citizens Affairs in all
Sangguniang Barangays of Marikina to be headed by a Chairman who will be chosen
from among the Barangay Kagawads of the Sanggunian concemed through a duly
approved resolution. The concemed Barangay Chairman shall serve as an adviser to the
created Committee.
CHAPTER VH
SENIOR CITIZENS COUNCIL

SECTION 28. Senior Citizens Council. Pursuant to Section 458 (a), sub-paragraph 5,
(xvii) ofthe Local Government Code of 1991, there shall be established a city council for
the elderly, and in consonance thereof, the Senior Citizens Council of Marikina is hereby
created, to be composed of:
(c) The President of the Federation of Senior Citizens of Marikina, the City Health
Officer, the Chief of the DSWD-Marikina, the City Legal Officer of Marikina, the
Community Relations Officer of Marikina' as Members.
SECTION 29. Functions of the Senior Citizens Council. The Senior Citizens Council
shall have the following functions:
(a) Declare and designate the date of assembly of senior citizens of Marikina for the
nomination of three (3) senior citizen candidates to head the OSCA of Marikina;
(b) In coordination with the committee for Senior citizens Affairs of the Barangay
and concemed city govemment agencies. declare and designate the date of
election for the election of the chairman. Vice-Chairman and officers of the
Barangay OSCA;
(c) Formulate policies and adopt measures mutually beneficial to the elderly, to the
city and the communitY;
(d) Provide incentives for non-govemmental agencies and entities;

projects for the benefit of the elderlyl

(0 monitor and evaluate the implementation of programs and projects
for the senior citizens;
(g) Perform such other functions, as may be provided by law or duly constituted
authorities.
SECTION 30. Councit secrclatiat. There is hereby constituted for the Senior Citizens a
Council Secretariat which shall be responsible for providing technical support,
documentation, preparation of reports and other assistance as may be required in the
discharge of its functions. The Senior Citizens Council may avail of the services of
physica'ily and mentally capable elderly, NGOs, educational or research institution for
this purpose.
CHAPTER VIII
Marikina may render voluntary services to the community, which shall consist, but not be
limited to the following:

SECTION )4. Discounts from Establishments. Every senior citizen of Marikina shall be
granted TWENTY PERCENT (20%) discount and exemption from the value-added tax
(vaD, if applicable, on the sale of the following goods and services offered to the
general public, regardless of the amount purchased from any establishment, irrespective
of classification, relative to the utilization of services for the exclusive use of senior
citizens:
(a) HOTELS and SIMILAR LODGING ESTABLISHMENTS - The discount shall
be for room accommodation and other amenities olfered by the establishment,
such as. but not timited to, hotel-based parlors, barbershops, restaurants, massage,
parlor, sauna bath, aromatherapy rooms' workout gyms, swimming pools,
iacuzzis, ktv bars, intemet facilities, food, drinks and other services offered. The
term "hotel" shall include beach and mountain resorts'
(b) RESTAURANTS - The discount shall be for the purchase of food, drinks, dessert
and other consumable items served by the establishments offered for the
consumption of the general public.
(c) RECREATION CENTERS - The discount shall be for the utilization of services
in the form of fees, charges and rental for sports facilities or equipment, including
golfcart rentals and green fees, or venues for ballroom dancing, yoga, badminton
iourts, bowling lanes, table or lawn tennis workout gyms, martial arts facilities
which shall include the facitities ofthe Marikina Sports Park'
Non-profit, stock golf and country clubs which are not open to the general public,
and are private ani for exclusive membership only as duly proven by their official
Securities and Exchange registration paper. are not mandated to give the 207o
senior citizens discount. However, should restaurants and food establishments
inside these country clubs be independent concessionaries and food sold are not-

