REPUBLIC OF THE PHILIPPINES

SANGGUNIANG PANLUNGSOD

PROPOSED ORDINANCE NO. ____ SERIES OF 2019

AN ORDINANCE REQUIRING ALL BARANGAYS WITHIN THE


JURISDICTION OF THIS CITY\MUNICIPALITY TO PROVIDE FOR
COMMON PARKING SPACES FOR PRIVATE VEHICLES WITHOUT
PERSONAL PARKING AREAS

Whereas, Section 16, Of Republic Act No. 7160, Otherwise


Known As The Local Government Code Of 1991, Provides That Every
Local Government Unit Shall Exercise The Powers Expressly Granted,
Those Necessarily Implied Therefrom, As Well As Powers Necessary,
Appropriate, Or Incidental For Its Efficient And Effective Governance,
And Those Which Are Essential To The Promotion Of The General
Welfare. Within Their Respective Territorial Jurisdictions, Local
Government Units Shall Ensure And Support, Among Other Things,
The Preservation And Enrichment Of Culture, Promote Health And
Safety, Enhance The Right Of The People To A Balanced Ecology,
Encourage And Support The Development Of Appropriate And Self-
Reliant Scientific And Technological Capabilities, Improve Public
Morals, Enhance Economic Prosperity And Social Justice, Promote Full
Employment Among Their Residents, Maintain Peace And Order, And
Preserve The Comfort And Convenience Of Their Inhabitants.

Whereas, Section 17 Of Republic Act No. 7160, Otherwise


Known As The Local Government Code Of 1991, Provides That (A)
Local Government Units Shall Endeavor To Be Self-Reliant And Shall
Continue Exercising The Powers And Discharging The Duties And
Functions Currently Vested Upon Them. They Shall Also Discharge
The Functions And Responsibilities Of National Agencies And Offices
Devolved To Them Pursuant To This Code. Local Government Units
Shall Likewise Exercise Such Other Powers And Discharge Such Other
Functions And Responsibilities As Are Necessary, Appropriate, Or
Incidental To Efficient And Effective Provisions Of The Basic Services
And Facilities Enumerated Herein.

(B) Such Basic Services And Facilities Include, But Are Not
Limited To, The Following:

(1) For Barangay:

(VI) Infrastructure Facilities Such As Multi-Purpose Hall,


Multipurpose Pavement, Plaza, Sports Center, And Other Similar
Facilities;

Whereas, Section 384 Of Republic Act No. 7160, Otherwise


Known As The Local Government Code Of 1991, Provides That As
The Basic Political Unit, The Barangay Serves As The Primary
Planning And Implementing Unit Of Government Policies, Plans,
Programs, Projects, And Activities In The Community, And As A
Forum Wherein The Collective Views Of The People May Be
Expressed, Crystallized And Considered, And Where Disputes May Be
Amicably Settled.

Whereas, Article IV, Section 46 Of Republic Act No. 4136,


Otherwise Known As An Act To Compile The Laws Relative To Land
Transportation And Traffic Rules, To Create A Land Transportation
Commission And For Other Purposes, Provides That No Driver Shall
Park A Vehicle, Or Permit It To Stand, Whether Attended Or
Unattended, Upon A Sidewalk, Street, Gutter and Highway In Any Of
The Following Places:

A. Within An Intersection
B. On A Crosswalk
C. Within Six Meters Of The Intersection Of Curb Lines.
D. Within Four Meters Of The Driveway Entrance To And Fire
Station.
E. Within Four Meters Of Fire Hydrant
F. In Front Of A Private Driveway
G. On The Roadway Side Of Any Vehicle Stopped Or Parked
At The Curb Or Edge Of The Highway
H. At Any Place Where Official Signs Have Been Erected
Prohibiting Parking.

Whereas, Article V, Section 52 Of Republic Act No. 4136,


Otherwise Known As An Act To Compile The Laws Relative To Land
Transportation And Traffic Rules, To Create a barangay local office
for the purposes of administering and managing, directing And For
Other Purposes, Provides That No Person Shall Drive Or Park A Motor
Vehicle Upon Or Along Any Sidewalk, Path Or Alley Not Intended For
Vehicular Traffic Or Parking.

