LGUs and National Gov’t in General: LGUs are agents of the State
LGUs and the SC: LGUs acts are subject to Judicial Review
Acts of LGUs are subject to judicial review, as under Sec 4 (2), 1987
Constitution, the SC has jurisdiction over all cases involving the constitutionality
of a treaty, international or EA, which shall be heard by the SC en banc, and all
other cases which under cases which under the ROC are required to be heard en
banc, including those involving the constitutionality, application, or operation of
PDs, proclamations, orders, instructions, ordinances, and other req’ts
Sec 4, Art X of Phil Consti provides that the President of the PH shall exercise
general supervision over local governments. Provinces with respect to component
cities and municipalities, and cities and municipalities with respect to component
barangays shall ensure that the acts of their component units are within the
scope of their prescribed powers and functions.
Consistent with the basic policy on local autonomy, the President shall exercise
general supervision over LGUs to ensure that their acts are within the scope of
their prescribed powers and functions. The President shall exercise supervisory
authority directly over provinces, HUCs, and ICC, through the province with
respect to component cities and municipalities; and through the city and
municipality with respect to barangays.
Nat’l agencies and offices with project implementation functions shall coordinate
with one another and with the LGUs concerned in the discharge of these
functions.
They shall ensure the participation of LGUs both in the planning and
implementation of said nat’l projects.
The President may, upon request of the LGU concerned, direct the appropriate
nat’l agency to provide financial, technical, or other forms of assistance to the
LGU.
Such assistance shall be extended at no extra cost to the LGU concerned.
