FAR EASTERN UNIVERSITY

OMNIBUS ELECTION CODE

ARTICLE 1. Declaration of Policy. It is hereby declared the policy of the Student


Development (SDev) to promote the welfare of the student body by giving those who actively
participate in student elections the opportunity to:

1. Learn the art and science of government;


2. Develop student leaders who exhibit the FEU core values of Fortitude,
Excellence, and Uprightness; and
3. Learn and appreciate love of God, country, and university.

ARTICLE 2. Elections Governed by this Code. The election of the following officers shall be
conducted in accordance with the provisions of this Code.

For the Far Eastern University Central Student Organization (FEUCSO):

1. President
2. Vice President
3. Secretary
4. Treasurer
5. Auditor
6. Press Relations Officer

For the Institute Councils:

1. President
2. Vice President
3. Secretary
4. Treasurer
5. Auditor
6. Press Relations Officer
7. FEUCSO Representative

For Institute of Law:

1. President
2. Vice President
3. Secretary
4. Treasurer
5. Auditor
6. Year level Representatives (I-IV)

1. President
2. Vice President
3. Secretary
4. Treasurer
5. Auditor
6. Press Relations Officer
7. Academic Organization Representative

ARTICLE 3. Powers of the SDev Director. The Student Development (SDev) Director shall
exercise overall powers over the election in the university. He may, at his discretion, delegate
such other powers not provided in this Code to the Commission on Elections (COMELEC).

ARTICLE 4. Appeal to the SDev Director. All decisions of the Commission on Elections shall
be appealable, in writing, to the SDev Director within a period of three (3) working days, unless
a different period is declared otherwise by the COMELEC. The decision of SDev shall be final
and executory.

ARTICLE 5. Supervision of Elections. The SDev Director shall appoint members of the
Commission on Elections (COMELEC/Commission) to supervise the orderly and honest conduct
of election, proclaim winners, and decide on election protests and other election-related
matters.

ARTICLE 6. Members and Tenure of Office. The SDEV Director shall nominate to the
VPAA faculty members/employees who will serve as Chair, Co-Chair, and Secretary-General
from the different institutes to compose the University COMELEC who shall hold office for a
term of one (1) year, without prejudice to possible renewal of appointment for the next student
elections.

Four (4) student representatives shall also be appointed as part of the University
COMELEC.

Sixteen (16) students from Junior Philippine Institute of Accountants (JPIA) will likewise
be appointed as part of the Institute Comelec. All student representatives shall also hold office
for a term of one (1) year, without prejudice to possible renewal of appointment for the next
student elections.

The members of the University and Institute COMELEC shall have the following
qualifications, namely:

For the faculty representatives:

a. Regular full-time or lecturer full-time status;


b. Served or serving as adviser of any accredited student or member/head
of any university or institute committees; and
c. No pending disciplinary case.

For the student representatives:

a. Leadership experience or active participation in student organizations;


b. Certification of good moral character issued by the Student Discipline; and
c. Commitment letter that he/she shall uphold and observe utmost
prudence, honesty, and non-partisanship in the upcoming student
election.

The SDEV Director shall nominate at least five (5) nominees to the COMELEC and the
COMELEC has the sole prerogative to choose from the nominees the four (4) student
representatives in the University COMELEC.

Student representatives of the Institute Comelec will be nominated by the JPIA from
among their members. For this purpose, JPIA should nominate at least twenty (20)
representatives for the Institute Comelec. The SDEV Director and University COMELEC will
choose among the nominees submitted by JPIA.

The student representatives, both in the University and Institute Comelec, shall not be
allowed to run, be nominated, be appointed or hold any other political and academic
organization position within the university, except in JPIA, while they sit as the student
representative. For this purpose, positions held outside the university is not covered by this
prohibition. Violation of this prohibition results in automatic forfeiture of his/her position and
disqualification to any leadership award in the university.

The COMELEC shall also appoint such other faculty members, employees, organizations,
and/or students during the casting of ballots as may be needed to help the Commission in the
performance of its duties, subject to the approval of SDev.

