PATHIRANAGE SRIYANI her heirs executors, Administrators and Assigns) of the ONE PART and BAMUNUVITA GAMAGE PRASHAD SAMANTHA (Holder Of National Identity Card No. 800154170v) of No.113/1, Mabulgoda, Pannipitiya in the said Republic of Sri Lanka (Hereinafier called and referred to as. the LESSEE which term or expression as herein used shall where the context so requires or admits mean and include the said BAMUNUVITA GAMAGE PRASHAD SAMANTHA his heirs Executors and Administrators) of the OTHER PART. WITNESSETH WHEREAS the Lessor is seized and possessed of or otherwise well and sufficiently entitled to the Annex bearing assessment No. 63A, D.$.Senanayake Mawatha, Colombo 08 in the second floor of the three storied building more fully described in the Schedule hereto under and by virtue of Deed of Transfer No. 4092 dated 29" March 2007 attested by H.R.K.Caldera Notary Public. AND WHEREAS THE Lessor has agreed to let and lease and the Lesee has agreed to take on lease the said premises more fully described in the schedule hereto for a Period of Two (02) Years commencing from the Twenty Fifth(2s") day of May 2017 and terminating on the Twenty Fourth (24) day of May 2019 subject to the following terms and condition and stipulation hereinafter contained: Q) @ © Oy (8) 0) (10) ay (12) The said premises is given on lease to the Lessee by the Lessor for a monthly rental of RUPEES FIFTEEN THOUSAND (Rs. 15,000/-) per month for Two Years commencing from 25" day of May 2017. Out of the monthly rental Rupees 15,000/- the Lessee shall pay Rupees 10,000/- to the lessor on or before 25" day of each and every consecutive months without default and the balance 5,000/- shall be deducted monthly from the refundable deposit mentioned in the Para 3. on the demised premises morefully described in the schedule hereto. The Lessee shall deposit with the Lessor a sum of Rupees Two Hundred Thousand (Rs.200,000/-) as a refundable deposit and shall be refunded by the Lessor to the Lessee at the expiry of these presents subject to deductions of the part of monthly rental Rs, 5,000/- per month and unpaid Electricity and water bills and-damages caused to the demised premises or to the fixtures and fittings thereon(After excepting the normal wear and tear)if any. To keep the demised premises in a good and tenantable condition and not carry ‘on or permit or suffer to be carried in demised premises or any part thereof. a offensive noxious or dangerous activities, whatsoever or any activity which is likely to cause nuisance to the tenants or occupiers or the neighboring premises. To keep the demised premises in good sanitary condition and state in conformity with the rules and regulations and bye-laws of the Local Authority relating a general sanitation of otherwise be liable for any fines and impositions that may be levied for the breach and non observance or nonperformance of the aforesaid and to keep the Lessor freed and indemnified from all fines and prosecutions which may be imposed or instituted in consequence of the breach of or non performance of any bye laws of the Local Authority. All electricity and, water charges for the demised premises shall be paid and settled by the Lessee. In the event of the failure on the part of the Lessee to settle the Electricity and Water charges for Two consecutive months and or on Lessee failure to abide by any of the conditions hereby covenanted the Lessor shall be at liberty to demand peaceful and vacant possession of the premises on a date within Three months from the date of notice which shall be sent to the Lessee by registered post. The Lessor keep the right to disconnect the water and Electricity connection and the supply of water if the lessee fails to pay the monthly charges for the Water and Electricity. ‘The Lessce shall not alienate the rights acquired under this agreement in by way or manner without the permission of the Lessor. Repair any damage caused by Lessee or Lesse’s agents, Servants, invitees or Licensces to the demised premises and in addition to that lessee shall do and execute all repairs other than structural. repairs. The Lessee shall attend to all minor repairs up to Rs, 3,000/- and the Lessor shail attend to all major repairs above Rupees 3,000/-. The Lessee shall not make any damages to the fixtures and fittings of the demised premises if any such damaged are caused, the Lessee shall at her own cost and expense repairs same t0 its original state or pay damages to same. The Lessee shall be entitled to use the said premises only for commercial purposes. (13) Permit the Lessor or Lessor’s authorize agent at any reasonable hours during the day time. after giving a prior notice to the Lessee to enter upon, view and examine the conditions of the demise premises. (14) Not assign , sub-lease, sub let or the part of the procession or give on commissions | any part of the same except with the prior written consent of the Lessor. (15) Not make any structural alterations to the premises and no structures be put up without written consent of the Lessor. (16) The refundable deposit Rupees 80,000/- in the hands of lessor at the expiration shall be refunded to lessee subject to deduction of unpaid electricity and water bills and damages caused to the demised premises or its fixtures and fittings if any. (17) If the Lessee desiring to vacate without giving prior notice to the Lessor ,in such event the Lessee shall pay three month lease rental in lieu of notice (18) Hand over the vacant possession of the premises on or before the 24" day of May 2019. (19) If the Lessee fails to hand over the peaceful and vacant possession of the said premises at the end of the One Year Lease period, in that event the Lessee shall pay to the Lessor a sum of Rupees Three Thousand (Rs.3,000/-) per euch day of excess occupation until the peaceful vacant possession is handed over to the Lessor as damages and not as penalty the Lessee violates any of the conditions the Lessor has the right to terminate this agreement forthwith. (20) All notices, letters in writing required to be given of sent in terms of this | agreement shall be deemed to have sufficiently given or sent, if sent under registered cover to the Lessor and Lessee at the addresses given in this Agreement and/or to the address of the demised premises to the Lessee. | (21) Allow the peaceful enjoyment of the property by the Lessee without disturbances by the Lessor of those holding under the Lessor, during the term hereby created is | terminated. (22) Pay all rates and taxes payable to the local authority without getting into default during the term hereby created is terminated, (23) Indemnity or made goods, any damage caused to the premises other than due to the negligence of the Lessee or Lessce’s agents. IN WITNESE WHERE OF the said Lessor and the Lessee do hereunto and to 1 two Others of the same tenor and date as these presents set their respective hands at Rajagiriya in this 20" day of June in the Year Two Thousand Seventeen(2017).
