DEED OF CONDITIONAL DONATION

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF CONDITIONAL DONATION, made and executed

by ERIN GABRIEL T. SANTOS, of legal age, single, and resident of Brgy.
Taculing, City of Bacolod, Negros Occidental, Philippines, hereinafter
called the DONOR in favor of FRANK T. CASTLE, of legal age, Filipino,
single, and a resident of Brgy. Taculing, City of Bacolod, Negros
Occidental, Philippines, hereinafter called the DONEE,

WITNESSETH:

That the DONOR is the owner in fee simple of that certain

real property with the buildings and improvements thereon,
situated in Bacolod City, Negros Occidental, and more
particularly described in Transfer Certificate of Title No.
4331894, as follows, to wit:

“A parcel of land, lot no. 05, in the name of Erin

Gabriel Santos, situated in Riyal St., Brgy. Taculing,
Thass II Subd., City of Bacolod, Negros Occidental,
Island of Visayas. Bounded on the NE., points 2 to 5 by
Subdivision road (10.00 m. wide); on the SW., points 5
to 1 by Lo 4, of the Subdivision Plan; and on the NW.,
points 1 to 2 by Lot 3, Block 4; containing an area of
FORTY THOUSAND SQUARE METERS (40,000 Sq.m.),
more or less.”

That for and in consideration of the love and affection

which the DONOR has for the DONEE, the said DONOR by
these presents transfer and conveys, by way of CONDITIONAL
DONATION, unto the said DONEE, his heirs and assigns, the
above-described real property with all the buildings and
improvements thereon, to become effective upon the death of
the DONOR, but in the event that the donee should die before
the donor, the present donation shall be deemed rescinded
and of no further force and effect.

That the DONOR is making his donation in favor of the

DONEE with the following conditions:

1. That meantime I am still living, these properties donated are

all yet at my disposal as well as the products therein derived,
and whatever properties or property left undisposed of me
during my lifetime will be the ones to be received by the donee
if any;

2. That in case of my illness, I have still the perfect right to

dispose said properties if necessary to finance all the expenses
to be incurred for my sustenance and medical treatment, and
whatever left, if any, of these properties will be the one to be
received by the donee.

That the DONEE does hereby accept this donation of the

above-described real property, and does hereby express his
gratitude for the kindness and liberty of the DONOR.

IN WITNESS WHEREOF, the DONOR and the DONEE have

hereunto signed this deed of donation, this 05th day of January,
2019, in the City of Bacolod, Philippines.