ARTICLE 7. Power to Decide Complaint/Protest. All complaints relative to the student


election shall be in writing addressed to the COMELEC Chair and filed to the SDev Director.
Election issues/protests in the Institute level should be forwarded to the University COMELEC.

All protests and/or complaints concerning the election of the members of FEUCSO, the
respective student councils and academic organizations shall be decided by the University
COMELEC.

The University COMELEC can decide on the complaint outright based on the documents
submitted by the parties without necessarily holding a hearing for the parties involved, unless
otherwise required by the University COMELEC.

Should the University COMELEC decide to conduct a hearing, the parties shall be heard
and the matter will be decided by the University COMELEC within three (3) days from the time
the corresponding complaint is filed, unless due to special circumstances, this period of time is
extended by the University COMELEC.

All cases decided by the University COMELEC shall be appealable to SDev within a period
of three (3) working days whose decision shall be final and executory.

This procedure shall likewise apply in the disqualification of candidates and in the
election protest.

ARTICLE 8. Other Powers of the Commission. For purposes of exercising the other powers
of the Commission, the following terms shall apply:

COMELEC EN BANC: constituted by all the members of the University COMELEC.

UNIVERSITY COMELEC: consists of Chair, Co-Chair, Secretary-General, and the four


(4) student representatives.

The University COMELEC shall be responsible for the supervision of faculty members,
employees, organization, and students who are designated by the SDev Director to perform the
duties relative to the proper conduct of the election.

The University COMELEC shall further be empowered to coordinate with the Information
Technology Services (ITS) for the preparation of the electronic voting forms, candidates’
application form, and other forms as may be needed in the student election.

The COMELEC en banc shall act on the certificates of candidacy only after verification of
the submitted documents.

The University COMELEC may exercise such other powers as maybe necessary and
convenient for the conduct of the election.

Should the rules of this Code be silent on an election-related issue elevated to the
COMELEC, the COMELEC en banc is empowered to decide through a majority vote of the
members present, provided, there is a quorum and the presence of at least four (4) members
of the University COMELEC, provided further, that there are at least two (2) student
representatives.

Members of the COMELEC are epitome of integrity, honesty, and uprightness and as
such, should exhibit utmost professionalism in the performance of their functions and should
not engage in partisan political activity.

ARTICLE 8-A. Accreditation of Political Parties. Accreditation of political parties is not a


matter of right but only a privilege which can be suspended, withdrawn, and/or revoked by the
COMELEC upon failure to comply with the terms of its accreditation and the provisions of this
Code. It is not also a requisite for a candidate to be under a political party to run for office.

SDev supports the democratic principle of multi-party system and is open to any political party
in the FEU student elections.

Application for accreditation of political parties should be filed to the SDev within the period
designated by the COMELEC. The COMELEC has the sole prerogative to grant the accreditation
to the political party.

Suspension and/or revocation of the accreditation resulting from the violations during the
election period will no longer affect the results of the election, without prejudice to the other
corresponding penalties imposable for the violations committed by the accredited political party.

QUALIFICATIONS AND DISQUALIFICATIONS OF CANDIDATES

ARTICLE 9. Qualifications of Candidates. All candidates of the Far Eastern University


Central Student Organization (FEUCSO), Institute Student Organizations, and the respective
Academic Organizations of all the Institutes must possess the following qualifications:

9.1. General Qualifications:

9.1.1. A bonafide student of the university;


9.1.2. Carry a minimum load of 62 percent (62%) of the units prescribed by their
respective curriculum when election is held as well as the semester previous to the election. If
elected, s/he must maintain the minimum load requirement with no failing grade during his/her
entire term of office;
9.1.3. Of good moral character as attested by the Student Discipline. No temporary
clearance shall be issued for this purpose;
9.1.4. Has passed all courses in the semester immediately preceding the elections in
FEU;
9.1.5. Has had leadership experience either as incumbent officer in FEU, previously
elected officer of any FEU-based organization, active committee member of FEU-based
organizations, high school leader, or active officer in organizations outside FEU.

