Affidavit of the petitioner

I Duggesani Venkata Narasimha Reddy son of late Narasimha
Reddy aged about 52 years ,Hindu, business residing at door No 507-C
Silpa Sandhya apartment ,Maruthi Nagar ,Kadapa city do here by
solemnly declare and state as follows .
1. I am the petitioner/D.Hr herein and plaintiff in O.S NO
140/2017 .I know the facts of the case.
2. I filed O.S NO: 140/2017 in the Honourable court against the
respondent for recovery of R.s 13,21,800/- due on two
promissory Notes and that the Honourable court was pleased
to pass an decree on 14-11-2017 in my favour. I filled
I.A NO. 8 of 2017 under 38 rule 5 of C.P.C for attachment of
E.P schedule property before judgment .The Honorable court
was pleased to order on 1-5-2015 for attaching the E.P
schedule property by issuing attachment warrant to the filed
assistant for attaching EP Schedule property before judgment
.The field assistant attached the E.P schedule property on
14-05-2017 as per orders of the Honorable court as per the
procedure established in civil procedure code by beat of tom
tom at the schedule property.
3. The respondent /Dependent did Not file any appeal in the
appellant court against the attachment made on the E.P
schedule property ,and that the respondent did not file any
appeal against the decree and judgment of the Honourable
court made 14-11-2017
4. The respondent /defendant did not pay the E.P amount to me
up to Now even after my several demands. The defendant is
very intelligent and cunning person capable of protracting the
case without paying the E.P amount to me. I will Not realize
the E.P amount without selling the E.P schedule property of
 ::2::
the respondent. There is necessity to sell EP schedule property
for realization of my E.P amount from the respondent/J.Dr
The respondent has No bank balance and he has no cash in
hand and that respondent has no any other immobile
properties. There is no stay order from any court for staying
the the execution of O.S NO 140/20017 decree dated 14-11-
2017 .Hence this execution petition is maintainable under law
5. Therefore I pray that the Honorable court may the pleased to
order for sale the E.P schedule property for realization of my
E.P amount with costs and for paying that E.P amount to me
in the interest of justice.