consumable items under club membership dues, they must grant the 20%o senior
citizen discount.
For Dine-in services under items (a), (b) and paragraph 2 of item (c) of Section
34, the privilege must be personally availed of by the senior citizen as defined
herein, and no proxies or authorization in favor of another person who is not a
senior citizen will be honored.
(d) HOSPITAL, GOVERNMENT AND PRIVATE HEALTH FACILITIES, DRUG
STORES, PHARMACIES, MEDICAL AND OPTICAL CLINICS, AND
SIMILAR ESTABLISHMENTS DISPENSING MEDICINES AND MEDICAL
The City Govemment of Marikina shall provide fully subsidized medical and
dental services, diagnostic and laboratory fees for all senior citizens confined in
service wards of govemment facilities while 20Yo discount and VAT exemption
shall apply for all senior citizens confined in pay sections (both in and out patient)
of govemment health facilities.
Private health facilities and hospitals shall grant all senior citizens 20Vo discount
and VAT exemption on medical and dental services, and diagnostic and
laboratory fees, including professional fees of attending doctors.
The same discount and exemption shall also apply for the purchase of eyeglasses,
hearing aids, dentures, prosthetics, artificial bone replacements like steel and
which includes implants, plates, rods, and screws as well as walkers, crutches,
wheelchairs, canes, geriatric diapers and other essential medical supplies,
accessories and equipment for senior citizens.
SECTION 35. Special Discounl on Basic Necessities and Prime Commodities. Pursuant
to the guidelines issued by the DTI on the grant of special discount in special programs
for senior citizens, every senior citizen of Marikina. upon presentation of his/her Senior
Citizens card, shatl be entitled to a special discount of Five (5%) percent of the regular
price of the following basic necessities and prime commodities to be purchased from
supermarkets, grocery stores, convenient and mini-convenience stores and shops, and
bakeries only:
(a) Canned sardines, tuna
(b) Evaporated, condensed and powder filted milk
(c) Coffee
(d) Bread
(e) White and brown sugar
(f) Cooking oil
(g) Instant noodles
(h) Luncheon meat, meat loaf, corned beef
(i) Frozen/ refrigerated/ preserved/ ready-to-cook pork, beefand chicken
(i) Powdered, liquid, bar, laundry and detergent soap
Provided: That the total amount of purchase shall not exceed the amount of Six
Hundred Pesos (P600.00) per calendar week without cturyover of the unused
amount.
SECTION 38. Authorized Represenlalive, A senior citizen who can not personally make
the purchase of medicine and basic necessities and prime commodities may appoint a
representative to make the purchase for and in his / her behalf. The appointed

representative shall present the OSCA ID of the concemed senior citizen and an
authorization letter.
CHAPTERX

SECTION 40. Income Tax Exemption The senior citizen shall be entitled

exemption from the payment of the individual income tax, provided he/she
considered to be minimum wage earner in accordance with Republic Act No. 9504.
SECTION 41. Exemption from Training Fees The senior citizen shall be exempted
from training fees for socio-economic programs conducted by private and govemment
agencies, subject to the guidelines to be issued by the DTI. DOLE. DA' TESDA and
DOST.TRC.
SECTION 42. Free Medical and Dental Semices in Government Facilities- Medical
and dental services, diagnostic and laboratory tests requested by the physician such as
but not limited to X-rays, computerized tomography scans. and blood tests availed ofby
senior citizens, including professional fees of attending doctors in all govemment
hospitals, medical facilities, outpatient clinics, and home health care services, shall be
provided free of charge to senior citizens.
SECTION 43. Medicol and Dental Semices in Private Facilities. In accordance with
the rules and regulations to be issued by the DOH and in coordination with the Phil-
HEALTH, a senior citizen shall be granted twenty percent (20%) discount on medical
and dental services and diagnostic and laboratory fees, such as, but not limited to x-ray,
computerized tomography scans and blood tests including professional fees of attending
doctors in all private hospitals and medical facilities.
SECTION 45. Benefits and Privileges for Retirees. To the extent practicable and
feasible, a senior citizen shall be granted the continuance of the same benefits and
privileges given by the GSIS, the SSS and the PAG-IBIG. as the case may be and as are
enjoyed by those in active service. Retirement benefits of retirees from both the
government and the private sector shall be regularly reviewed to ensure their continuing
iesponsiveness and sustainability, and to the extent practicable and feasible, shall be
upgraded to be at par with the culrent scale enjoyed by those in active service. -