9.2. Specific Qualifications: Each position has specific qualifications to ensure that the
candidates’ competencies are aligned with the functions of the positions they would like to be
elected in.

9.2.1. Residency: The President and Treasurer must have at least two (2) regular
consecutive semesters of residence in a specific FEU branch immediately prior to the election.
All other officers must at least be on their second semester during the application period.

9.2.2. Grade Requirement:

Candidates for President and Treasurer in FEUCSO, Institute Student Councils and
Academic Organizations should have a cumulative general weighted average (GWA) of at least
2.00 or cumulative grade point average (GPA) of at least 2.50. All other positions should have a
cumulative general weighted average (GWA) of at least 2.25 or a cumulative grade point
average (GPA) of at least 2.00

9.2.3. Leadership Experience: On top of the aforesaid grade requirements,


candidates should have had leadership experiences.

All candidates for President and Treasurer should have attended at least one (1)
seminar per semester under the CLIP-TASK organized by SDev.

9.2.3a. For FEUCSO and SCs, candidates for President and Treasurer should either
be:
9.2.3.1 incumbent officer for any position in FEUCSO, SC, or in any active
academic/university-wide organization under Student Development.
The list of active organizations will be provided by SDEV; or
9.2.3.2 previously elected officer occupying any other elected position from
any SC, academic, and university-wide organization under Student
Development.
9.2.3b. Candidates for FEUCSO’s and SC’s vice president, secretary, auditor, PRO,
and FEUCSO representative should at least comply with ANY of the following:

9.2.3.3. active committee member based on the submitted list of the


incumbent secretary and noted by the incumbent president and
adviser of any FEU-based organization;
9.2.3.4. elected high school leader as certified by high school administrators
or featured in official campus publications; or
9.2.3.5. active officer in academic-related and socio-civic organizations and
elected/appointed local government positions outside FEU, as
certified either by the secretary or the highest official of the
organization.

For Academic Organizations, only the candidates for President and Treasurer will be
covered by one of the leadership experience qualifications outlined in 9.2.3a. All other
positions will observe at least one of the qualifications mentioned in 9.2.3b. Grade and
residency period requirements still apply to all positions.

9.2.4. Additional Requirements: The following are the additional requirements to


help ensure that candidates have the sufficient time to balance their leadership service
and their studies:

9.2.4.1. President should at least be on his/her second year, second semester


(or an incoming third year) for a four-year degree program during the
filing of candidacy.
9.2.4.2. Treasurer should not be an incoming graduating/senior student and
should not be enrolled in his/her degree’s apprenticeship program in the
first and second semester during their term of office.
9.2.4.3. All candidates shall submit parent’s consent on their participation in the
elections;
9.2.4.4. And other relevant student development and leadership programs.

ARTICLE 9-A. Disqualification of Candidates. The following shall constitute the grounds
for the disqualification of candidates:

a. Failure to meet the requirements in the immediately preceding Article;

b. Submission of falsified documents as to their candidacy;

c. Conviction of the violation of the university policies;

d. Conviction of the violation of this Code;

e. Students who knowingly submit erroneous or false documents as to their


candidacy;

f. Commission of the election offenses as mentioned in this Code; and

g. Such other disqualifications mentioned in this Code.

ARTICLE 10. Requirements for Filing. Certificates of Candidacy (COC) of the FEUCSO,
Institute and academic organizations shall be filed in duplicate with the University COMELEC,
through the SDev, within the period specified in the election calendar.

Certificates of Candidacy (COC) shall be signed personally by the candidates. They shall
be supported by a statement under oath of all the subjects being taken by the candidate during
the semester.

The said certificate must be filed together with the following documents:
a. Printout of Certificate of Registration;
b. Printout of myCurriculum from eDerp;
c. Certificate of leadership experience from relevant organizations;
d. Certificates of Attendance in CLIP-TASK organized by SDev (for President and
Treasurer)

The following required documents will be requested and/or generated by SDev on behalf
of the candidates who filled out the online form on or before the set deadline:

1. Report of Ratings;
2. Certificate of Good Moral Character; and

Those who fail to accomplish the online form shall request the above-cited documents
on their own.

