RULE 110

SECTION 3 COMPLAINT

A complaint is a sworn written statement charging a person with an offense, subscribed by the
offended party, any peace officer, or other public officer charged with the enforcement of the law
violated.

SECTION 4 INFORMATION

An information is an accusation in writing charging a person with an offense, subscribed by the


prosecutor and filed with the court.

SECTION 5 Paragraph 4

Where the offended party, who is a minor, fails to file the complaint, her PARENTS,
GRANDPARENTS, or GUARDIAN may file the same.

SECTION 6 Sufficiency of complaint or information [6]

A complaint or information is sufficient if it states the 1NAME of the ACCUSED; the


2DESIGNATION of the offense given by the statute; the 3ACTS or OMISSIONS complained of as
constituting the offense; the 4NAME of the OFFENDED party; the 5APPROXIMATE DATE of the
commission of the offense; and the 6PLACE where the offense was committed.

SECTION 1

RIGHTS OF THE ACCUSED [9]

A) To be presumed INNOCENT until the contrary is proved beyond reasonable doubt;


B) To be INFORMED of the nature and cause of the accusation against him;
C) To be PRESENT and DEFEND in person an by counsel at every stage of the proceedings, from
arraignment to promulgation of the judgment;
D) To TESTIFY as a witness in his own behalf but subject to cross-examination on matters covered
by direct examination. His silence shall not in any manner prejudice him;
E) To be EXEMPT from being compelled to be a witness against himself;
F) To confront and cross-examine the witnesses against him at the trial.
G) To have COMPULSARY process issued to secure the attendance of witnesses and production of
other evidence in his behalf;
H) To have SPEEDY, IMPARTIAL, and PUBLIC trial;
I) To APPEAL in all cases allowed and in the manner prescribed by law.
