Dear Ms. Lopez:
My Office has received your open records request dated October 30, 2018, seeking copies of all
ICE detainers placed on any inmate in the Oneida County Jail from January 1, 2014 to present or
a list of inmates with ICE detainers including name and date of birth from January 1, 2014 to
present. You also requested the aggregate number of ICE detainers in the jail for the same
period, broken down by year.
There is no record that exists of this information without extracting information from existing
records and compiling that information into a new format. ICE detainers are not specifically
identified when we book an inmate. The inmate type is identified as “Housed For Other
Agency”. In order to fill this request, our agency would be required to create a new record by
viewing each “Housed For Other Agency” booking within the specific time period, and
reviewing the comments within the booking. Pursuant to Wis. Stat. §19.35(1) (L), a custodian
need not create a new record in response to a request; therefore we are unable to process your
request.
I must inform you that you have appeal rights as described in 19.37, or upon application to the
