Garcia, Director Planning and Zoning Department PLEASE TAKE NOTICE THAT A FINAL DECISION HAS BEEN REACHED ON THE FOLLOWING MATTER: Title: Miami Worldcenter Phase | Citizen M located in Transect Zone T6-60A-0 (Urban Core Transect Zone) Address: 155 Northeast 10" Street, Downtown NET Intended Decision: OD Approval © Approval with conditions OD Denial FINDINGS AND CONDITIONS The subject proposal has been reviewed for Warrant Permit pursuant to Ordinance 13483, Appendix D, and a Waiver pursuant to Article 7, Section 7.1.2.5(a)(28) of 21 Code as adopted, the Zoning Ordinance of the City of Miami, Florida. * Warrant to allow for the construction of a 12-story hotel with 351 lodging units for the eastern portion of Block F - East, located within the Miami Worldcenter District + Waiver to allow for a reduction in the minimum lodging unit size of 200 sq. ft. by up to 10%. ZONING HISTORY On December 30th, 2016 the Planning Department approved Miami World Center, LLC. the, “Applicant,” request pursuant to Warrant No. 16-0074 attached hereto as Exhibit A entitled “Zoning History’ to allow for the construction of a mixed-use development containing 1,011 residential units, 338, 036 sq. ft. of commercial space, 86,034 sq. ft. of open space and two plazas as per the plans entitled “Miami Worldcenter” Fle No, 18-0059 ‘On September 28th, 2018 the Planning Department approved the Applicant's Special District Permit pursuant to permit No. SPD1/16-0074 attached hereto as Exhibit A entitled “Zoning History’ to allow a minor modification to a previous approved set of plans under Warrant No. 16-0074, to modify the western portion Block F - East. Specifically, to eliminate two levels of structured parking with 245 parking spaces and to modify the north, west and south facades. This request was not part of this Warrant; however the two sites are interconnected and share the loading docks as per plans on file to meet said requirements. (On September 19, 2018 the Applicant submitted a revised Warrant request under Warrant Application No. 2018-0059 to allow for the construction of a 12-story hotel with 351 lodging units for the eastern portion of Block F - East, which is the subject of this request. Pursuant to Section 3(a) of Appendix D of Miami 21 a Warrant is required for any new buildings within the Miami Worldcenter District. Under the previous Warrant No.18-0074, a hotel was not contemplated and thus is not subject to Section 3(c) entitled "Special District Permit Minor Modifications & Modifications to Approvals’. FINDINGS The project is found to be designed in accordance with Appendix D entitled “Miami Worldcenter’ and Section 7.1.2.5(a)(28) of the Miami 21 Zoning Ordinance. Pursuant to Section 7.1.3.4 of the above-cited Zoning Ordinance, the Planning and Zoning Department has made referrals to the following Departments and Boards: Office of Zoning Downtown NET Office, Neighborhood Enhancement Team Urban Design Division Art in Public Places Division Office of Historic Preservation Their comments and recommendations have been duly considered in this final decision. This application has been reviewed, pursuant to Section 7.1.2.4 (d) of the Zoning (Ordinance; the following findings have been made: * The Applicant seeks a Warrant and a Waiver approval to allow for the construction of Hotel pursuant to Ordinance 13483, Appendix D, Section 3(a) and Article 7, Section 7.1.2.(a)(28) of the Miami21 Code. + The proposed new hotel development consists of the following: a) 12 floors with an overall height of 142'-0"; b) 351 lodging units; c) Rooftop amenities including a pool, gym, sundeck, and hotel bar; and d) An overall building area of 130,326 sq. ft. * Waiver to decrease up to 10% in the minimum lodging unit size from 200 sq, ft. to 185 sq. ft Page 2/3 Citizen M at MWC File No. 18-0059 Based on the above findings and the considered advice of the officers and agencies consulted on this matter and pursuant to Section 7.1.1.2 of the Zoning Ordinance, the subject proposal is hereby approved with conditions subject to the plans submitted by the applicant and on file with the Planning and Zoning Department. CONDITIONS: 1. The site shall be developed in accordance with the plans entitled “CitizenM Miami Worldcenter Warrant Package” as prepared by Gensler consisting of 32 pages dated stamped approve by the Planning Department on November 30", 2018. 2. The exterior public Art at ground level and on the facades of the building shall be reviewed and approved by the Director of the Planning Department or designee upon a recommendation from the Art in Public Places Board. 3. The approval of this Special District Permit does not void any applicable conditions subject to the original approval under Warrant No. 16-0074. NOTICE The final decision of the Director may be appealed to the Planning, Zoning, and Appeals Board by any aggrieved party, within fifteen (15) days of the date of issuance by filing a written appeal and appropriate fee with the Office of Hearing Boards, located at 444 SW 2” Ave., 3rd Floor, Miami, FL 33130.
