SWORN AFFIDAVIT
I, ANTONIO B. BORJA, of legal age, Filipino and a resident of
Tibungco, Davao del Sur, Philippines, after having been duly sworn
according to law depose and say that:
1. I am one and the same person whose personal circumstance is
herein above described;
2. On the day of 25 March 1977, I was near the vicinity of our Purok
– situated in Saug, Asuncion, Davao del Norte – when a sudden public commotion
piqued my interest and I immediately rushed to the scene of the
commotion;
3. When I arrived at the scene, I personally saw BENJAMIN ROSADAS
MARCELINO (BENJAMIN), with both of his hands tied at his back,
being paraded before the public by numerous armed personnel of
the Philippine Police Constabulary (PC);
4. I personally heard one of the member of the PC ordering Benjamin
to run; out of fear, Benjamin heeded the order and when he
started running, two members of the PC open-fired at the running
Benjamin;
5. Thereafter, from my position, I could see Benjamin lying dead on
the ground; afterwards, I saw a member of the PC approaching the
dead body, then he drew a bladed weapon and sliced Benjamin’s
neck;
6. I am executing this affidavit in order to attest the truth of the
foregoing facts and provide support to the claims of the
beneficiary of BENJAMEN ROSADAS MARCELINO with the Office of the
Commission on Human Rights, and for whatever legal purpose/s this
may serve.

I, RUSTICO L. SAMBAYON, of legal age, Filipino and a resident of
Sonlon, Asuncion, Davao del Norte, Philippines, after having been duly
sworn according to law depose and say that:
1. I am one and the same person whose personal circumstance is
herein above described and former Purok Leader/Chainrman of our
Purok before;
2. On the day of 25 March 1977, I was at the vicinity of our Purok –
situated in Saug, Asuncion, Davao del Norte – and attending to, and/or aiding
with, the preparation for our Purok’s Anniversary;
3. Suddenly, members of the Philippine Police Constabulary (PC)
paraded the person of BENJAMIN ROSADAS MARCELINO (BENJAMIN) –
whose hands were then tied at his back – before the residents of our purok;
such parading caught the interest of observing public and many of
them rushed and flocked at the scene;
4. Subsequently, BENJAMIN was ordered to run by the armed PC;
moments later, he was shot dead at the back during his running
away;
5. Thereafter, from where I was standing, I saw Benjamin lying
lifeless on the ground; afterwards, I saw a member of the PC
approaching his dead body and sliced his throat using a bladed
weapon;
6. I am executing this affidavit in order to attest the truth of the
foregoing facts and provide support to the claims of the
beneficiary of BENJAMEN ROSADAS MARCELINO with the Office of the
Commission on Human Rights, and for whatever legal purpose/s this
may serve.

SWORN AFFIDAVIT WITH CORROBORRATION OF TWO DISINTERESTED PERSONS
I, BENELINDA MARCELINO ALLEN, of legal age, Filipino and a
resident of Sonlon, Asuncion, Davao del Norte, Philippines, after
having been duly sworn according to law depose and say that:
1. I am one and the same person whose personal circumstance is
herein above described and the daughter of BENJAMIN ROSADAS
MARCELINO (BENJAMIN) who was a Human Rights Victim during the
martial law regime;
2. Pursuant to R.A. No. 10368 (Human Rights Victims Reparation and Recognition Act
of 2013), I have a pending claim for reparation and recognition
before the HUMAN RIGHTS VICTIMS’ CLAIMS BOARD on the ground that
my aforecited father was a victim of human rights violation;
3. On the day of 25 March 1977, I personally witnessed my father
Benjamin being forcibly taken out of our house by members of the
Philippine Police Constabulary; thereafter, they gunned my father
to death in the open view of the public, and such killing was
personally witnessed by our neighbor RUSTICO L. SAMBAYON and
ANTONIO B. BORJA;
4. I am executing this affidavit in order to attest the truth of the
foregoing facts and provide support with our pending claim for
reparation with the Office of the Commission on Human Rights, and
for whatever legal purpose/s this may serve.