An incumbent officer of the FEUCSO, SC, and academic organization shall file a leave of
absence (LOA) the day after filing his COC. Failure to file the said LOA shall constitute a ground
for disqualification.

ARTICLE 10-A. GWA/GPA and Academic Requirements. In order to facilitate the


determination of grade requirements, the SDev, in coordination with the University Registrar,
shall submit to the COMELEC a certification of the cumulative GWA/GPA of students filing for
candidacy as well as the actual percentage of load of units of the student in the current as well
as the previous semesters prior to the election.

ARTICLE 10-B. Substitution of Candidates. After the deadline of the filing of the
certificate of candidacy, no substitution of candidates is allowed. The proposed substitute
should not be coming from the candidates who have already filed their certificates of candidacy
in another position.

Changing of political party affiliation is likewise not allowed during the election period.

ARTICLE 11. Announcement of Candidates. Announcement of qualified candidates will be


done within three (3) to five (5) working days after the deadline for filing of Certificate of
Candidacy.

ARTICLE 12. Petition for Disqualification of Candidates. No petition of disqualification
shall be entertained two (2) working days prior to announcement of qualified candidates.

Petition should be in writing with attachment of supporting documents.

QUALIFICATIONS OF VOTERS

ARTICLE 13. Who are Qualified to Vote. All students of the University who are duly
enrolled during the semester of the election are qualified to vote in the FEUCSO election.

Students of the respective Institutes who are duly enrolled during the semester of the
election are qualified to vote in their Institute organization election. On the other hand, only
students taking up the course and are duly enrolled during the semester of the election in their
respective disciplines are allowed to vote in the academic organization election.

IABF students enrolled in the BSBA curriculum can only vote for one academic
organization.

Proxy voting is not allowed. Such act is an offense against the FEU Students Code of
Conduct and shall also be a ground for disqualification.

CAMPAIGN, VOTING, CANVASSING AND PROCLAMATION OF WINNERS

ARTICLE 13-A. Election Period. Election period shall commence from the accreditation of
the political party/ies and shall end at the time of the proclamation of the winning candidates.

ARTICLE 14. Election Campaign and Rally. FEUCSO and Institute student candidates shall
be allowed a minimum of five (5) day room-to-room campaign at such days and hours as may
be designated by the Director of SDEV.

For academic organizations, the COMELEC shall designate the mechanics of the
campaign in accordance with the provisions of this Code.

Advisers of student organizations and faculty members are not allowed to interfere in
electioneering activities. Should a violation be found committed after the investigation
conducted for the purpose by the SDEV, the violation shall be communicated to the respective
Dean of the Institute where the faculty member belongs in.

Any form of campaigning on the days of casting of ballots by the candidates and
incumbent officers is strictly prohibited and shall also constitute a ground for disqualification.

ARTICLE 15. Election Campaign Materials and Procedures. The following shall guide all
candidates and supporters including current students and alumni during the campaign period of
the FEU elections.

A. Campaign Focus. All speeches and posters shall focus on the party’s platform,
especially the candidates’ or political party’s action plan for specific projects or issues they
would like to address. “How to do it” should be highlighted in the posters, and Facebook Page.

B. Campaign Materials/Strategies. Campaign materials are only limited to the


following:

I. Posters
a. All posters should have a maximum size of 13 x 17 inches.
b. Each poster should be approved and signed for posting by SDev Director or in his
absence, any of the University COMELEC officers.
c. Each political party should produce one poster for each of the following set of
candidates:
c.1 FEUCSO
c.2 Institute SC candidates
c.3 Academic Organization candidates
d. Total number of copies per poster should be equal to the following number of
bulletin boards:
d.1 FEUCSO – total number of bulletin boards in FEU (25)
d.2 Institute SCs – total number of bulletin boards under the Institute (8)
d.3 Academic organization – 1
e. Each poster should detail the platforms of the party.
f. Posters of both parties should only be mounted on the bulletin boards of student
councils and organizations. Each bulletin board should have 6 posters:
f.1 FEUCSO by Party A
f.2 FEUCSO by Party B
f.3 SC by Party A
f.4 SC by Party B
f.5 Acad Org by Party A
f.6 Acad Org by Party B

