AN ORDINANCE PRESCRIBING THE NEW FARE RATES FOR MOTORIZED

TRICYCLES OPERATING IN THE MUNICIPALITY OF TIGBAUAN, PROVINCE OF
ILOILO.

WHEREAS, pursuant to Section 447 Paragraph 3 (vi), Article 3, chapter 3, Title
2, Book III of R.A. 7160, otherwise known as the Local Government Code of 1991, the
LTFRB franchising functions, powers and responsibilities over tricycles-for-hire have
been devolved to the Local Government Units effective July 1,1992;

WHEREAS, by virtue of such devolution, the Sangguniang Bayan is empowered

to determine, fix, prescribe, or periodically adjust fares or rates for the service provided
in a zone after public hearing;

WHEREAS, due to the recent increase in the prices of gasoline, oil and spare
parts, the following tricycle owners and drivers associations in this municipality have
submitted to the Sangguniang Bayan their respective formal requests/petitions for fare
increase: Tigbauan Tricycle Owners And Drivers Association (TTODA), Poblacion-
Buyuan Tricycle Owners and Drivers Association (PBTODA), Samahan ng Tigbauan
Cordova Tricycle Operators and Drivers Association (STCTODA), Tigbauan Econobike
Drivers and Owners Association (TEDOA) and Samahan ng Tigbauan Tricycle Rotta
Barroc plying Namocon-Baguingin-Barroc and Atabayan (NBBA) Route;

WHEREAS, in view thereof, a public hearing was conducted (in compliance with
the requirement of the law) on ____________ at Tigbauan Covered Gym, Tigbauan,
Iloilo which was attended by Tricycle Operators, Drivers, Barangay Officials headed by
Punong Barangays and other interested parties;

NOW, THEREFORE, Be It Ordained by the Sangguniang Bayan of the

Municipality of Tigbauan, Province of Iloilo that:

SECTION 1. The following are the new fare rates for motorized tricycles
operating in the Municipality of Tigbauan, Province of Iloilo:

Note: Students/Senior Citizens/Disabled persons with valid I.D. can avail of the
20% discount on all regular rates for motorized tricycles operating in the
Municipality of Tigbauan.

Drivers and operators are advised to prepare enough coins and to remit correct fare
change to commuters.

SECTION 2 – CHARGES AND PENALTY

Each tricycle unit shall be required to secure the fare matrix from the Office of
the Municipal Treasurer after paying the amount of P50.00. Said approved fare matrix
shall be displayed in full view to the passengers.

A penalty of P200.00 shall be imposed to drivers who charge passengers but fail
to display the approved matrix.

SECTION 3 – Repealing Clause – Any prior ordinance in conflict or inconsistent

with this ordinance shall be deemed repealed or amended accordingly.

SECTION 4 – Separability Clause – In the event any part or portion of this

ordinance is declared to be illegal, unconstitutional or invalid, those parts or portions
thereof which are not affected thereby shall continue to be effective and enforceable.

SECTION 5. Effectively Clause – This ordinance shall take after compliance with
the required mandatory posting as provided for under Section 511 of R.A 7160, The
Local Government Code of 1991.
