d). Duty of Care ( Occupational Safety and Health Act (OSHA) )

Occupational Safety and Health Act 1970


- This Act involves enforcing a set of rules and regulations for a business to
follow in order to promote safer and healthier working conditions for
employees. OSHA basically ensures that the safety, health and welfare of
employees are respected and protected in the workplace.

Pros of OSHA;
- Holds industries accountable for a set safety standard
- Specific standards for hazards
- Encourages compliance for workers
- Insures workers safety and health

Cons of OSHA;
- Not all employees are covered ( self-employed, independent farmers)
- There are only minimal standards that are set
- Some standards may been out of date
- Not 100% effective in preventing injuries or accidents

(Example situations things)

OSHA’s safety and health standards, including those for asbestos, fall
protection, cotton dust, trenching, machine guarding, benzene, lead and
bloodborne pathogens.

- Inform workers about chemical hazards through training, labels, alarms,


color-coded systems, chemical information sheets and other methods.
- Provide safety training to workers in a language and vocabulary they can
understand.
- Keep accurate records of work-related injuries and illnesses.
- Perform tests in the workplace, such as air sampling, required by some
OSHA standards.

Why should OSHA regulations be followed?

- Compliance with OSHA regulations along with implementing your own


well-designed safety program can save your business money. Accidents
and injuries occurring on the job can result in major medical and legal
expenses. Also, Training your employees and having a program in place
may mostly likely prevent these costly incidents from occurring.
Therefore, maintaining a safe environment for your workers rewards you
with increased productivity and higher morale as well.

What is the Impact of OSHA on Business?


- It ensures the safety and health issues of the employees are taken cared
during their working period which can result as an increase in
productivity.
- It reduce the chances of accidents to happen and reduce lose in an
accident for the business.
- It provides a sense of security to the employees which make them buy
into the business.
- Starting a new business can be challenging. OSHA can help by
explaining the federal regulatory requirements concerning safety and
health and help you create a safe and healthful workplace for your
employees that conforms to federal law.