II. Social Media


a. Each political party shall have only one Facebook Page as central online
campaign platform, which should contain all the candidates in all leadership
positions (FEUCSO, Institute SCs, academic organizations).
b. The platforms of the party especially the general plan of action should be
included.
c. Sharing of online campaign materials and posting of comments in other
social media are allowed.

d. Mudslinging is strictly prohibited.
e. In case videos are uploaded via Youtube, the link or the actual video should
be embedded in the FB Page with the following strict guidelines:
a.1 Total running time per candidate is 3 minutes maximum (including
intro and extro).
b.2 Speech should focus on the party’s platform. No mudslinging from the
candidates or supporters is allowed. Any type of mudslinging—direct or
implied, spoken, written, communicated, or in jingle form—will be a ground
for disqualification.
c.3 Each political party may have one (1) video that will serve as a
campaign material for the party’s GPOA in student leadership/service.
Running time of the video is 5 minutes maximum.

III. Candidates’ ID & Lanyard


a. The maximum size of each candidate’s ID is 5.5 x 11 inches. Only the
candidate is authorized to have an ID. Supporters and teammates are not
allowed to wear the ID. The ID can be worn by the candidate while walking
on campus or during room-to-room campaigns.
b. Only the candidates may have a customized lanyard. No other student, not
even the campaign manager should wear any political party lanyard.

IV. Speeches in Room to Room Campaigns


a. The following time limits shall be strictly observed during the room-to-room
campaigns:
i. FEUCSO – 20 minutes for all candidates per party
ii. Institute SC candidates - maximum of 15 minutes per party
iii. Academic Organization – maximum of 15 minutes per party
b. The speeches should only tackle:
i. The candidate’s qualifications
ii. Concrete action plan to solve a particular issue or to support a project
iii. Separate guidelines on campaigning will be released by COMELEC
before the start of campaign period
c. Before any campaign is done in the class, the campaign manager should hand
the campaign slip issued by the COMELEC to the faculty who will evaluate the
speeches whether it contained mudslinging of another candidate and/or
political party.
d. After the maximum time, class mayor and the faculty are requested to ask the
candidates to take their bow and exit quietly.
e. Jingle, in any form, is prohibited.
f. After the miting de avance, no room-to-room campaign is allowed. However,
the use of social media and other forms of campaigning are still allowed.

V. Grand Election Debate
a. COMELEC will provide the mechanics.
b. Banners will only be allowed by the COMELEC on the day of the Grand Election
Debate. The respective political parties will be allowed also to recite their
respective chants. Other campaign sorties will be allowed provided the
approval of the COMELEC is sought prior to the Grand Debate.
c. Debate in the Institute level and in Academic Organization will also be allowed,
subject to the guidelines that will be issued by the COMELEC in partnership
with Institute or Department of the degree programs.

VI. Prohibited Campaign Materials/Strategies


a. No banners (inside or outside FEU) are allowed.
b. No lanyards and other election paraphernalia (e.g. jackets, shirt, etc.) or any
material associated to any political party shall be distributed to voters. Only
the candidates and 200 registered supporters per accredited political
party are authorized to wear lanyards provided by the party gratis. The list of
supporters shall be submitted to SDEV before the announcement of official
candidates.
c. No event (program, project, or concert) shall be used for campaigning directly
or implicitly during the campaign period such as:
i. The color of stage backdrop, design, shirts of working
committee should not be the same as the political party’s official color
ii. No mentioning of the party’s name is allowed by any performer
or host.
iii. Any candidate is not allowed to host or be an emcee of any
activity approved by the SDev during the campaign period.
d. Maligning in whatever form or style, whether direct or implicit, whether in
words, symbols, or pictures, is not allowed. Maligning refers to the act of
wilfully injuring the good name or reputation of another candidate and/or
party which tends to bring the other candidate and/or party in disrepute.
e. No selling of any campaign paraphernalia is allowed.

