Student-Trainee On the Job Training Agreement

STUDENT-TRAINEE ON THE JOB (OJT)


TRAINING AGREEMENT

I, ____________________________________, _____ years of age, Filipino, single/married, with


residence and postal address at ________________________________________, and a bona fide
student of ______________________________________________ (“School”).
In compliance with the curriculum of my course ________________________________, I have to
complete ________ hours of service delivery training/support office training (referred to as “OJT
hours”) as may be required by the School curriculum at SUTHERLAND GLOBAL SERVICES PHILIPPINES,
INC., (“SGSPI”) located at _________________________________________.
SGSPI has granted me the privilege of undergoing work immersion pursuant to the Training Plan hereto
attached as Annex 1, which work immersion includes performance of actual service delivery activities
or support office practice under the terms and conditions of this Student-Trainee On the Job Training
Agreement (“Agreement”):
1. I will be responsible for my actions during my training period.
2. SGSPI shall not be liable for any injury/illness/damages consequent to my actions during the
training period.
3. I will observe SGSPI’s rules, regulations and company policy such as but not limited to training
shifting schedules, training overtime requirement, information security (infosec),
confidentiality and non-disclosure, at all times.
4. I am aware that any violation of SGSPI rules, regulations, policies, and/or misdemeanor shall
result in disciplinary action depending on the gravity of such violation and/or misdemeanor,
including but not limited to my immediate removal from my training assignment.
5. I confirm that notwithstanding my receipt of the allowance if any and if entitled thereto, from
SGSPI, my being assigned and given a Trainee Number and access badge to the SGSPI premises,
my performance of assignments and tasks related to the primary business of SGSPI, the same
do not make me an employee of SGSPI.
6. In case of entitlement to allowance, I confirm that the same shall be computed in accordance
with Annex “2” hereof.
7. I will only be required to report in SGSPI for the duration of the training until the required
number of OJT hours is completed.

For clarity, OJT Hours is defined as the time in terms of hours spent in SGSPI commencing from
the time I clock in for my shift assignment for training (which includes CX training, product
training, nesting, go live) or performance of service delivery functions and/or support practice,
overtime work, training or coaching to be conducted before or after work shift, work rendered
on holidays or and/or rest days, and such hours as I may be required to perform activities
related to, and as laid out in my Training Plan. In which case, any time spent in the performance
of the foregoing activities shall be considered in the computation of my required OJT Hours.

8. In the event that I voluntarily manifest my intention to continue performing the activities
mentioned in Par. 7 above after my completion of my OJT Hours and beyond what is required
by my school, I understand that the same may only be continued upon my application with
SGSPI and being processed and accepted as a probationary employee of SGSPI. I understand
that until my admission to SGSPI as a probationary employee, I cannot be required to render
any service delivery and/or support office practice.

9. I further understand that in case I apply and get accepted as a probationary employee of SGSPI,
the OJT Hours rendered under the OJT Program shall be excluded from my probationary period.

10. I undertake to accomplish three (3) copies of this Agreement, ensuring that a copy is submitted
to the School, to SGSPI, and retain for myself the last copy. Likewise, I undertake to have my
parent/guardian to sign three (3) copies Parent’s/Guardian’s Waiver to the Student On the Job
Training Agreement, submitting a copy thereof to the School, to SGSPI, and retaining the last
copy for myself.

I hereby bind myself to terms and conditions of the Agreement for which I voluntarily affix my signature

Parent’s/Guardian’s Waiver on the
Student-Trainee On the Job Training

PARENT’S/GUARDIAN’S WAIVER
FOR THE STUDENT TRAINEE ON THE JOB TRAINING AGREEMENT

I, _______________________________, of legal age, resident of


______________________________________, hereby state that:
1. I am the parent/legal guardian of ______________________________, enrolled student of
__________________________ taking up ________________________ (course).
2. My child/ward, is a Student-Trainee at Sutherland Global Services Philippines, Inc., by virtue of
a Memorandum of Agreement between the latter and _________________________
(“School”)
(name of School) and of the Student-Trainee On the Job Training Agreement.
By allowing my child/ward to undergo work immersion, which includes performance of actual
service delivery activities or support office practice under the terms and conditions of the
StudentTrainee On the Job Training Agreement, I understand that there exists no employer-
employee relationship between SGSPI and my child/ward, notwithstanding my child’s/ward’s
receipt of any incidental monetary allowance from SGSPI as indicated in the Student-Trainee
On the Job Training Agreement.
3. I understand any monetary allowance received by my child/ward is given as incentive allowed
under CHED Memorandum Order No. 23, Series of 2009, and not in payment of, or
compensation for any training tasks/activities that may be related to the business of SGSPI.
4. I understand that while my child/ward, in the course of the training, may be issued by SGSPI
the following: Training ID and access badge, assigned a Trainee Number and such other access
or privileges that may be similar to a regular employee of SGSPI, and is required to obey SGSPI
rules and policies, none of the foregoing, however, shall be construed as constitutive of an
employeremployee relationship between SGSPI and my child/ward.
5. Any violation of SGSPI rules, regulations, policies, and/or misdemeanor committed by my
child/ward shall result in disciplinary action depending on the gravity of such violation and/or
misdemeanor, including but not limited to my child’s/ward’s immediate removal of my
child/ward from the training program.
6. I understand that my child/ward is expected to observe SGSPI’s rules, regulations and company
policy such as but not limited to training shifting schedules, training overtime requirement,
information security (infosec), confidentiality and non-disclosure, at all times.
7. I further understand that while there may be training tasks/activities requiring the presence of
my child/ward outside SGSPI premises, my child/ward has the option not to join the said
task/activity. Such exercise of the right to choose shall not be taken against my child/ward.
8. There being no employer-employee relationship between SGSPI and my child/ward, I shall hold
SGSPI, its officers, directors, free from any liability for any loss or damage to property or bodily
injury my child/ward might sustain in the course of the training, within or outside SGSPI
premises.
9. I confirm that the training period of my child/ward shall coincide with the OJT Hours required
by the School. Such that once the required OJT Hours, as defined in Par. 7 of the Student On
the Job Training Agreement, which I voluntarily co-signed with my child/ward, has been
completed, my child/ward is released from being a Student-Trainee of SGSPI
10. In the event that my child/ward decides to work for SGSPI after his/her completion of his/her
OJT Hours required by his/her School, I understand that, he/she needs to apply for and be
processed as a probationary employee.
11. Lastly, in the event that my child/ward applies for and gets accepted as a probationary
employee of SGSPI, I confirm that the OJT Hours of my child/ward shall not be considered as
part of his/her probationary employment.