SECTION 47. Death Benejit Assistanca In case of demise of an elderly, his/her family
may avail of a burial assistance in the amount of Two Thousand Pesos (Php 2,000.00)
which shall be chargeable against the funds of the Office of Senior Citizens Affairs
(oscA).
CHAPTERXI
CHAPTER XII
SECTION 49. Employmenl. Senior citizens, who have the capacity and desire to work,
or to be re-employid, rhuu be provided with information and matching services to enable
them to be productive members of society. Terms ol employment shall conform to the
provisions oi the Labor Code, as amended, the Civil Services rules and regulations and
other laws.
Private entities that shatl employ senior citizens as employees upon effectivity of the
Expanded Senior Citizens Act. shall be entitled to an additional deduction from their
gross income, equivalent to fifteen percent (15%) of the total amount paid as salaries and
iug", to senioi citizens, subject to the provisions of the NIRC, as amended in the
Reienue Regulations to be issued by the BIR approved by the Department of Finance
(DOF). Provided, however, that such employment shall continue for a period of, at east,
si* 1Oj .onttrr. Provided, further, that the net annual income of the senior citizen does not
exceed the poverty level for that year as determined by the NEDA through the NSCB.
The DOLE, in coordination with other govemment agencies, such as, but not limited to,
the Technology and Livetihood Resources Center (TLRC) and the DTI, shall asses,
design and imllement training programs that will provide skills or livelihood support
for
senior citizens.
SECTION 50. Education. The DepEd, the TESDA and the cHED, in coordination with
NGOs and POs shall institute a program that will ensure access of senior citizens to
formal and non-formal education. and they are to: .

(a) Formulate and implement relevant and effective course designs and
educational programs;
(b) Conduct the necessary training for the implementation of the appropriate
curriculum for the purpose;
(c) Ensure the availability of the needed educational facilities and materials;
(d) In coordination with the OSCA and the CSWDO, shall conduct
assessment and profiling of senior citizens who wanted to study; and
(e) Conduct continuing research and development progftlm for the necessary
and relevant education of the senior citizens.
Section 51. Health. The DOH, in coordination with the City Govemment of Marikina,
NGOs and POs for senior citizens. shall institute a national health program and shall
provide an integrated health service for senior citizens. The health programs aims to
promote healthy and productive elderly population through:
The City Govemment shall train community-based health workers among senior
citizens and health personnel to specialize in geriatric care and health problems of
senior citizens. In coordination with and technical assistance provided by the DSWD,
NGOs and other concemed agencies, community-based health rehabilitation
programs shall be established.
SECTION 52. Social Semices. The DSWD-Marikina, in coordination with the OSCA of
Marikina, NGOs, concemed POs, and concemed offices and agencies of the City
Govemment, shall develop and implement programs on social services for senior
citizens, the component of which are:
(a) Self and social enhancement services to provide senior citizens opportunities for
socializing, organizing, creativeness and self-improvement;
(b) After care and follow-up services for senior citizens who are specially those who
have problems of reintegration with the family and community, free counseling
shall be provided to both the senior citizens and their families;
(c) Neighborhood support services wherein the community or family members shall
provide care-giving services to the frail' sick or bedridden senior citizens;
(d) Substitute family care in the form of residential care-group homes for the
abandoned, neglected, unattached or homeless senior citizens and those incapable
of self-care; and
(e) Inclusion of community-based settings as practicum for academic institutions and
in the curriculum ofcare-giving and technical vocational schools'
SECTION 53. Housing. The Senior citizens Act. as expanded and further amended,
provides that the national govemment shall inctude in its national shelter program the
special housing needs of senior citizens, such as establishment of housing units for the
elderly.
Tl.e fiLUnS is mandated to formulate housing designs suitable to the requirements and
needs of the senior citizens. In accordance with Executive Order No. 105,
promulgated
on May 16, 2002, the housing program shall include the establishment and/or donation of

group/foster homes for the neglected. abused and unattached or homeless senior citizens
and those incapable of self-care, including its management, maintenance and operation.
SECTION 54. Access to Public Transport. The DOTC in coordination with concemed
agencies is mandated by the Acts to develop programs to assist senior citizens in gaining
full access in the use of public transport and facilities. The minimum requirements and
standards to make transportation facilities and utilities for public use shall be developed
for accessibility and mobility of senior citizens, particularly those with disability,
pursuant to the Accessibility Law.
CHAPTER XIII
SECTION 5'l . Cily Government Responsibility, The Senior Citizens Act mandates that
the City Govemment of Marikina shall be responsible in ensuring that the provisions of
the Acts are implemented to its fullest extent. And through its local Chief Executive, to
require all establishments covered by the Acts to prominently display posters, stickers,
and other notices that will generate public awareness of the rights and privileges ofsenior
citizens.
SECTION 58. City Government Programs for lts Senior Citizens. The City Govemment
of Marikina has the following programs, projects and legislative measures for its senior
citizens.
(a) Enactment of Ordinance No. 21, Series of l99l creating the Office for Senior
Citizens of Marikina;

