MARRIAGE 3. Attempt of respondent to corrupt or induce the petitioner, a

-permanent union between a man and a woman, entered into in
accordance with law not subject to stipulation by the parties involved
or the establishment of conjugal and family life.

Marriage Settlement
1. Absolute community regime
-everything owned by the husband and wife at the beginning of
marriage including whatever is earned or property acquired during
the marriage that is owned by both of them.
2. Conjugal property
-what either party bring to the marriage is his/her own, but what you
earn and acquire during the marriage is owned by both.
3. Complete separation of property
-whatever you bring to the family is your own. What you earn during
the marriage is your own. But both contributes to the upkeep and
maintenance of the family. Who earns more contributes more.

1. Authority of the solemnizing officer- valid marriage licence
2. Marriage ceremony- 2 parties are present in the presence of a
solemnizing officer with atleast 2 witnesses
LEGAL SEPARATION AND ANNULMENT OF MARRIAGE
 Legal Separation
- separation of bed and board, marriage still exists, cannot marry
another person
 Annulment of marriage
- can get married again, because marriage is considered disowned
as if it never happened.
-the defect/ grounds for annulment must be present during the time
of marriage except for psychological incapacity.
Psychological incapacity- you cannot portray your role as a
husband or a wife
Grounds for Legal Separation
Family Code of the Philippines: Article 55
1. Repeated physical violence or grossly abusive conduct directed
against the petitioner, a common child, or a child of the
petitioner;
2. Physical violence or moral pressure to compel the petitioner to
change religious or political affiliation;
common child, or a child of the petitioner, to engage in
prostitution, or connivance in such corruption or inducement;
4. Final judgment sentencing the respondent to imprisonment of
more than six years, even if pardoned;
5. Drug addiction or habitual alcoholism of the respondent;
6. Lesbianism or homosexuality of the respondent;
7. Contracting by the respondent of a subsequent bigamous
marriage, whether in the Philippines or abroad;
8. Sexual infidelity or perversion;
9. Attempt by the respondent against the life of the petitioner; or
10. Abandonment of petitioner by respondent without justifiable
cause for more than one year.
Grounds for Annulment of Marriage
Family Code of the Philippines: Article 45
1. Absence of Parental Consent.
A marriage was solemnized and one or the other party was
eighteen (18) years of age or over but below twenty-one (21)
and consent was not given by the parents, guardian or person
having substitute parental authority. The Petition of Annulment
must be filed within five (5) years of having attained the age
twenty-one. However, if the parties freely cohabited with the other
as husband and wife after having reached the age of twenty-one
(21) a Petition of Annulment can no longer be filed.
2. Mental Illness
One or the either party was of unsound mind at the moment of the
marriage. But if the parties freely cohabited with each other after
he or she came to reason the law prohibits the filing of a Petition.
3. Fraud
That the consent of either party was obtained by fraud, unless
such party once having knowledge of the fraud freely cohabited
with the other as husband and wife. The petition must be filed
within five (5) of finding out the facts of the fraud.
4. That the consent of either party was obtained by force,
intimidation or undue influence. Except when the same has
ceased and the party filing the petition freely cohabited with the other
as husband and wife. The injured party must file within five (5) years
from the point in time the force, intimidation or undue influence
disappeared or came to an end.
5. One or the other party was physically incapable of
consummating the marriage, and such incapacity continues and
appears to be incurable. The filing of the Petition of Annulment must
be filed within five (5) years after the marriage.
6. Either party was at the time of marriage afflicted with a sexually-
transmitted-disease (STD) found to be serious and seems to be
incurable. This may also constitute fraud. The filing of the Petition of
Annulment must be filed within five (5) years after the marriage.

ADULTERY
-a wife has sexual intercourse with a man who is not her husband
-the man has sexual intercourse with a woman knowing the woman
to be married
CONCUBINAGE
-applies to a married man
1. Married man repeated sexual intercourse with a woman under
scandalous circumstances
2. The man leaves his conjugal home and cohabitates with mistress
3. A married man and his wife have children, they live in a house, the
wife leaves the house to work (abroad). the husband takes his
mistress to live in there house.
PRE-MARITAL SEX
-sex before marriage
1. there must be the intention to get married
Imorral: To safe guard and preserve the sanctity of marriage. The
catholic church only permits sexual intercourse between the husband
the the wife (conjugal love).

2. Fornication.
-consensual sexual intercourse between two persons who are not
married to each other.
3. Responsibility on the part of the man is not ascertained.
-The man might possibly endanger the off spring.
-The man may not want to get married.
RESPONSIBLE PARENTHOOD
- control the number of children in the family

- hinges all the aspects of ovulation
2. Artificial method
- ways in order to prevent pregnancy
- spacing of children

Conclusion:
1.Husband and wife recognize their duties towards God, themselves,
family and society.

- Does not demand any method of birth control
- Choose methods of birth control
