1. The petition is unjust and not maintainable either in law or
on facts.

2. The petitioner is put to strict proof on all the allegations

made in the affidavit which are not expressly admitted herein by this
respondent.

3. The petitioner filed this false petitioner for adding

S.Md.Fairoz as defendant No.24 in O.S No. 31/2011. The said Fairoz is
nothing to do with the suit schedule property. The mother of this
respondent named S.Md.Abdul Razak executed registered will on
05-07-2017 in favour of S.Md.Abdul Razak for the suit schedule
property and recently died by giving effect to that will. So S.Md.Fairoz
has no right or authority or interest over the suit schedule property by
virtue of the registered will dated 05-07-2017 executed in favour of
this respondent named S.Md.Abdul Razak.

4. There are no merits in this petition. This petition was filed

with malafide intention for abusing the process of the Honourable
court.

5. Therefore the respondent prays that the Honourable court

may be pleased to dismiss this petition in the interest of justice.

S.Md.Fairoz as defendant No.32 in this suit. The mother of this
respondent executed registered will in favour of this respondent on
05-07-2017 for the suit schedule property and died recently by giving
effect to the will. So this respondent alone is entitled for the suit
schedule property by virtue of registered will dated 05-07-2017.

4. There are no merits in this petition. This petition was filed

with malafide intention for abusing the process of the Honourable
court.

5. Therefore the respondent prays that the Honourable court

may be pleased to dismiss this petition in the interest of justice.