SDEV will assign the designated places where posters can be placed. No posters are
allowed to be placed in any classroom.

The proposed budget for expenditures for the election (must not exceed PhP60,000)
and should be submitted to SDEV before the Announcement of Candidates and approved by the
same.

The actual expenditures of the election, cash inflows (including donations) and outflows
should be submitted to SDEV within the period set by the same in the form of a Cash Flow
Statement.

Any violation of the requirements of this provision shall also constitute a ground for
disqualification of the candidates and/or the political party concerned.

ARTICLE 16. Schedule and Venue for Voting. The schedule of the FEUCSO, Institute
Council, and Academic Organization student election shall be determined by the SDev upon
consultation with the ITS and announced by the COMELEC.

The synchronization of the election shall be under the sole prerogative of SDev. Should
the election be synchronized, the COMELEC shall prescribe the guidelines thereto.

Voting precincts shall be assigned by the SDev.

ARTICLE 16-A. Committee of Election Assistant. A Committee of Election Assistant will


be created for the purpose of assisting the COMELEC on the days of casting of ballots.

For this purpose, a group of students or an existing non-political organization in FEU will
be appointed.

ARTICLE 17. Procedure of Voting.

In case of E-voting, the voters shall:

1. Proceed to their designated voting precincts.


2. Key in their student number and password and then vote.

Each voter is required to present his FEU ID before entering the election precinct. A
strict No ID, No Vote Policy shall be strictly observed. Students will be required to enter their
name and student name in the election logbook.

Each voter is required to wear their prescribed school attire, except those who have
their OJT (OJT schedule signed by their company or program head is required) and those who
have a PE class on that day.

In case the election in the academic organization should be conducted manually, then
the Institute COMELEC concerned shall prescribe the rules and regulations therein. Institute of
Law is allowed to hold its election manually, unless it adopts e-voting system.

In case the election of the academic organization be done manually, the Institute
COMELEC shall be the one to preside.

The student representatives shall not be allowed to preside in the election, unless
authorized by the COMELEC. In case of violation, the student representative as well as the
Institute COMELEC shall be reprimanded but the results of the election shall be valid.

In case of the synchronized election, the candidates are not allowed to stay on the
building floor where elections are being held. Candidates and incumbent officers and their
supporters are not allowed to wear their political color on the day of the election.

Students or candidates are not allowed to take pictures of their vote. Proxy or absentee
voting is not allowed.

ARTICLE 18. Canvassing of Votes. In case of E-voting, canvassing of votes is done


electronically with the assistance of the Information Technology Systems (ITS), except in the
Institute of Law (IL) where voting and canvassing of votes is done manually. In such case, the
Institute COMELEC shall take charge of counting the vote in a final canvass and shall then
prepare and submit election results to the Commission on Elections, until such time that the
Institute of Law will adopt the electronic system of voting.

Should the canvassing be conducted manually, it shall be under the supervision of the
Institute COMELEC.

Partial and Official results without identifying the corresponding candidates shall be
generated only once and projected to the university LED screens by the Chair of the University
COMELEC in the presence of the Co-Chair, Secretary General, one (1) ITS Staff and Student
Representatives during election day/s.

ARTICLE 19. Official Watchers of Candidates. During the synchronized elections, every
bonafide student political party shall be entitled to have one (1) watcher in the designated area
as approved by the University COMELEC during the Election Day. In the case of Institute of
Law, where voting is done manually, the watcher (one for each political party) shall have the
right to witness the final canvassing and inform himself of the proceedings and may file protest
for any irregularities which he believes may have been committed.

ARTICLE 20. Posting of Election Results. Election results shall be released immediately
after the proclamation of winners by the COMELEC.

