PLEASE TAKE NOTICE that the New Jersey Election Law Enforcement Commission
(Commission) considered at its meeting of January 15, 2019, the Complaint against Christopher
Campos (Respondent Candidate) and Marilyn Monrroy (Respondent Treasurer) for late reporting
and failure to report contributions and expenditures, failure to file 48-hour notices, and receipt of
excessive contributions for the 2007 municipal and runoff elections, issued on December 28,
2011, pursuant to N.J.S.A. 19:44A-1, et seq., which Complaint is hereby incorporated by
reference in this Final Decision. The Commission considered each Respondent’s Affidavit and
Waiver of Hearing submitted in response to the Complaint, and by a vote of 3-0, adopted as its
Final Decision the Proposed Findings of Fact and Proposed Conclusions of Law as set forth in
the Complaint, and as modified below.

The Commission finds on Count Four that Respondents filed a Report of Contributions
and Expenditures (Form R-1) as an amended 11-day report for the municipal election on August
4, 2015, reporting three contributions, totaling $4,100.00 (3,021 days late).

The Commission finds on Count Five that Respondents’ amended municipal 11-day
report, filed August 4, 2015, reported contributions of $300.00 or less, totaling $1,000.00 (3,021
days late).

The Commission finds on Count Eight that Respondents filed a Form R-1 as an amended
11-day report for the municipal election on August 4, 2015, reporting two $1,500.00
contributions, from individual members of a limited liability company (LLC), which do not
exceed the contribution limit. The Commission therefore dismisses Count Eight.
The Commission finds on Count Nine that Respondents filed amended runoff 11-day
reports on August 4, 2015 and September 11, 2015, reporting nine contributions, totaling
$8,500.00 (2,986 days late), and a $2,600.00 contribution from an individual LLC member
(3,024 days late), respectively.

The Commission finds on Count Nine that Respondents’ amended runoff 11-day report,
filed August 4, 2015, reported an additional $2,500.00 contribution (2,986 days late), but did not
report occupation information.

The Commission finds on Count Ten that Respondents’ amended runoff 11-day report,
filed August 4, 2015, reported an additional $1,000.00 of contributions of $300.00 or less and the
correct total amount of $2,750.00 (2,986 days late).

The Commission finds on Count Twelve that Respondents filed a Form R-1 as an
amended 20-day report for the runoff election on August 4, 2015, reporting a $1,000.00
contribution; employer name for a $2,600.00 contribution; occupation and employer information
for another $2,600.00 contribution; and contributor information for two contributions, totaling
$1,000.00, from individual LLC members (2,955 days late).

The Commission finds on Count Thirteen that Respondents’ amended runoff 20-day
report, filed August 4, 2015, reported an additional $400.00 of contributions of $300.00 or less
and the correct total amount of $900.00 (2,955 days late).

The Commission finds on Count Sixteen that Respondent was not the designated payee
for one of the $2,600.00 checks from Miguel Hector. The Commission therefore dismisses
Count Sixteen.

The Commission finds on Count Seventeen that Weehawken and You Action Committee
filed an amended 2007 second quarterly report, reporting two of the contributions ($2,500 and
$2,500) to Respondent Campos’ campaign for the 2007 municipal election and not for the 2007
runoff election. The Commission therefore dismisses Count Seventeen.

PENALTY

THEREFORE, pursuant to N.J.S.A. 19:44A-22 and N.J.A.C. 19:25-17.1 et seq., the


Commission hereby REPRIMANDS Respondents and imposes a joint penalty upon Respondents
on Counts 1 through 7 and 9 through 15, in the amount of $22,321.85, as follows:

a) For late reporting of 56 contributions totaling $73,000.00, the Commission imposes a


penalty of $7,300.00 (Counts 1, 4, 9 and 12); and

b) For late reporting of a $2,500.00 contribution and failure to report occupation


information, the Commission imposes a penalty of $525.00 (Count 9); and

c) For late reporting of contributions of $300.00 or less totaling $3,870.00, the


Commission imposes a penalty of $387.00 (Counts 2, 5, 10, and 13); and

d) For failure to file 48-hour notices for seven contributions totaling $12,650.00, the
Commission imposes a penalty of $6,325.00 (Counts 7 and 15); and

e) For late reporting of 443 expenditures totaling $62,960.92, the Commission imposes a
penalty of $6,296.09 (Counts 3, 6, 11, and 14); and

f) For failure to report purpose for a $300.00 expenditure, the Commission imposes a
penalty of $42.00 (Count 3); and

g) For late reporting of payee addresses for 206 expenditures totaling $36,168.94, the
Commission imposes a penalty of $1,446.76 (Count 11).

Payment of $22,321.85 is now due.