(b) Enactment of Ordinance No. 65, Series of 1993, as amended by Ord. No.81,
Series of 1993 declaring the third week of October every year as "Senior Citizens
Week";
(c) Enactment of Ordinance No. 67 Series of 1994 strictly implementing the granting
of 207o discount on fares of senior citizens;
(d) Enactment of Ordinance No.l & 4, Series of 1994 requiring all drug
storeVcompanies to designate special counters for senior citizens;
(e) Establishment of the Senior Citizens Center, known as the, "Senior Citizens
Healthy Life Style Center" (Ord.No.4l, Series of 1996 that caters to the medical
and health needs of senior citizens;
(f) Passage of Resolution No.204, Series of 1998 requesting all accredited food
establishments in Marikina to comply in giving discount to all senior citizens;
(g) Accreditation of the Marikina City Federation of senior Citizens, affiliated with
the national Federation of Senior Citizens Association of the Philippines (Ord.
No. 04O,Series of 2002);
(h) Establishment of a Training Center for Caregivers (Res. No. I 88, Series of 2002);
(i) "Dalaw Kay Tatang at Inang", an ambulatory health care program visitation
whereby city health personnel in ambulance make home visitation on the elderly
to provide them health care services:
O Free admission upon entry to the Marikina Sports Park for their physical
reconditioning.
CHAPTER XIV
The govemment shall recognize the vital role of NGOs in complementing the
govemment in the delivery of services to senior citizens. It shall likewise encourage
NGOs for senior citizens to develop innovative service models and pilot projects and to
assist in the duplication of successful examples of these models elsewhere in the country.
SECTION 61. Support for Non-Governmental organiTatiozs. NGos for senior citizens
may avail of the following from appropriate government agencies, subject to certain
conditions: //

SECTION 62. Dkcount for utilities. At least Fifty Percent (50%) discount for the
consumption of electricity, water, and telephones shall be granted to the senior citizens
center and residential care/group homes that are non-stock, non-profit domestic
corporation organized and operated exclusively for the purpose ol promoting the well-
being of abandoned, neglected, unattached, or homeless senior citizens. To avail of the
discounts, the' following are required;
(a) accredited Senior Citizens Center
Being utilized by the senior citizens as certified by the DSWD
Regional Oflice.

The Board may call on other city govemment agencies, NGOs and POs to serve as
resource persons as the need arises. They shall not have the right to vote.
SECTION 66. NGO Representation. The NGOs shall represented, preferably by a senior
citizen, but not limited to, women, urban poor and veterans who are accredited by DSWD
and have services primarily for senior citizens. The representative shall be selected
appointed by the Board and shall serve a period of three (3) years.
SECTION 67. Functions of the Board. The Local Inter-Agency Coordinating &
Monitoring Board shall have the following function:
(a) Formutate a domestic or local plan of action for senior citizens in coordination
concemed government agencies and other stakeholders.
(b) Develop effective monitoring and reporting system towards an efficient,
consistent uniform implementation ofthe plan
(c) Develop and institute effective and innovative and approaches and methods
with which address the issues and concems ofthe senior citizens;
(d) Coordinate the programs and projects of the concemed agencies by
immediately effectively address the issues and concems ofthe senior citizens.
(e) Coordinate and conduct of city-wide information, educational campaign and
the other advocacy activities on the Expanded Senior Citizens Act 0f2003.
(f) Monitor the conduct of education, training and other capability-building
program maximize the construction and participation of senior citizens.
(g) Coordinate the conduct and evaluate of plan of action, research, and
documentation of goods participates and disparities for policy and progmm
development.
(h) To actively establish local network for resource generation and technical
cooperation.
(i) Prepare yearly accomplishment report to the Office of the Mayor of Marikina

CHAPTER XVI
IMPLEMENTING MECHANISM AND ENFORCING AUTHORITIES
SECTION 70. Enforcing Authorities. All agencies of the City Govemment of Marikina
vested with police powers shall be responsible for the strict implementation and
enforcement of this Code, to include:
(a) The Barangay Captain and /or the Committee on Senior Citizens Affairs of the
barangay.
(b) The Marikina PNP and other law-enforcing agencies of the City Govemment.
CHAPTERXVII
APPLICATION Of PENALTIES
SECTION 71. Penalties lor Persons. Any person who violates any provision of the
Acts shall be imposed with the following penalties, as prescribed under the adopted
implementing Rules and Regulations covering the Senior Citizens Acts.
(a) For the first Violation, a fine of not less than Fifty Thousand Pesos
(P50,000.00) but not exceeding One Hundred Thousand Pesos (100,000.00)
and imprisonment for not less than two (2) years but not more than six (6)
years;
(b) For any subsequent violation, a fine ofnot less than One Hundred Thousand
Pesos (P100,000.00), but not exceeding Two Hundred Thousand Pesos -