ARTICLE 21. Proclamation and Tenure of Office. The elected officers shall be proclaimed
by the COMELEC and shall assume office during the incoming school year, for a term of one (1)
school year. Elected officers are required to file the result of their grades for the academic year

for which they were elected. Failure to file the said grades shall constitute a ground for
FORFEITURE of his/her office and/or other penalties as may be imposed by SDev.

In the event of disqualification of a candidate resulting in only one candidate running for
the position or should there only be one candidate for the position, the said candidate has to
get more votes than the votes for abstain.

In case of failure to attain the required number of votes, the COMELEC shall declare that
the position shall be open for appointment by duly authorized bodies in the following manner:
SDev for FEUCSO, Institute Dean for Institute SC; and Department Chair and Coordinator for
Academic Organizations.

Should any elected candidate of the FEUCSO, Institute Student Councils and/or academic
organization or any appointed officer by the SDev for the vacant positions fails to maintain the
minimum load requirement and/or incurs a failing grade in any subject during his term of office
or during the second semester at the time of filing his/her certificate of candidacy, it shall result
in the AUTOMATIC FORFEITURE OF HIS OFFICE without need of any vote for that matter
for his removal.

More importantly, should any elected candidate of the FEUCSO, Institute Student
Councils and/or academic organization or appointed officer of the SDev neglects his duties
during the term of his office, any elected officer or committee chair of the same organization
can file a case of neglect of duties against the said officer in the SDev office.

For this purpose, SDev will issue the rules and regulations relative to neglect of duties.
SDev will conduct the investigation and the findings of the SDev will be final and
executory.

Should the said officer resign during the said investigation conducted by the SDev, then,
the investigation will be terminated and the resignation of the said officer will be construed as a
verdict of neglect of duties.

Findings of the neglect of duties by the SDev will have the following effects, namely:
a. disqualify the said officer in any leadership award inside Far Eastern University;
b. disqualify the said officer in running in the next student elections; and
c. no certification for the position will be issued either by the organization concerned or
by SDev.

The vacant position resulting from either the failure to maintain the minimum load
requirement, the failing grade, resignation or neglect of duties shall be filled by the
appointment of the duly authorized bodies in the following manner: SDev for FEUCSO, Institute
Dean for Institute SC; and Department Chair and Coordinator for Academic Organizations.

Should the President be the one disqualified, then, the Vice-President elect shall be the
new President.

ARTICLE 22. Election Protest. Election protest shall be filed within forty eight (48) hours
from the time the proclamation of winners by the Commission. No election protest shall be
given due course after the lapse of this period.

ARTICLE 23. Assumption of Office Notwithstanding Protest. Any elected officer


proclaimed by the COMELEC shall assume office notwithstanding any pending protest against
his election without prejudice to the decision on said protest.

INTERVENTION IN ELECTIONS

ARTICLE 24. Who May Not Intervene. Except those mentioned in Article 6 of this Code,
no faculty member, employee, student, alumnus or security guard of the university or any
outsider shall in any manner intervene in the election or partake therein, except to preserve
peace and order, if absolutely necessary.

ELECTION OFFENSES AND PENALTIES

ARTICLE 25. General Provisions. The University COMELEC, after the requisite due process
shall determine and recommend to the SDev the appropriate penalty, taking into account the
following:
a. Nature and inherent gravity of the election-related offense;
b. Previous record of the student;
c. Character and position of the aggrieved person/party;
d. Established precedents; and
e. Pertinent applicable aggravating and mitigating circumstances.

ARTICLE 25-A. Classification of Offenses. The COMELEC shall be guided by the following
classification of election-related offenses:

A. MINOR OFFENSES
a. Spreading of rumors as to election related matters (rumor-mongering);
b. Wearing of lanyards and other election-related paraphernalia by non-candidates and
non-registered supporters;
c. Participation as host or emcee in any program/activity during the campaign period.

