I believe there is probable cause to charge the defendant with these charges because:
PC STATEMENT
On 11/06/18 detectives with the Utah County Major Crimes Task Force executed a search warrant at 8387
Hoover Street, Midvale, Utah. Rafael Marquez DOB
09/05/93 was encountered in the residence along with his 5 month old son. A total of 33 grams of a brown
substance consistent with heroin was located on the kitchen table. This substance was field tested by Sgt.
Patrick and field tested positive for heroin. .5 grams of a white substance consistent with cocaine was also
located on the kitchen table. The substance field tested positive for cocaine. Next to the cocaine was a baby
bottle filled with milk. A digital scale and packaging materials were located on the kitchen table next to the
narcotics. A blue bag in the bathroom closet contained a total of 44 grams of a green leafy substance which
field tested positive for marijuana. A bag located by the front door contained 14.7 grams of a white substance
which field tested positive for cocaine. A .22 cal handgun was found in a purse hanging near the front door. 9.6
grams of a wax substance consistent with DAB which field tested positive for THC was located in the living room.
8.9 more grams of marijuana was located in the living room. A total of $3,489 in cash was located throughout
the residence.

From my training and experience as a narcotics detective a total of 33 grams of heroin, 15.2 grams of cocaine,
and 60 grams of marijuana is much more than for
personal use. 33 grams is approximately 333 individual "hits" or doses with an estimated street value of around
$3,000. 15.2 grams of cocaine is approximately 152 individual "hits" or doses with an estimated street value of
$1500. 60 grams of marijuana was located throughout the house. A large marijuana joint would contain .50
grams of marijuana. 60 grams would be equivalent to about 120 joints. The digital scale and packaging
materials located along with the large quantity of cash is consistent with narcotic distribution.

Post Miranda Rafael admitted to "selling marijuana". Rafael Marquez was cooperative with the investigation and
stated that he wanted to assist detectives with identifying individuals who sell larger amounts of narcotics than
he sell. I was later contacted by Rafael's attorney who advised that his client changed his mind and did not
want to assist detectives. Charges for the case on 11/06/18 had not yet been filed.

During the month of December 2018 I learned that Rafael Marquez started selling heroin again. I began to
conduct another investigation into Rafael and enough probable cause was obtained for a search warrant at his
new residence located at 3867 West 8620 South, West Jordan, Utah. On 01/30/19 detectives executed the
search warrant at Rafael's residence. Rafael was encountered in the front of his house in a red Jeep Cherokee.
Rafael was detained with handcuffs and his person was searched. In Rafael's pocket I located 7 individual
packaged baggies containing a total of 7.6 grams of a brown substance and $1,363 in cash. A drug k9 did an
exterior sniff of the red Jeep Rafael was in. The k9 officer advised that due to the actions of his k9 there was
enough probable cause to search the vehicle. Inside the vehicle another plastic baggie containing 1 gram of a
brown substance was located. These brown substances all field tested positive for heroin by Detective B.
Johnson. A search of the residence revealed 6 grams of a green leafy substance which field tested positive for
marijuana and 14 THC edible candies.

From my training and experience as a narcotics detective I know that 7.6 grams of heroin is much more than for
personal use. 7.6 grams is approximately 76 individual "hits" or doses with an estimated street value of $760.
The heroin was individually packaged for sales. A large quantity of cash in both small and large denominations
was located in the same pocket as the heroin and consistent with narcotic distribution.

Rafael Marquez was arrested and transported to the Salt Lake County Jail. He has a criminal history with (2) prior
convictions for possession of a controlled substance with intent to distribute so his charges are enhanced.

Rafael was booked on the following charges for case 18MC01434 on 11/06/18: possession of heroin with intent
to distribute (F1), possession of cocaine with intent to distribute (F1), possession of marijuana with intent to
distribute (F2), possession of a firearm by a restricted person (F3), child endangerment (F3), and possession of
drug paraphernalia (MA)

Rafael was booked on the following charges for case 19MC00110 on 01/30/19: possession of heroin with intent
to distribute (F1), possession of marijuana (MA), and possession of drug paraphernalia (MB).
