The inclusion of this clip does follow the Fair Use Guidelines because it is being used to
teach others about short term memory loss. It is therefore re-purposing the material to a
new audience. Since the material is a short clip, it is still in fair use because it is just
enough to get the point across.

3- If Ravi decided to use a 20 second portion of the clip, rather than the entire 2 minute
scene, would this change your response to question b? Why or why not? (Be sure to
support your argument with one or more references.

If Ravi decides to use a longer clip than I do believe he would not be in fair use of the
copyrighted material. Although, Ravi is still using the clip for the purpose to teach others
about short term memory loss, he is using too much of the original material to do so. It
is considered fair use when it is a very short portion of the original material.

4- If the workshop is packaged by Ravi’s instructional design firm and sold to other
clients, would this affect his ability to use this clip in his materials? Why or why not? (Be

If Ravi includes the clip in his material that are sold, than yes he is out of fair use
guidelines because of the potential market that exists for that material. People may not
use copyrighted material to profit off of, it is automatically breaking copyright law.

5-Suggest an alternative to this clip.

Instead of using this clip, Ravi could create a video of people role playing a scenario
where short term memory loss is present. Ravi could use the scenario as an example to
describe short term memory loss further, he would be able to use it to get his point
across while not dealing with copyright issues.