B. MAJOR OFFENSES
a. Unauthorized use of FEU Grandstand for election-related campaigns;
b. Unauthorized holding of any political sortie or campaign;
c. Vandalism;
d. Disrespect in any form to the officials of Comelec and Student Development;
e. Submission of falsified documents to Comelec;

f. Dishonesty in any form to Comelec;
g. Inciting to fight;
h. Grave threat;
i. Plagiarism;
j. Cheating in the election;
k. Maligning, insulting of the person, character, organization, institution using any form
of communication and media (i.e. social network sites, yahoo groups, facebook,
twitter, multiply, instagram, e-chats etc.);
l. Room to room campaigning without the approval of the SDev;
m. Acts of misrepresentation;
n. Submission of falsified documents as to their candidacy;
o. Students who knowingly submit erroneous or false documents as to their
candidacy;
p. Actual campaigning whether explicit or implicit during the day of the election itself;
q. Failure to submit the election campaign expenditures;
r. Exceeding the maximum budget for the election campaign;
s. Substituting for another voter;
t. Voting more than once in election;
u. Availing oneself of any scheme to discover a vote cast (e.g. taking pictures of the
voting screen, etc.);
v. Tampering with or unauthorized duplicating of the official ballot or results;
w. Interrupting an election or canvassing or in any way disturbing the same, or in any
other way hindering, delaying or causing postponement of the proceedings;
x. Falsifying any statement used in connection with the certificate of candidacy;
y. Campaigning inside and in the same floor of the election precinct;
z. Mudslinging of candidates;
aa. Failure to comply with election guidelines and resolutions; and
bb. Selling of election paraphernalia.

ARTICLE 26. Schedule of Penalties. These penalties are imposable to candidates,


supporters, voters, incumbent officers, campaign managers, and political party.

A. MINOR OFFENSES
First Offense: Written Warning
Second Offense: Written Warning and Counselling
Third Offense: Elevation as a major offense

B. MAJOR OFFENSES
First Offense: Written Reprimand
100 hours of Community Service

Referral to Guidance Office for counselling

Second Offense Disqualification from participation in the election


Referral to the Disciplinary Office
150 hours of Community Service
Suspension of the Political Party

Third Offense Perpetual Disqualification to hold any office


200 hours of Community Service
Perpetual Suspension of the Political Party

Should there be multiple violations or acts of recidivism, the COMELEC is empowered to


impose the penalties for the Second and Third Offenses.

Disqualification in any leadership award in FEU can be imposed as an additional penalty.

SCHEDULE AND POSTPONEMENT OF ELECTION

ARTICLE 27. Schedule of Election. The election calendar shall be prepared by COMELEC,
subject to the approval of SDev in coordination/consultation with the Institute Deans.

ARTICLE 28. Postponement of Election. If for any serious cause as may be determined by
the SDEV Director, the holding of election on the date previously scheduled becomes
impossible, the COMELEC shall with the approval of the Institute Deans and SDEV Director,
postpone the same to such time as may be convenient under the circumstances.

In the event of failure of election, the incumbent officers shall continue to hold office
until an election is held for the purpose.

ARTICLE 29. Premature Campaigning. No premature campaigning before the


accreditation and prior to the filing of the COC such as, but not limited to, giving or wearing of
pin buttons, T-shirts, leaflets, are allowed before the accreditation of political parties and after
the announcement of the official candidates but prior to the official campaign period. Such acts
shall constitute a ground for disqualification of political parties.

ARTICLE 30. Amendment Clause. Any amendment/s to this Election Code shall take effect
upon three fourth (3/4) votes of all Members of the COMELEC present provided there is a
quorum. The amendment shall take effect upon approval of the Director of SDEV.

ARTICLE 31. Repealing Clause. The provisions of the previous Election Code are hereby
repealed. All existing CBLs of all organizations inconsistent with this Code are hereby repealed.
All precedence as to the previous decisions of the previous COMELEC is likewise repealed and is
not applicable to future decisions of COMELEC.

ARTICLE 32. Effectivity Clause. This Election Code shall take effect upon the majority vote
of all members of the COMELEC and the approval of the Director of SDEV.