NOW, THEREFORE, BE IT ORDAINED by the Sangguniang


Panlungsod of Caloocan City pursuant to the provisions of the 1987
Philippine Constitution and other pertinent laws that:

SECTION 1. Title of the Ordinance. – This Ordinance shall be


known as the “ “

SECTION 2. Purposes.

Section 3. Declaration of Policy. As used in this Ordinance, the


following words and phrases shall mean as follows:

Setion 4. Definition of Terms.

Section 5. Local Commission for Parking and Traffic.

The Local Commission for Parking and Traffic herein referred to


as composed of the following members:

 Chief of Local Commission for Parking and Traffic who


should be a member of the Barangay Council voted by
the members in special meeting created for that purpose

 Secretary who is a member of the Barangay Council voted


by the members in a special meeting for that purpose

 Treasurer appointed by the City Mayor from the list


recommended by the City Treasurer

 Assistant Chief for Parking and Traffic Division

 Assistant Chief for Vehicle Registration Division

Section 6. Roles and Functions of Local Commission for Parking


and Traffic.

The LCPT, as the implementing office, shall handle the


registration of Filipino and Non-Filipino residents owning, renting,
leasing and possessing vehicles for private use.

Likewise, the LCPT shall administer, manage, regulate, oversee


and control the financing including the collection, disbursement,
funding, and distribution of funds appropriated for the LCPT,
provided that monthly financial statements comprising of statement
of assets and liabilities, statement of collection, statement of
disbursements, and other supporting notes to the financial
statements signed by the Chief of the LCPT, Secretary and Treasurer
to be submitted to the Office of the Mayor.

Section 7. The Vehicle Registration System.

The Vehicle Registration system herein referred to as the “VR


System” is hereby established and instituted as an economic tool
towards the attainment of a progressive implementation of local
traffic ordinances. The VR system shall provide official identification
of all residents within each barangay who shall be subject to the
regularized rate prescribed by the LCPT. It shall gradually concert
and consolidate the list and information of residents within each
barangay.

Section 8. Terms and Conditions.

The VR System shall be in exclusion of those residents that are


living, staying or situated in the following areas:

 Gated Private Subdivision


 Condominium with parking lots built for the usage of its
inhabitants

However, if such residents choose to register under VR System,


they shall be allowed provided that said residents do not have
adequate parking space within their vicinity. Likewise, those residents
with adequate and specific garage or parking space for their private
vehicles may, at their option, avail and list under VR System.

Further, Vehicles registered under VR System shall be classified


based on the following:

Class 1 vehicles (motorcycles, cars, pickups, private jeepneys,


vans, and vehicles with 2-axles and 7ft. height).

Class 2 vehicles (buses, trucks with 2-axles and 7ft. above


height and light vehicles with more than 2-axles and 7ft. height).

Class 3 vehicles (trucks with 3 or more axles and 7ft. above


height).
Registration Fees, interests, surcharges, compromise and other
penalties shall be prescribed and regulated by the Vehicle
Registration Division, subject to the monitoring of the Board of
Council of each barangay.

Section 9. Rules and Regulations involving the Parking and


Traffic Division.

The Parking and Traffic Division shall control, regulate and


manage the circadian operation of the designated parking lot, and all
other administrative functions such as the following:

 Creating, organizing, forming and developing


units and sub-unit of the Parking and Traffic Division per
barangay

 Hiring, engaging, contracting, suspending and


dismissing parking attendants, parking cleaners and
security guards

 Determining, fixing, prescribing, or


periodically adjusting fares or rates for the service
provided in the parking zone after public hearing within
the residents of each barangay;

Each designated parking unit shall be required to secure the


Rate matrix from the Parking and Traffic Division as signed by the
Office of the Municipal Treasurer. Said approved Rate matrix shall be
displayed in full view to the parking attendees who are residents and
non-residents including guests, visitors, tourists and transients of the
barangay.

A penalty of ₱10,000.00 shall be imposed to unit or sub-unit


who charge parking attendees but fail to display the approved matrix.

The following are the new fare rates for motorized tricycles
operating in the Municipality of Tigbauan, Province of Iloilo:
