iv) Further clause (f) of Article 17 of the Constitution prohibits a public servant from holding the position of an
office-bearer of the AAI. This will however, not apply to any Archers who may be public servants; To
clarify, except for an Archer, in no event can a public servant contest election to the Executive Committee
of AAI.
v) As per proviso to Clause (b) of Article 17 of the Constitution, for the purpose of first elections to be
conducted, the existing State and Associate Members shall send their representatives who are otherwise
eligible under the Constitution to form the General Council for the purpose of the election of Office-
bearers.
vi) Further no member State Archery Association can authorize any office bearers who is either a public
servant or above the age of 70. However, the President of the existing State Archery Associations/
Associate Members can send authorization as provided in clause (d) of Rule 4 of Election Bye-Laws of
Archery Association of India.
vii) For sake of clarity, "public servant" would mean any MP, MLA or Government servant. This would
include any individual who receives salary or emoluments drawn on the consolidated fund and
forming part of the State or National audit. Employees of corporations, nationalized banks,
municipalities and panchayats are also public servants. For further guidance, reference may be made to
the definition of "public servant" in Section 21 of the Indian Penal Code, 1860.

viii) Further the provision of Article 18 specifying tenure and age limits of Office Bearers of AAI is also
reproduced below :-
(a) The President of AAI shall hold office, with or without a break, for a maximum period of 12 years,
comprising 3 terms of 4 years each, subject to at least one term of cooling off between
consecutive terms.
(b) All other Office Bearers of the AAI may serve a maximum of two successive terms of 4 years each,
after which a person who has held any of these posts shall be able to seek election to the same or
any other post only after a cooling off period of one term. In any event, no individual shall be an
Office Bearer for more than 12 years. It is clarified that any fraction of a term served shall be
deemed to be the full term of 4 years.
(c) All Office Bearers, shall, without exception, cease to hold these posts on attaining the age of
seventy (70) years, or in the event of being charged of an offence by a court of law.
The above clarifications are issued for the benefit of all stakeholders. They are advised to keep the above points
into consideration while submitting the names of Authorized Representatives within the deadline i.e. by 3.00 PM
of 07.12.2018 already notified on 04.10.2018. In case any Member State Archery Association/Associate Member
wants to revise their earlier intimation in view of above clarification, they may do so within the given deadline.
All stakeholders may refer to the other provisions of the Constitution for complete understanding of the clauses
of the amended Constitution.
