DEED OF SALE
KNOW ALL MEN BY THESE PRESENTS:

THIS DEED OF SALE, made and executed in , this


day of , 20 , by and between:

The NATIONAL HOUSING AUTHORITY, a corporation created and existing


under Presidential Decree 757 dated July 31, 1975, with principal office at NHA
Bldg., Quezon Memorial Circle, Diliman, Quezon City herein represented by
,
herein referred to as the VENDOR.

SERGIO Z. AGUIMAN , of legal age,


Filipino citizen, married to (single)
with residence and postal address at Barangay 19 , Gingoog City
, hereinafter referred to as the VENDEE;

WITNESSETH: That

WHEREAS, the VENDOR is the registered owner of a parcel land located at


Barangay 19 , Gingoog City City/Municipality of Misamis Oriental as evidenced by TCT
No. T-12034 of the land records of the Registry of Deeds for 10-036686
;

WHEREAS, on the day of , 20 , the VENDEE or


his/her predecessor-in-interest applied to purchase and the VENDOR agreed to sell a portion of
the abovestated parcel land identified as Lot 1 Block 1 Psd 10-036686 ,
with an area of 44 square meters, situated at Barangay 19 , Gingoog City City/Municipality
of Misamis Oriental ;

NOW, THEREFORE, for and in consideration of the foregoing premises, the VENDOR
has sold, transferred and conveyed, and by these presents, sells, transfers and conveys unto
the VENDEE, his/her assigns and successors-in-interest, the abovementioned lot particularly
described in the attached technical description marked as Annex “A” and made an integral part
of this contract, subject to the burdens, restictions and encumbrances as follows:

1. Except by hereditary succession, herein lot or any part thereof cannot be alienated,
transferred, or encumbered within ten (10) years from the date issuance of the Transfer
Certificate of Title (TCT) without the written consent and authority of the VENDOR.

2. The encumbered/restriction abovementioned shall be annoted on the Transfer


Certificated of Title to be issued in favor of the VENDEE and any violation thereof shall have
the same legal effect as the violation in the succeeding paragraph hereof. The annotated
encumbrance/restriction shall be cancelled after ten (10) years from the issuance of the Transfer
Certificate of Title (TCT).
3. The application to purchase the abovementioned property and other pertinent
documents filed by the VENDEE are herein incorporated as integral part of this Deed and any
material misrepresentation or falsehood stated therein shall be sufficient ground for the
automatic cancellation without judicial declaration of this Deed of Sale and / or his/her
successor-in-interest including the forfeiture of the purchase price paid for the lot subject hereof,
inclusive of all interests and penalties.

It is further agreed that the VENDEE shall pay all the expenses for the preparation,
execution, notarization and registration of the Deed of Sale and such documents as may be
necessary for the issuance of the corresponding Certificate of Title.

IN WITNESS WHEREOF, the parties have hereunto signed these presents on the date
