The undersigned affiant, Detective Jeff W Long of BYUPD, upon an oath or written
affidavit subscribed under criminal penalty, declares:

That your affiant has reason to believe:

THAT

On the premises known as Brigham Young University Police


2120 JKB BYU Campus
Provo, Ut 84602, further described as Theft of rare books and photos from the
BYU Special Collection Department located in the Herold B. Lee Library;

On the person(s) described as: Defendant Kevin Schuwer, Date of Birth


09/16/1989;

On the vehicle(s) described as: N/A;

On the item(s) described as: Apple iPhone, serial number G6TW434ZJCL7


Apple iPad, serial number DLXVR5WRHND6;

In the City of Provo, County of Utah, State of Utah, there is now certain property or
evidence described as:

Apple iPhone, serial number G6TW434ZJCL7


Apple iPad, serial number DLXVR5WRHND6

and that said property or evidence:

Was unlawfully acquired or is unlawfully possessed;

has been used or is possessed for the purpose of being used to commit or
conceal the commission of an offense; or

is evidence of illegal conduct.

Affiant believes the property and evidence described above is evidence of the crime
or crimes of Theft
Forgery.

The facts to establish the grounds for issuance of a Search Warrant are:

I have been a police officer for 28 years in the State of Utah where I attended
the Utah Police Academy (POST) in 1989. I have worked for the Orem Police
Department for 20 years where I was a detective for seven years specializing in
sex crime investigations. I also worked as a patrol officer, patrol sergeant, and
DARE Officer. I currently work for Brigham Young University Police Department
where I am assigned as a detective. I have a bachelor’s degree in criminal justice
from Utah Valley University and I am a current student at BYU working on a
master’s degree. I have also maintained a minimum of 40 hours a year of training
in various law enforcement topics.

On 10/11/18 the defendant, Kevin Schuwer, entered the Herald B. Lee Library on
BYU campus and
requested to see photos in the Special Collections room of the library. While
looking at the photos, Schuwer removed an original photo of Porter Rockwell from
its protective sleeve and replaced it with a fake copy of the same picture. Schuwer
then sold the original photo to a collector in Utah County for $2,000. The collector
also said he purchased three rare LDS Church books from Schuwer. These books
contained markings showing they were BYU property. The collector contacted the
police and the items were recovered and verified by BYU Special Collections to
be BYU property.

I received a phone call from Officer Taylor Ditxel from Utah State University who
said their library was missing a rare photo of Orson F. Whitney that disappeared
after Kevin Schuwer visited their library. This picture was sold online to a collector
in California by Kevin Schuwer. The same collector reported he also purchased
a rare picture of Porter Rockwell for $11,500 from Kevin Schuwer. The Porter
Rockwell picture belongs to the Daughters of the Pioneers museum in Salt Lake
City, which was stolen out of a display frame and replaced with a fake.

On 10/30/18 I arrested Kevin Schuwer at his home in Orem and he was


transported to the police station at BYU where Schuwer was advised of his
Miranda rights. Schuwer said he understood his rights and he was willing to talk to
me. Schuwer admitted that he entered the BYU Special Collections room where he
traded and fake photo of Porter Rockwell for an original owned by BYU. Schuwer
said he then sold the photo for $2,000 to a collector Schuwer also admitted to
taking six rare books out of the BYU library that he intended to sell.

on 10/30/18 Kevin Schuwer voluntarily gave his iPhone and iPad to the BYU police
detectives and he
signed a consent form giving the police permission to search these items. During
an initial search it was discovered Schuwer’s iPhone contained 38,000 images and
many more on his iPad. The devices were closed and the consent was terminated
by detectives so a search warrant could be obtained to further the search.

Kevin Schuwer used his iPad and iPhone extensively and exclusively to
sell vintage items on the internet to collectors around the country. Some of
these sales have been stolen property and these devices contain photos and
communications of these transactions. Kevin Schuwer was also manufacturing
digital reproductions of photographs that he used to replace when stealing the
originals. It is believed Kevin Schuwer was using these devices to reproduce
copies of vintage photos. It’s my request to obtain a search warrant to further the
investigation to see if BYU and others are missing more original items sold by
Kevin Schuwer.