(P200,000.00) and imprisonment for not less than fwo (2) years, but not more
than six (6) years.
(c) For abuse of the privileges granted under the Acts, a fine of not less than
Fifty Thousand Pesos (P50,000.00), but not more than One Hundred
Thousand Pesos (P100.000.00) and imprisonment of not less than six (6)
months.
(d) If the offender is an alien or a foreigner, he shall be deported immediately
after service of sentence without further deportation proceedings.
SECTION 73. Fines/penalties for Violation of the City Ordinances. The following
penalties shall be imposed for violations of city ordinances, as prescribed by Section 458,
(1), (iii) of the Local Govemment Code of'I991 which authorizes local govemment units
to approve ordinances imposing fines and penalties for violation of city ordinances:
(c) For Public Utility Tricycles Fines for the tricycle driver/
Not granting 20Yo fare operator/ owner
Discount to senior citizens 1't offense - Pl,000.00 fine
on both driver and owner
2nd offense - P5,000.00 and
Revocation of the Franchise

(d) For not posting 20% Fine for the tricycle owner P500.00
Discount sticker on tricycles
The CTMDO shall require all public utility tricycles operating in Marikina city to
permanently post a sticker inside the tricycle's sidecar which estates that senior citizens
are given 20% discount on tricycle fares. The CTMDO shall issue the sticker and may
charge a minimal fee therefore.
SECTION 74. Cily Fines/ Penaltics-Exclzsiuifl. Pursuant to the developed powers and
authority vested upon local govemment units by the Local Govemment Code of 1991, the
fines and penalties imposed by the City Govemment of Marikina for violation of City
Ordinances shall be separate and exclusive of the fines and penalties imposed by the
Senior Citizens Act, unless otherwise, declared by the judicial court or competent
authority.
CHAPTER XVIII
APPROPRIATION
SECTION 75- Appropriation. The DBM and DSWD issued Joint circular No. 2003-01
on April 28, 2003 regarding the Implementing Guidelines for Section 29 of the General
Appropriations Act for FY 2003, entitled, "Seuing Aside One Percent of Govemment
Agency Budget for ProgramVProjects related to Senior Citizens and the Disabled,"
wherein local government units are mandated to issued guidelines relative to the
implementation of Section 29 of the General Appropriations Act of 2003.
The Senior citizens Act mandates local chief executives of local government units to
immediately include in their annual appropriations the funding necessary to implement
programs and services required by the Acts and its IRR. Thus, except for the provisions
of the Senior Citizen Acts which requires the funding olthe Office of the President of the
Philippines and concemed national government agencies, funds necessary to implement
the provisions of this code shall de charged out of the funds of the City Govemment of
Marikina. Thereafter, any such amount as shall be needed for the regular implementation
of this code shall be included in the annual preparation of the local chief executive
budget.
SECTION 77. Budgetary Allocation for the conduct of Borangay OSCA Election.
Funding necessary for the conduct of the said election for this year shall be taken from
any available fund and shall thereafter be included annually in the budget of the
Community Relations Office (CRO).
SECTION 78. Implementing Authorily. The local chief executive shall be responsible
for the implementation ofthe programs, projects, activities and services that will address
the needs of the elderly and disabled persons of Marikina, as well as, the submission of
reports as required by the Joint Circular of the DBM and DSWD. The Office of the Local
/
Chief Executive shall likewise formulate the necessary lmplementing Rules and
Regulations (lRR) to ensure the strict implementation of this code.
CHAPTER XIX
FINAL PROVISIONS
SECTION 79. Repealing Clause. All city ordinances' executive orders and rules and
regulations, or part(s) thereof, that are contrary to or inconsistent with any provision of
this Code, are hereby repealed or modified accordingly. The provisions of Ordinance No'
67, Series of 1994 and Ordinance No. I 84, Series of 1994, as regard to fines and penalties
are herby amended.
SECTION 80. Separability C/czsa Should any part or provision of this Code shall be
held to unconstitutional and declared invalid, other parts or provisions hereof which are
not affected' thereby shatl continue to be full force and effect.
SECTION 81. Effectivity Clause. This code shall take effect upon its approval.
