This agreement made and entered into by and between:

JOHN JEOFFREY CUENCO, Married, of legal age, Filipino, with permanent address at Brgy.
Butnga, Oras, Eastern Samar, Herein referred to as “CLIENT”.

and

NALUIN P.CASTRO , Filipino, of Legal age, with office address at Jayan’s Catering, F. Llamas St.,
Punta Princesa, Cebu City, herein referred to as “LIPAT BAHAY”.

Witnesseth: That -

Whereas, CLIENT has secured the services of LIPAT BAHAY and LIPAT BAHAY has agreed to
transport the CLIENT’s belongings, from Tisa, Cebu City to Butnga, Oras Eastern Samar on
October 24 to 25, 2018, for a fee, agreed beforehand by the two parties, and the exact
breakdown of those fees are listed in paragraph 1.1.

1. Fees

1.1 Breakdown of agreed fees

 Truck rental – Php 9,600.00 (Php 4,800 per day)

 Driver fee – Php 1,000.00 (Php 500.00 per day)
 Two (2) Helpers – Php 1,600 (Php 400 each helper per day)
 Meal Allowance (for driver and 2 helpers) – Php 1,800 (100 per person per meal
meal at 3 meals per day)
 Boat Fare for 2 persons – 1,400.00 (at 700.00 per way)
 Fuel Deposit – Php 7,000.00 (Actual consumption will be billed to CLIENT)
 Freight charges – Php 11,000.00 (at 5,500 per way) (Actual charges will be billed
to CLIENT)

1.2 Billing

1.2.1 That the total cost of the fees, as listed in paragraph 1.1, is THIRTY
THREE THOUSAND FOUR HUNDRED pesos only (Php 33,400.00 only).
1.2.2 That the charges for the fuel and the freight, the actual costs will be
billed to the CLIENT. In the event that the actual fuel and freight
charges costs will be higher than the amount reflected in Paragraph 1.1,
the CLIENT will cover those extra charges. If it will be lower than the
amounts agreed upon, the difference will be deducted from the total
amount by the LIPAT BAHAY.
 1.2.3 That the CLIENT agrees to pay an advance deposit of Twenty Thousand
Pesos upon execution of this contract and further agrees to pay to LIPAT
BAHAY the remaining balance of the agreed fee, upon delivery of his
belongings to Butnga, Oras, Eastern Samar.

2. Terms

2.1 WHEREAS, LIPAT BAHAY agrees to bear the responsibility of transporting

the CLIENT’s belongings, from Tisa, Cebu City to Butnga, Oras, Eastern Samar,
safely and with due diligence of a good father.

2.2 That for this service, CLIENT has agreed to pay, in cash, the agreed amount as
stated in Paragraph 1.1, with the proper adjustments applied, as stated in
paragraph 1.2.2.

2.3 That upon complete delivery of all the CLIENT’s belongings to Butnga, Oras,
eastern Samar, both the CLIENT and LIPAT BAHAY will be free of any and all
legal encumbrances from this agreement, so long as the belongings were
transported safely and completely and all the agreed fees with the necessary
adjustments were paid for.

2.4 That both parties agree to all the conditions set in this agreement and if any
party reneges on his obligation, will be liable to pay the full amount and an
additional fifty percent (50%) of the total contract price, without need for an
order from a court of law.

In witness whereof, the parties have hereunto affixed their signatures this __ day of October, 2018 at
Cebu City, Cebu, Philippines.
